Two features of Puerto Rico's interrogatory rule catch federal practitioners off guard. There is no numerical cap anywhere in Rule 30. And an objection is not a line in the response — it is a motion filed in place of the answer.

Who answers, and when you may ask

P.R. R. Civ. P. 30.1 starts with the parties and the timing.

Any party may serve upon any other party written interrogatories to be answered by the party served or, if the party served is a public or private corporation or a partnership, association or government agency, by any officer, official, or agent, who shall furnish such information as is available to the party. Interrogatories may be served upon the plaintiff without leave of court after commencement of the action. They may also be served upon any other party to the action, insofar as the thirty (30) day term following the date of service has elapsed. If the defendant begins to conduct any kind of discovery within the aforementioned term such limitation shall not apply.

Two things follow from that timing rule. A plaintiff can be served with interrogatories as soon as the case exists. Every other party gets a thirty-day buffer after being served with process — a buffer the defendant forfeits by starting discovery early. The same structure governs depositions under Rule 27.1.

Note also who must answer for an organization: any officer, official or agent, who must furnish the information available to the party — not merely what that individual happens to know.

The count that isn't there

Rule 30 sets no numerical limit on interrogatories. There is no equivalent of the federal cap of twenty-five questions including discrete subparts, and no requirement to seek leave for more.

That does not mean there is no ceiling. The limits come from Rule 23.2, which lets the court cut discovery back where it is unreasonably cumulative or duplicative, obtainable more conveniently elsewhere, already available to the requesting party, or disproportionately expensive. The difference is procedural but real: in federal court the excess is presumptively improper; here the burden of complaining sits with the party that received the questions.

Answering

Each interrogatory shall be answered separately and fully in writing under oath, unless it is objected to.

And the answers are personal:

The answers shall be signed and sworn by the person making them.

The deadline runs from service:

The party upon whom the interrogatories have been served shall serve a copy of the answers or objections, if any, or both, upon the party who served the interrogatories within thirty (30) days after service of the interrogatories. The court may, upon notice and good cause shown, allow a shorter or longer time.

Note that an extension requires notice and good cause — not merely an agreement recited in a letter.

Objecting: a motion, not a line in the response

This is the mechanic that differs most from federal practice.

If the interrogatory is objected to, the reasons for objection shall be stated by motion in lieu of an answer, and a copy of the interrogatory objected to shall be furnished.

A partial objection is more demanding still:

If only part of the interrogatory is objected to, the party objecting to it shall include the question verbatim with a statement of the reasons for objection, in which event the objecting party and shall serve, together with the objections, the answers to the remainder of the interrogatory upon the party who submitted it.

Three obligations in one sentence. Quote the question word for word. State the reasons. And answer everything you did not object to, served together with the objection.

Objecting to the answers you receive

The rule works in the other direction too, and it is equally formal.

The party submitting the interrogatories may object to the answers thereto, subject to the provisions of Rule 34.1, by motion addressed to the court that shall include a verbatim transcript of the question and of the answer involved and the grounds for objection. The party submitting the interrogatories may move for an order under Rule 34 with respect to any objection to or other failure to answer an interrogatory.

Two requirements worth marking. The motion must reproduce both the question and the answer word for word. And it is "subject to the provisions of Rule 34.1" — which means it must carry the good-faith certification described in the motion to compel. A discovery motion without that certification is one the court may not consider.

What you can ask about

Rule 30.2 points at the scope rule and then settles a recurring fight.

Interrogatories may relate to any matter that can be inquired into under Rule 23, and the answers may be used to the extent permitted by the Rules of Evidence. An interrogatory otherwise proper is not necessarily objectionable merely because an answer to the interrogatory involves an opinion or contention that relates to fact or to conclusions of law, but the court, upon good cause shown, may order that such an interrogatory need not be answered or that it be answered at a time and under such conditions as it may deem reasonable.

Contention interrogatories are permitted. The remedy for one that arrives too early is timing, not refusal — the court may defer the answer rather than excuse it.

Producing records instead of answering

Rule 30.3 is the option that saves work when the answer lives in the files.

