Five rules on the judgment that declares rather than orders.
Rule 59.1 grants the power and gives the declaration the force of a final judgment. Rule 59.2 says who may seek one and over what — contracts, statutes, ordinances, franchises, trusts and estates. Rule 59.3 lets the court refuse when a declaration would settle nothing. Rule 59.4 provides for further relief built on the declaration. Rule 59.5 requires everyone affected to be joined and protects those who are not.
The point of the device is timing. A party facing a contract it thinks is void does not have to breach it and get sued to find out. It can ask first.

La Regla 59.1 concede la facultad y le da a la declaración la fuerza de una sentencia final. La 59.2 dice quién puede pedirla y sobre qué: contratos, leyes, ordenanzas, franquicias, fideicomisos y caudales. La 59.3 permite negarla cuando no resolvería nada. La 59.4 provee remedios ulteriores basados en la declaración. La 59.5 exige acumular a todos los afectados y protege a quienes no lo sean.
El sentido del mecanismo es el momento. Quien enfrenta un contrato que cree nulo no tiene que incumplirlo y esperar a que lo demanden para saberlo. Puede preguntar antes.
