On motion and upon such terms as are just, the court may relieve a party or a party’s legal representative from a judgment, order, or proceeding for the following reasons:
(a)mistake, inadvertence, surprise, or excusable neglect;
(b)newly discovered material evidence by which due diligence could not have been discovered in time to move for a new trial under Rule 48;
(c)fraud (whether heretofore denominated intrinsic or extrinsic), misrepresentation, or other misconduct of an adverse party;
(d)the judgment is void;
(e)the judgment has been satisfied, released, or discharged, or a prior judgment upon which it is based has been reversed or otherwise vacated, or it is no longer equitable that the judgment should have prospective application; or
(f)any other reason justifying relief from the operation of the judgment.
The provisions of this rule do not apply to judgments in divorce actions, unless the motion is based on reasons (c) or (d). The motion shall be made within a reasonable time, but in no case shall it be made more than six (6) months after the judgment, order, or proceeding was entered or taken. A motion under this Rule 49.2 does not affect the finality of a judgment or suspend its operation. This rule does not limit the power of a court to:
(1)entertain an independent action to relieve a party from a judgment, order, or proceeding;
(2)grant relief to a party not actually notified; and
(3)set aside a judgment for fraud upon the court.
While an appeal or certiorari is pending final resolution in a voluntary jurisdiction proceeding, the respondent court may not grant relief under this rule, unless with leave of the appellate court. Once the appellate court enters judgment, no relief inconsistent with the mandate may be granted under this rule unless previously permitted by the appellate court. In both cases, the motion for relief shall always be made before the respondent court within the term stated above, and if the respondent court determines that it would be willing to grant relief, a request for such leave shall then be made to the appellate court.
Mediante una moción y bajo aquellas condiciones que sean justas, el tribunal podrá relevar a una parte o a su representante legal de una sentencia, orden o procedimiento por las razones siguientes:
(a)error, inadvertencia, sorpresa o negligencia excusable;
(b)descubrimiento de evidencia esencial que, a pesar de una debida diligencia, no pudo haber sido descubierta a tiempo para solicitar un nuevo juicio de acuerdo con la Regla 48;
(c)fraude (incluso el que hasta ahora se ha denominado “intrínseco” y el también llamado “extrínseco”), falsa representación u otra conducta impropia de una parte adversa;
(d)nulidad de la sentencia;
(e)la sentencia ha sido satisfecha, renunciada o se ha cumplido con ella, o la sentencia anterior en que se fundaba ha sido revocada o de otro modo dejada sin efecto, o no sería equitativo que la sentencia continúe en vigor, o
(f)cualquier otra razón que justifique la concesión de un remedio contra los efectos de una sentencia.
Las disposiciones de esta regla no aplicarán a las sentencias dictadas en pleitos de divorcio, a menos que la moción se funde en las razones (c) o (d). La moción se presentará dentro de un término razonable, pero en ningún caso después de transcurridos seis (6) meses de haberse registrado la sentencia u orden o haberse llevado a cabo el procedimiento. Una moción bajo esta Regla 49.2 no afectará la finalidad de una sentencia ni suspenderá sus efectos. Esta regla no limita el poder del tribunal para:
(1)conocer de un pleito independiente con el propósito de relevar a una parte de una sentencia, una orden o un procedimiento;
(2)conceder un remedio a una parte que en realidad no haya sido emplazada, y
(3)dejar sin efecto una sentencia por motivo de fraude al tribunal.
Mientras esté pendiente una apelación o un recurso de certiorari de una resolución final en procedimiento de jurisdicción voluntaria, el tribunal apelado no podrá conceder ningún remedio bajo esta regla, a menos que sea con el permiso del tribunal de apelación. Una vez que el tribunal de apelación dicte sentencia, no podrá concederse ningún remedio bajo esta regla que sea incompatible con el mandato, a menos que se obtenga previamente permiso para ello del tribunal de apelación. En ambos casos, la moción de relevo deberá siempre presentarse ante el tribunal apelado dentro del término antes señalado, y si éste determina que estaría dispuesto a conceder el remedio, se acudirá entonces ante el tribunal de apelación para solicitar el referido permiso.

