“Judgment” as used in these rules includes any decision of the Court of First Instance that finally resolves the matter in litigation and from which an appeal lies. “Resolution” includes any ruling that puts an end to an incident within the judicial process.
“Judgment,” when rendered by an appellate court, refers to the final decision of that court concerning the appeal before it or concerning the discretionary remedy for which the appellate court has issued the writ sought. The final decision of an appellate court when it denies, at its discretion, the writ sought shall be called a “resolution.” The final decision of an appellate court when it sets aside an appeal for any reason or dismisses it for abandonment shall be called a “judgment.”
Según se usa en estas reglas, el término “sentencia” incluye cualquier determinación del Tribunal de Primera Instancia que resuelva finalmente la cuestión litigiosa y de la cual pueda apelarse. El término “resolución” incluye cualquier dictamen que pone fin a un incidente dentro del proceso judicial.
El término “sentencia”, cuando es dictada por un tribunal de apelación, se refiere a la determinación final de ese tribunal en cuanto a la apelación ante sí o en cuanto al recurso discrecional en el cual el tribunal de apelación ha expedido el auto solicitado. La determinación final del tribunal de apelación cuando éste deniega discrecionalmente el auto solicitado se denomina "resolución". La determinación final del tribunal de apelación cuando éste desestima por cualquier causa o archiva por desistimiento un recurso de apelación, se denomina “sentencia”.

In the Court of First Instance. A judgment is any decision that finally resolves the matter in litigation and from which an appeal lies. A resolution is any ruling that puts an end to an incident within the judicial process. The test is not the label the court uses but what the ruling does.
In an appellate court, the vocabulary changes. A judgment there is the final decision on the appeal, or on a discretionary remedy for which the court has issued the writ sought.
But the final decision of an appellate court denying, at its discretion, the writ sought is called a resolution. So a certiorari petition that is refused produces a resolution; one that is granted and then decided produces a judgment.
And a third case: where an appellate court sets aside an appeal for any reason or dismisses it for abandonment, that is a judgment — not a resolution, even though nothing was decided on the merits.
These labels are not cosmetic. Appeal rights, the terms in Rules 43.1, 47, 48 and 52.2, and the effect of Rule 46’s notice requirement all key to whether what was entered is a judgment.
En el Tribunal de Primera Instancia. La sentencia es cualquier determinación que resuelva finalmente la cuestión litigiosa y de la cual pueda apelarse. La resolución es cualquier dictamen que ponga fin a un incidente dentro del proceso judicial. El criterio no es la etiqueta que use el tribunal sino lo que la determinación hace.
En un tribunal apelativo cambia el vocabulario. Allí la sentencia es la decisión final sobre el recurso apelativo, o sobre el recurso discrecional cuyo auto el tribunal expidió.
Pero la decisión final del tribunal apelativo que deniega, en su discreción, el auto solicitado se llama resolución. Así, un certiorari denegado produce una resolución; uno expedido y luego resuelto produce una sentencia.
Y un tercer caso: cuando el tribunal apelativo desestima un recurso por cualquier razón o lo declara abandonado, eso es una sentencia, no una resolución, aunque nada se haya decidido en los méritos.
Estas etiquetas no son cosméticas. Los derechos de apelación, los términos de las Reglas 43.1, 47, 48 y 52.2, y el efecto del requisito de notificación de la Regla 46 dependen de si lo dictado es una sentencia.
