The designated judge of the Court of First Instance shall determine by resolution:
(a)the Steering Committees for plaintiffs and defendants that the designated judge, in his or her sound judgment and discretion, may deem necessary for the adequate legal representation of the common interests of plaintiffs and defendants. In making this determination, the designated judge may request from the parties the information that he or she deems pertinent, and use, at his or her discretion, the Guidelines for Discovery in Complex Cases;
(b)the individual members of the Steering Committees by selecting them from among counsel for the different parties. In making this determination, the designated judge may request from the parties the information that he or she deems pertinent, and he or she shall make sure that the designated counsel reasonably represent the different interests involved in the litigation. The designated judge shall also make sure that the qualifications, organization, resources, and engagements of the designated counsel will allow them to meet their obligations. Except in extraordinary circumstances, each committee must not have more than five (5) members;
(c)the method for assessing and paying compensation to the individual members of the Steering Committees for their professional services and the expenses incurred in the adequate legal representation of the common interests of the parties that constitute their respective groups. The designated judge may impose strict requirements concerning the records of hours worked and expenses incurred by the designated counsel, and establish guidelines, methods or restrictions on the award of attorney’s fees. In making this determination, the designated judge may request from the parties the information that he or she deems pertinent. The parties may stipulate with each other the method for assessing and paying compensation to the individual members of the Steering Committees, as long as it is not contrary to law, morals, or public policy. Said agreement is subject to the approval of the court. In any event, the court reserves the faculty to modify by resolution any of the above designations and determinations in those cases it deems appropriate to do so.
(d)Notice of all resolutions issued by the designated judge under this rule must be served on all the parties to the action as provided by the Rules of Civil Procedure in force.
La jueza designada o el juez designado del Tribunal de Primera Instancia determinará mediante Resolución:
(a)Los comités timón de abogados o abogadas de las partes demandantes y demandadas que, a su sano juicio y discreción, entienda necesario para la debida y adecuada representación legal de los intereses comunes de las partes demandantes y demandadas. Al hacer dicha determinación, la jueza designada o el juez designado podrá solicitar de las partes la información que estime pertinente y utilizar a su discreción las Guías para el Descubrimiento de Prueba en Casos Complejos.
(b)Los miembros individuales de dichos comités timón de entre las representaciones legales de las diversas partes. Al hacer dicha determinación, la jueza designada o el juez designado podrá solicitar de las partes la información que estime pertinente y se asegurará que las abogadas designadas o los abogados designados representan razonablemente los diversos intereses presentes en el litigio. También se asegurará que las calificaciones, la organización, los recursos y los compromisos de las abogadas designadas o los abogados designados le permitirán cumplir con las obligaciones. Salvo en casos extraordinarios, cada comité no deberá exceder de cinco (5) miembros.
(c)La manera mediante la cual se habrá de valorar y pagar la remuneración a los miembros individuales de dichos comités timón por los servicios profesionales y costos en que se ha incurrido en la debida y adecuada representación legal de los intereses comunes de las partes que componen sus respectivos grupos. La jueza designada o el juez designado podrá imponer requisitos precisos en torno a los registros de horas trabajadas y gastos en que hayan incurrido las abogadas o los abogados designados, así como establecer guías, métodos o limitaciones que gobiernen la concesión de los honorarios. Al hacer dicha determinación, la jueza designada o el juez designado podrá solicitar de las partes la información que estime pertinente. Queda reservada la facultad de las partes para estipular entre sí la manera mediante la cual se habrá de valorar y pagar dicha remuneración a los miembros individuales de los comités timón de abogados o abogadas, siempre y cuando no contravengan la ley, la moral o el orden público. Dicho acuerdo estará sujeto a la aprobación del tribunal. En todo caso queda reservada la facultad al tribunal para modificar mediante resolución cualesquiera de las anteriores designaciones y determinaciones en aquellos casos que entienda apropiado.
(d)Toda resolución dictada por la jueza designada o el juez designado en virtud de esta regla deberá ser notificada a todas las partes del pleito de conformidad con lo dispuesto por las Reglas de Procedimiento Civil vigentes.
What this rule doesQué hace esta regla
Everything in this rule is done by resolution of the designated judge, and at three points the rule repeats that the judge may request from the parties whatever information he or she deems pertinent.
(a) How many committees. The Steering Committees for plaintiffs and defendants that the judge, in his or her sound judgment and discretion, deems necessary for the adequate legal representation of the common interests. The judge may also use, at his or her discretion, the Guidelines for Discovery in Complex Cases defined in Rule 3(c).
(b) Who sits on them. Members are selected from among counsel for the different parties. The judge shall make sure the designated counsel reasonably represent the different interests involved, and that their qualifications, organization, resources, and engagements will allow them to meet their obligations — capacity, not just credentials. Except in extraordinary circumstances, each committee must not have more than five members.
(c) How they are paid. The judge sets the method for assessing and paying compensation for professional services and expenses incurred representing the common interests of each group. The judge may impose strict requirements on records of hours worked and expenses, and establish guidelines, methods or restrictions on the award of attorney’s fees.
The parties may agree instead — up to a point. They may stipulate the method of compensation among themselves, as long as it is not contrary to law, morals, or public policy, and the agreement is subject to the approval of the court. In any event the court reserves the faculty to modify by resolution any of these designations and determinations.
(d) Notice. Every resolution issued under this rule must be served on all the parties as the Rules of Civil Procedure in force provide. Note the contrast with Rule 15(b), where interlocutory rulings go only to the committees: who represents whom, and who gets paid, is something every party is told directly.
Todo en esta regla se hace por resolución del juez designado, y en tres puntos la regla repite que puede solicitar a las partes la información que estime pertinente.
(a) Cuántos comités. Los comités timón de las partes demandantes y demandadas que el juez, en su sano juicio y discreción, estime necesarios para la adecuada representación legal de los intereses comunes. Puede además utilizar, discrecionalmente, las Guías para el Descubrimiento de Prueba en Casos Complejos que define la Regla 3(c).
(b) Quiénes los integran. Sus miembros se seleccionan de entre los abogados de las distintas partes. El juez se asegurará de que representen razonablemente los distintos intereses envueltos y de que sus cualificaciones, organización, recursos y compromisos les permitan cumplir sus obligaciones: capacidad, no solo credenciales. Salvo circunstancias extraordinarias, cada comité no tendrá más de cinco miembros.
(c) Cómo se les paga. El juez fija el método para tasar y pagar la remuneración por servicios profesionales y gastos incurridos en representar los intereses comunes de cada grupo. Puede imponer requisitos estrictos sobre los registros de horas trabajadas y gastos y establecer guías, métodos o restricciones a la concesión de honorarios.
Las partes pueden acordarlo, hasta cierto punto. Pueden estipular entre sí el método de remuneración siempre que no sea contrario a la ley, la moral o el orden público, y el acuerdo queda sujeto a la aprobación del tribunal. En todo caso el tribunal se reserva la facultad de modificar por resolución cualquiera de estas designaciones y determinaciones.
(d) Notificación. Toda resolución dictada bajo esta regla debe notificarse a todas las partes según disponen las Reglas de Procedimiento Civil vigentes. Nótese el contraste con la Regla 15(b), donde lo interlocutorio va solo a los comités: quién representa a quién, y quién cobra, se le dice a cada parte directamente.