What this rule doesQué hace esta regla

The six grounds. On motion and upon such terms as are just, the court may relieve a party or a party’s legal representative from a judgment, order or proceeding for: (a) mistake, inadvertence, surprise or excusable neglect; (b) newly discovered material evidence that due diligence could not have discovered in time to move for a new trial under Rule 48; (c) fraud, whether formerly called intrinsic or extrinsic, misrepresentation or other misconduct of an adverse party; (d) the judgment is void; (e) the judgment has been satisfied, released or discharged, or a prior judgment it rests on has been reversed or vacated, or it is no longer equitable that it have prospective application; and (f) any other reason justifying relief from its operation.

Divorce judgments are carved out. The rule does not apply to judgments in divorce actions unless the motion is based on reason (c) or (d) — fraud or voidness.

Timing is the sharpest edge. The motion must be made within a reasonable time, and in no case more than six months after the judgment, order or proceeding was entered or taken. Both apply: a five-month delay can still be unreasonable, and no showing makes seven months acceptable.

Filing changes nothing by itself. A Rule 49.2 motion does not affect the finality of a judgment or suspend its operation. The winner may keep executing while the motion is pending.

Three powers the rule does not touch. The court may still entertain an independent action for relief, grant relief to a party not actually notified, and set aside a judgment for fraud upon the court. These sit outside the six-month cap.

While an appeal is pending. In a voluntary jurisdiction proceeding with an appeal or certiorari awaiting final resolution, the trial court may not grant relief without leave of the appellate court. Once the appellate court enters judgment, no relief inconsistent with the mandate may be granted unless that court permitted it beforehand. In both situations the motion is still filed in the trial court within the same term; only if that court says it would be willing to grant relief is leave then sought above.

Los seis motivos. Mediante moción y en las condiciones que sean justas, el tribunal puede relevar a una parte o a su representante legal de una sentencia, orden o procedimiento por: (a) error, inadvertencia, sorpresa o negligencia excusable; (b) prueba sustancial recién descubierta que con debida diligencia no pudo haberse descubierto a tiempo para pedir nuevo juicio bajo la Regla 48; (c) fraude, antes llamado intrínseco o extrínseco, falsa representación u otra conducta impropia de una parte adversa; (d) nulidad de la sentencia; (e) que la sentencia haya sido satisfecha, renunciada o descargada, o que una sentencia anterior en que se funda haya sido revocada o dejada sin efecto, o que no sea equitativo que continúe en vigor; y (f) cualquier otra razón que justifique el relevo.

El divorcio queda excluido. La regla no aplica a las sentencias de divorcio salvo que la moción se funde en los motivos (c) o (d): fraude o nulidad.

El término es el filo más agudo. La moción debe presentarse dentro de un término razonable y en ningún caso después de transcurridos seis meses de haberse registrado la sentencia u orden o haberse llevado a cabo el procedimiento. Ambas exigencias rigen: cinco meses pueden ser irrazonables, y ninguna explicación hace aceptables siete.

Presentarla no cambia nada por sí sola. La moción no afecta la finalidad de la sentencia ni suspende sus efectos. Quien ganó puede seguir ejecutando mientras esté pendiente.

Tres facultades que la regla no toca. El tribunal aún puede atender un pleito independiente de relevo, conceder relevo a una parte que no fue debidamente emplazada y dejar sin efecto una sentencia por fraude al tribunal. Quedan fuera del tope de seis meses.

Con recurso pendiente. En un procedimiento de jurisdicción voluntaria con apelación o certiorari pendiente de resolución final, el tribunal recurrido no puede conceder relevo sin permiso del apelativo. Dictada la sentencia apelativa, no cabe relevo incompatible con el mandato salvo que se haya permitido antes. En ambos casos la moción se presenta siempre ante el tribunal recurrido dentro del mismo término; solo si este determina que estaría dispuesto a conceder el relevo se solicita entonces el permiso arriba.