Where the answer to an interrogatory may be derived from the books, documents, records, or electronically stored information of the party upon whom the interrogatory has been served, and the burden of deriving the answer is substantially the same for the party serving the interrogatory as for the party served, it is a sufficient answer to such interrogatory to specify the records, books, documents, or electronically stored information from which the answer may be derived and to afford to the party serving the interrogatory reasonable opportunity to examine, inspect or audit them and to make copies, compilations, summaries, or hard copies.

The condition is equality of burden, not convenience. And the access promised includes the right to audit the records, a word the federal rule does not use.

The absence of a cap is the headline, but the objection mechanics are what will cost you if you overlook them. A response that lists objections inline, in federal style, has not complied with Rule 30.1.

A short checklist

  • Check the calendar before serving. The plaintiff can be served at once; everyone else gets thirty days from service of process.
  • Do not assume a limit of twenty-five — and do not assume volume is safe either. Rule 23.2 is the real constraint.
  • Have the person who knows sign and swear the answers.
  • Object by motion, attach the interrogatory, and answer everything else at the same time.
  • Quote the question verbatim in any partial objection.
  • When challenging an answer, reproduce the question and the answer and add the Rule 34.1 certification.
  • Consider Rule 30.3 when the answer sits in records — but only when the burden is truly equal.
  • Do not refuse a contention interrogatory outright. Ask for time instead.

Quién contesta, y cuándo se puede preguntar

La Regla 30.1 empieza por las partes y el calendario.

Una parte podrá notificar interrogatorios por escrito a cualquier otra parte para ser contestados por la parte así notificada, o si ésta es una corporación pública o privada o una sociedad, asociación o agencia gubernamental, por cualquier(a) oficial, funcionario(a) o agente de éstas, quien suministrará aquella información que esté al alcance de la parte. Los interrogatorios podrán ser notificados a la parte demandante luego del comienzo del pleito sin el permiso del tribunal. Los interrogatorios podrán también ser notificados a cualquier otra parte siempre que haya transcurrido el término de los treinta (30) días siguientes a la fecha de su emplazamiento. Si la parte demandada inicia cualquier tipo de descubrimiento dentro del referido plazo, dicha limitación no será de aplicación.

De esa regla de tiempo se siguen dos cosas. A la parte demandante se le puede interrogar apenas exista el pleito. Las demás partes tienen un colchón de treinta días desde su emplazamiento, colchón que la parte demandada pierde si empieza a descubrir antes. La misma estructura rige las deposiciones bajo la Regla 27.1.

Fíjese también en quién contesta por una organización: cualquier oficial, funcionario o agente, que debe suministrar la información al alcance de la parte, no solo lo que esa persona recuerde.

El número que no está

La Regla 30 no fija límite numérico de interrogatorios. No hay equivalente del tope federal de veinticinco preguntas con sus subpartes, ni permiso que pedir para exceder.

Eso no significa que no haya techo. Los límites llegan por la Regla 23.2, que permite recortar el descubrimiento irrazonablemente acumulativo o duplicado, el que puede obtenerse por vía más conveniente, el que la parte ya tuvo oportunidad de conseguir, o aquel cuyo costo excede su beneficio. La diferencia es procesal pero real: en el foro federal el exceso es presuntamente impropio; aquí la carga de quejarse recae sobre quien recibió las preguntas.

Contestar

Cada interrogatorio será contestado por escrito, en forma separada y completa, y bajo juramento, a menos que sea debidamente objetado.

Y las contestaciones son personales:

Las contestaciones deberán ser firmadas y juradas por la persona que las da.

El término corre desde la notificación:

La parte a la cual le sean notificados los interrogatorios deberá entregar una copia de las contestaciones o de las objeciones, si algunas, o de ambas conjuntamente, a la parte que formuló dicho interrogatorio dentro del término de treinta (30) días a partir de la fecha de notificación del interrogatorio. El tribunal podrá, previa moción al efecto y por razones justificadas, ampliar o acortar este término.

Fíjese en que la prórroga requiere moción y razones justificadas, no un acuerdo recogido en una carta.

Objetar: una moción, no una línea en la contestación

Ésta es la mecánica que más difiere de la práctica federal.

Si el interrogatorio es objetado, se expondrán mediante moción las razones para ello en sustitución de la contestación, y se deberá acompañar copia del interrogatorio objetado.

