(a)All counsel in the case shall keep in close communication with their respective Steering Committees and cooperate diligently with all legitimate requests made by the Steering Committees in view of, and to protect the common rights of the individual parties they represent.
(b)When the members of a Steering Committee certify a matter as one of particular or individual interest, counsel for the individual parties will be responsible for the judicial prosecution of said matter.
(c)The court reserves the right to allow, motu proprio or on motion, any counsel for an individual party to handle a matter that is not of common interest, but of particular or individual interest to his or her client.
(d)Counsel who file a paper with the court shall promptly inform any possible conflict of interest and include information that may be relevant to the possible recusal of any judge. Motions for recusal must be filed as soon as the members of the Steering Committee learn of the composition of the court.
(a)Será obligación de todos los abogados o las abogadas del caso mantener una estrecha comunicación con sus respectivos comités timón y cooperar diligentemente en todo requerimiento legítimo de éstos, en atención y protección de los derechos comunes de la parte individual representada por éstos o éstas.
(b)En aquellos casos en los cuales los integrantes de un comité timón hayan certificado un asunto como de interés particular o individual, las representaciones legales de las partes individuales serán responsables del trámite judicial.
(c)Queda reservada la facultad del tribunal para, a instancia propia o a solicitud de parte interesada, permitir que cualquier abogado o abogada individual tramite un asunto que no sea común, sino particular o individual de su representado o representada.
(d)Será obligación de las representaciones legales que presenten cualquier escrito ante el tribunal, informar de forma expedita sobre posibles conflictos de intereses e incluir aquella información pertinente a la posible recusación de algún juez o alguna jueza. Cualquier moción de recusación deberá ser interpuesta tan pronto los miembros del comité timón advengan en conocimiento de la composición del tribunal.
What this rule doesQué hace esta regla
(a) Stay close. All counsel shall keep in close communication with their respective Steering Committees and cooperate diligently with all legitimate requests made by them, in view of and to protect the common rights of the individual parties they represent.
(b) Take back what is individual. When committee members certify a matter as one of particular or individual interest under Rule 10(b), counsel for the individual parties will be responsible for the judicial prosecution of that matter. Responsibility transfers with the certification.
(c) And the court can hand it back too. The court reserves the right to allow, motu proprio or on motion, any counsel for an individual party to handle a matter that is not of common interest but of particular or individual interest to that client. A lawyer who thinks the committee has swept up something personal to their client is not stuck with the committee’s view.
(d) Conflicts and recusal, promptly. Counsel who file a paper shall promptly inform any possible conflict of interest and include information that may be relevant to the possible recusal of any judge. And motions for recusal must be filed as soon as the members of the Steering Committee learn of the composition of the court.
That last deadline matters in a case of this size: one judge presides over everything under Rule 7, so a recusal discovered late would unwind far more than an ordinary case.
(a) Mantenerse cerca. Todos los abogados deberán mantener estrecha comunicación con sus respectivos comités timón y cooperar diligentemente con todos sus requerimientos legítimos, en aras de proteger los derechos comunes de las partes individuales que representan.
(b) Asumir lo individual. Cuando los miembros del comité certifiquen un asunto como de interés particular o individual bajo la Regla 10(b), el abogado de la parte individual será responsable de su tramitación judicial. La responsabilidad se traslada con la certificación.
(c) Y el tribunal también puede devolverlo. El tribunal se reserva el derecho de permitir, motu proprio o a instancia de parte, que el abogado de una parte individual atienda un asunto que no sea de interés común sino particular o individual de su cliente. Quien entienda que el comité arrastró algo propio de su cliente no queda atado al criterio del comité.
(d) Conflictos y recusación, con prontitud. Los abogados que presenten un escrito deberán informar prontamente cualquier posible conflicto de interés e incluir información que pueda ser pertinente a la posible recusación de algún juez. Y las mociones de recusación deben presentarse tan pronto los miembros del comité timón conozcan la composición del tribunal.
Ese último término pesa en un caso de este tamaño: bajo la Regla 7 un solo juez preside todo, de modo que una recusación descubierta tarde desharía mucho más que en un caso ordinario.
