A party adversely affected by an order or resolution of the Court of First Instance may file a motion for reconsideration thereof within the strict-compliance term of fifteen (15) days after the date of notice of such order or resolution.
A party adversely affected by a judgment of the Court of First Instance may file a motion for reconsideration thereof within the jurisdictional term of fifteen (15) days after the date on which a copy of the notice of judgment was filed in the record.
The motion for reconsideration must set forth specifically and particularly the facts and the law that the moving party deems should be reconsidered and must be grounded on substantial matters related to relevant findings of fact or material conclusions of law.
A motion for reconsideration that does not meet the specificity requirements of this rule shall be denied, and the term to appeal will not have been interrupted.
Once the motion for reconsideration has been filed, the terms for taking appeal shall be interrupted for all parties. The terms shall start to run again as of the date on which a copy of the notice of the resolution on the motion for reconsideration is filed in the record.
The motion for reconsideration shall be served on the other parties to the action within the term of fifteen (15) days provided herein so that it coterminous with the time for filing with the court. The term to serve notice is of strict compliance.
La parte adversamente afectada por una orden o resolución del Tribunal de Primera Instancia podrá presentar, dentro del término de cumplimiento estricto de quince (15) días desde la fecha de la notificación de la orden o resolución, una moción de reconsideración de la orden o resolución.
La parte adversamente afectada por una sentencia del Tribunal de Primera Instancia podrá presentar, dentro del término jurisdiccional de quince (15) días desde la fecha de archivo en autos de copia de la notificación de la sentencia, una moción de reconsideración de la sentencia.
La moción de reconsideración debe exponer con suficiente particularidad y especificidad los hechos y el derecho que el promovente estima que deben reconsiderarse y fundarse en cuestiones sustanciales relacionadas con las determinaciones de hechos pertinentes o conclusiones de derecho materiales.
La moción de reconsideración que no cumpla con las especificidades de esta regla será declarada “sin lugar” y se entenderá que no ha interrumpido el término para recurrir.
Una vez presentada la moción de reconsideración quedarán interrumpidos los términos para recurrir en alzada para todas las partes. Estos términos comenzarán a correr nuevamente desde la fecha en que se archiva en autos copia de la notificación de la resolución resolviendo la moción de reconsideración.
La moción de reconsideración se notificará a las demás partes en el pleito dentro de los quince (15) días establecidos por esta regla para presentarla ante el tribunal de manera simultánea. El término para notificar será de cumplimiento estricto.

Reconsideration is the first thing to try after a bad ruling, and it is the step most often lost on a technicality.
Two clocks, both fifteen days, but not the same kind of clock. Against an order or resolution, the term is of strict compliance and runs from the date of notice. Against a judgment, it is jurisdictional and runs from the date a copy of the notice of judgment was filed in the record. A strict-compliance term can be extended for good cause; a jurisdictional one cannot be extended by anyone, for any reason.
The motion must be specific. It has to set forth specifically and particularly the facts and the law the moving party thinks should be reconsidered, and it must rest on substantial matters tied to relevant findings of fact or material conclusions of law. A motion that merely disagrees, or that repeats the argument already made without pointing at anything, does not qualify.
The penalty for vagueness is severe. A motion that fails the specificity test shall be denied, and the term to appeal will not have been interrupted. Not tolled and then restarted — never interrupted at all. A party who files a loose motion on day fourteen and gets it denied on day forty has lost the appeal.
A good motion stops the clock for everyone. Once filed, the terms for taking appeal are interrupted for all parties, and they start running again from the date a copy of the notice of the resolution on the motion is filed in the record.
Service is its own deadline. The motion must be served on the other parties within the same fifteen days, so that service and filing are coterminous. That term is of strict compliance too.
La reconsideración es lo primero que se intenta tras un dictamen adverso, y es el paso que más se pierde por un tecnicismo.
Dos relojes, ambos de quince días, pero no del mismo tipo. Contra una orden o resolución, el término es de cumplimiento estricto y corre desde la fecha de notificación. Contra una sentencia, es jurisdiccional y corre desde que se archiva en autos copia de la notificación. El de cumplimiento estricto se prorroga con justa causa; el jurisdiccional no lo prorroga nadie.
La moción debe ser específica. Tiene que exponer con suficiente particularidad y especificidad los hechos y el derecho que la parte entiende deben reconsiderarse, y fundarse en cuestiones sustanciales relacionadas con determinaciones de hecho pertinentes o conclusiones de derecho materiales. La moción que solo discrepa, o que repite el argumento sin señalar nada, no cumple.
El castigo por la vaguedad es severo. La moción que no cumpla con la especificidad será declarada sin lugar y no interrumpirá el término para apelar. No lo suspende para reanudarlo: no lo interrumpe nunca. Quien presenta una moción floja el día catorce y la ve denegada el día cuarenta perdió la apelación.
La moción buena detiene el reloj de todos. Presentada, quedan interrumpidos los términos para apelar de todas las partes, y vuelven a correr desde que se archiva en autos copia de la notificación de la resolución que la resuelve.
La notificación tiene su propio plazo. Hay que notificar a las demás partes dentro de esos mismos quince días, de modo que notificación y presentación coincidan. Ese término también es de cumplimiento estricto.