La objeción parcial es todavía más exigente:

Si sólo se objeta parte del interrogatorio, la parte que lo objeta deberá incluir literalmente la pregunta así como los fundamentos en que se basa la objeción. En este caso, la parte objetante, junto con sus objeciones, deberá notificar a la parte que sometió el interrogatorio las contestaciones a la parte no objetada de éste.

Tres obligaciones en una oración. Cite la pregunta palabra por palabra. Exponga los fundamentos. Y conteste todo lo que no objetó, junto con la objeción.

Objetar las contestaciones que recibe

La regla funciona también en la otra dirección, y con el mismo formalismo.

La parte que somete un interrogatorio podrá objetar las contestaciones, sujeto a lo dispuesto en la Regla 34.1, mediante una moción al tribunal que incluya una transcripción literal de la pregunta y de la contestación concernida y los fundamentos en que se basa la objeción. La parte que somete un interrogatorio puede solicitar una orden bajo las disposiciones de la Regla 34 con relación a cualquier objeción u omisión en la contestación a un interrogatorio.

Dos exigencias que conviene marcar. La moción debe reproducir literalmente la pregunta y la contestación. Y está "sujeto a lo dispuesto en la Regla 34.1", lo que significa que debe traer la certificación de buena fe descrita en la moción para compeler. Una moción de descubrimiento sin esa certificación es una que el tribunal no puede considerar.

Sobre qué se puede preguntar

La Regla 30.2 remite a la regla de alcance y luego zanja una discusión recurrente.

Los interrogatorios pueden referirse a cualquier asunto que pueda ser investigado bajo las disposiciones de la Regla 23 y las contestaciones pueden ser usadas según lo permitan las Reglas de Evidencia. Un interrogatorio que de otra forma sea apropiado no es necesariamente objetable porque su contestación implique una opinión o contención relacionada con hechos o conclusiones de derecho, pero el tribunal, por causa justificada, podrá ordenar que dicho interrogatorio no sea contestado o lo sea en el tiempo y dentro de las circunstancias que estime razonable.

Los interrogatorios de contención están permitidos. El remedio para el que llega demasiado temprano es el tiempo, no la negativa: el tribunal puede diferir la contestación en vez de excusarla.

Producir expedientes en lugar de contestar

La Regla 30.3 es la salida que ahorra trabajo cuando la respuesta vive en los archivos.

Cuando la contestación a un interrogatorio pueda encontrarse en libros, documentos, expedientes o en información almacenada electrónicamente, por la parte a la cual se le ha formulado el interrogatorio, y el peso de obtener dicha contestación es sustancialmente igual para la parte interrogante que para la parte interrogada, constituye suficiente contestación a dicho interrogatorio el precisar la parte específica de los expedientes, libros, documentos o de la información almacenada electrónicamente de los cuales la contestación puede ser obtenida y ofrecerle a la parte interrogante una oportunidad razonable para el examen, la inspección o la auditoría de éstos y para la preparación de copias, compilaciones, resúmenes o impresos.

La condición es la igualdad del peso, no la comodidad. Y el acceso prometido incluye el derecho a auditar los expedientes, palabra que la regla federal no usa.

La ausencia de tope es el titular, pero lo que cuesta caro es pasar por alto la mecánica de las objeciones. Una contestación que enumera objeciones en línea, al estilo federal, no ha cumplido con la Regla 30.1.

Una lista breve

  • Mire el calendario antes de notificar. A la parte demandante se le interroga de inmediato; a las demás, treinta días después del emplazamiento.
  • No presuma un tope de veinticinco, ni presuma que el volumen es seguro. La Regla 23.2 es el límite real.
  • Que firme y jure las contestaciones quien de verdad sabe.
  • Objete por moción, acompañe el interrogatorio y conteste lo demás al mismo tiempo.
  • Cite la pregunta literalmente en toda objeción parcial.
  • Al impugnar una contestación, reproduzca pregunta y contestación y añada la certificación de la Regla 34.1.
  • Considere la Regla 30.3 cuando la contestación esté en expedientes, pero solo si el peso es verdaderamente igual.
  • No rechace de plano un interrogatorio de contención. Pida tiempo.
