No judgment by default shall be entered in any case for collection of money filed against the Commonwealth of Puerto Rico, its municipalities, agencies, instrumentalities or corporations, or against an officer acting in his or her official capacity, unless the claimant establishes a claim or right to relief by evidence satisfactory to the court.
En todo caso de cobro de dinero en el que se reclame al Estado Libre Asociado de Puerto Rico, a sus municipios, agencias, dependencias o a un funcionario o funcionaria en su carácter oficial, no se dictará sentencia en rebeldía a menos que la parte reclamante pruebe a satisfacción del tribunal su reclamación o derecho al remedio que solicita.
What this rule doesQué hace esta regla
A narrow but firm protection. No judgment by default shall be entered in any case for collection of money filed against the Commonwealth of Puerto Rico, its municipalities, agencies, instrumentalities or corporations, or against an officer acting in an official capacity — unless the claimant establishes a claim or right to relief by evidence satisfactory to the court.
What the rule removes is the ordinary effect of default. Under Rule 45.1 an entry admits the averments of the affirmative pleadings; here the claimant must still prove them. Silence by the government does not concede the claim.
Note the two limits on the protection. It applies to cases for collection of money — not to every case against the government — and it does not bar default judgment outright; it converts it into a judgment that must be earned on evidence.
The provision fits a pattern across these rules. Rule 10.1 gives the government sixty non-extendable days to plead; Rule 44.3(b) exempts it from pre-judgment obstinacy interest; Rule 34.6 requires a hearing before fees are imposed on it; and Rule 44.2 sends sanctions against it to the opposing party rather than to the Judicial Branch fund.
Read with Rule 45.2(b): where the court must establish the truth of an averment by evidence, it holds hearings or refers the matter to a master. That is the machinery this rule relies on.
Una protección estrecha pero firme. No se dictará sentencia en rebeldía en ningún caso de cobro de dinero presentado contra el Estado Libre Asociado de Puerto Rico, sus municipios, agencias, instrumentalidades o corporaciones, ni contra un funcionario en su carácter oficial, salvo que quien reclama establezca su reclamación o derecho a un remedio con prueba satisfactoria al tribunal.
Lo que la regla elimina es el efecto ordinario de la rebeldía. Bajo la Regla 45.1 la anotación admite las aseveraciones de las alegaciones afirmativas; aquí hay que probarlas igual. El silencio del gobierno no concede la reclamación.
Note los dos límites de la protección. Aplica a los casos de cobro de dinero —no a todo pleito contra el gobierno— y no prohíbe de plano la sentencia en rebeldía: la convierte en una que hay que ganarse con prueba.
La disposición encaja en un patrón de estas reglas. La Regla 10.1 da al gobierno sesenta días improrrogables para alegar; la 44.3(b) le exime del interés por temeridad anterior a la sentencia; la 34.6 exige vista antes de imponerle honorarios; y la 44.2 envía las sanciones en su contra a la parte adversa y no al fondo de la Rama Judicial.
Léase con la Regla 45.2(b): cuando el tribunal debe establecer la veracidad de una aseveración mediante prueba, celebra vistas o refiere el asunto a un comisionado. Esa es la maquinaria en que esta regla se apoya.
