When by these rules or by a notice given thereunder or by order of court an act is required or allowed to be done at or within a specified time, the court, for good cause shown, may at any time in its discretion: (1) with or without motion or notice, order the period enlarged or shortened if request therefor is made before the expiration of the period originally prescribed or as extended by a previous order, or (2) upon motion made after the expiration of the specified period, permit the act to be done where the failure to act was for good cause; but it may not extend or shorten the time for taking any action under Rules 43.1, 44.1, 47, 48.2, 48.4, 49.2, and 52.2, except to the extent and under the conditions stated therein.
Cuando por estas reglas, por una notificación dada en virtud de sus disposiciones o por una orden del tribunal se requiera o permita la realización de un acto en o dentro de un plazo especificado, el tribunal podrá, por justa causa, en cualquier momento y en el ejercicio de su discreción: (1) ordenar, previa moción o notificación, o sin ellas, que se prorrogue o acorte el término si así se solicita antes de expirar el término originalmente prescrito o según prorrogado por orden anterior, o (2) permitir, en virtud de moción presentada después de haber expirado el plazo especificado, que el acto se realice si la omisión se debió a justa causa, pero no podrá prorrogar o reducir el plazo para actuar bajo las disposiciones de las Reglas 43.1, 44.1, 47, 48.2, 48.4, 49.2 y 52.2, salvo lo dispuesto en éstas bajo las condiciones en ellas prescritas.
What this rule doesQué hace esta regla
The power. Where these rules, a notice given under them, or a court order requires or allows an act within a specified time, the court, for good cause shown, may at any time in its discretion, do one of two things.
(1) Before the period runs out.With or without motion or notice, order the period enlarged or shortened, if the request is made before the original period or a previously extended one expires. Note that this can be done sua sponte and without notice — and that it runs both ways, since a court may shorten a period as well as lengthen it.
(2) After it has run out.On motion made after the expiration, permit the act to be done where the failure to act was for good cause. Missing a deadline is not automatically fatal, but relief now requires a motion and an explanation.
The seven untouchable rules. The court may not extend or shorten the time for taking any action under Rules 43.1, 44.1, 47, 48.2, 48.4, 49.2, and 52.2, except to the extent and under the conditions stated therein.
Look at what that list is. Amended findings, costs and attorney’s fees, reconsideration, the time to move for and to order a new trial, relief from judgment, and every appellate deadline. These are the terms that decide whether a judgment becomes final — and each one carries its own internal rules about extension. The prohibition is not absolute; it points you back to the rule itself.
La facultad. Cuando estas reglas, una notificación dada bajo ellas o una orden del tribunal exijan o permitan un acto dentro de un término, el tribunal, con justa causa y en cualquier momento a su discreción, puede hacer una de dos cosas.
(1) Antes de vencerse.Con o sin moción o notificación, ordenar que el término se prorrogue o se acorte, si se solicita antes de vencer el originalmente prescrito o el ya prorrogado. Nótese que puede hacerse motu proprio y sin notificación, y que corre en ambos sentidos, pues el tribunal puede acortar tanto como alargar.
(2) Después de vencido.A moción presentada tras la expiración, permitir que el acto se realice cuando la omisión se debió a justa causa. Perder un término no es automáticamente fatal, pero el remedio ya exige moción y explicación.
Las siete reglas intocables. El tribunal no podrá prorrogar ni acortar el término para actuar bajo las Reglas 43.1, 44.1, 47, 48.2, 48.4, 49.2 y 52.2, salvo en la medida y bajo las condiciones que allí se dispongan.
Repárese en lo que es esa lista. Determinaciones enmendadas, costas y honorarios, reconsideración, el término para pedir y para ordenar un nuevo juicio, el relevo de sentencia y todos los términos apelativos. Son los que deciden si una sentencia adviene final, y cada uno trae sus propias normas de prórroga. La prohibición no es absoluta: devuelve a la regla misma.
