It shall be the duty of the clerk to forthwith and pursuant to the rules fixed by the Supreme Court, serve notice of the judgments rendered by the court, filing in the record a copy of the judgment and of the notice thereof, and registering the judgment. The annotation of a judgment in the Registry of Actions, Proceedings and Interlocutory Decisions shall constitute the entry of the judgment. The judgment shall not become effective until a copy of the notice sent to all parties is filed in the record, and the term to appeal shall run from the date such notice is filed.
Será deber del Secretario o de la Secretaria notificar a la mayor brevedad posible, dentro de las normas que fije el Tribunal Supremo, las sentencias que dicte el tribunal, archivando en autos copia de la sentencia y de la constancia de la notificación y registrando la sentencia. La anotación de una sentencia en el Registro de Pleitos, Procedimientos y Providencias Interlocutorias constituye el registro de la sentencia. La sentencia no surtirá efecto hasta archivarse en autos copia de su notificación a todas las partes y el término para apelar empezará a transcurrir a partir de la fecha de dicho archivo.

What this rule doesQué hace esta regla

The shortest rule in the chapter and one of the most consequential, because it fixes the moment everything else counts from.

The clerk’s duty. The clerk shall forthwith, and pursuant to the rules fixed by the Supreme Court, serve notice of the judgments rendered, file in the record a copy of the judgment and of the notice, and register the judgment.

Entry defined. The annotation of a judgment in the Registry of Actions, Proceedings and Interlocutory Decisions constitutes the entry of the judgment. Rule 66 is the registry itself.

The two consequences. The judgment shall not become effective until a copy of the notice sent to all parties is filed in the record. And the term to appeal runs from the date that notice is filed.

Both halves matter and they are easy to conflate. A judgment signed and dated by the judge does nothing until the notice is filed. And the appeal clock has no relationship to the judgment’s own date — a fact that runs through the rest of the rules, which key their terms to "a copy of the notice of the judgment is filed in the record": Rule 43.1’s fifteen days for amended findings, Rule 44.1(b)’s ten days for costs, and the periods in Rules 47, 48 and 52.2.

La regla más breve del capítulo y una de las de mayor consecuencia, porque fija el momento desde el que todo lo demás cuenta.

El deber de la secretaría. Deberá inmediatamente, y conforme a las reglas que fije el Tribunal Supremo, notificar las sentencias dictadas, archivar en autos copia de la sentencia y de su notificación, y registrar la sentencia.

El registro definido. La anotación de la sentencia en el Registro de Pleitos, Procedimientos y Providencias Interlocutorias constituye el registro de la sentencia. La Regla 66 es ese registro.

Las dos consecuencias. La sentencia no surtirá efecto hasta que se archive en autos copia de la notificación enviada a todas las partes. Y el término para apelar corre desde la fecha de ese archivo.

Ambas mitades importan y se confunden con facilidad. Una sentencia firmada y fechada por el juez no hace nada hasta que se archiva la notificación. Y el reloj de la apelación no guarda relación con la fecha de la sentencia, hecho que atraviesa el resto de las reglas, que atan sus términos a que “se archive en autos copia de la notificación de la sentencia”: los quince días de la Regla 43.1, los diez de la 44.1(b) para las costas, y los períodos de las Reglas 47, 48 y 52.2.
