The court may refuse to render or enter a declaratory judgment or decree where such judgment or decree, if rendered or entered, would not terminate the uncertainty or the controversy giving rise to the proceeding.
El tribunal podrá negarse a dar o a registrar una sentencia o decreto declaratorio cuando tal sentencia o decreto, de ser hecho o registrado, no haya de poner fin a la incertidumbre o controversia que originó el procedimiento.

One sentence, and it is the discretion that keeps Rule 59 from becoming a request for legal advice.
The court may refuse to render or enter a declaratory judgment or decree where such judgment or decree, if rendered or entered, would not terminate the uncertainty or the controversy giving rise to the proceeding.
It is the mirror image of the standard in Rule 59.2(c), which extends the general power to proceedings where a judgment will terminate the controversy or remove an uncertainty. Here the same test appears as a ground for declining.
The question is practical: after the declaration, is the dispute over? If the parties would still be exactly where they started, the court need not answer.

El tribunal puede negarse a dictar o registrar una sentencia o decreto declaratorio cuando, de dictarse o registrarse, no pondría fin a la incertidumbre o a la controversia que originó el procedimiento.
Es la imagen invertida del criterio de la Regla 59.2(c), que extiende la facultad general a los procedimientos en que una sentencia sí pondrá fin a la controversia o eliminará una incertidumbre. Aquí el mismo criterio aparece como fundamento para negarse.
La pregunta es práctica: después de la declaración, ¿se acabó la disputa? Si las partes quedarían exactamente donde empezaron, el tribunal no tiene que contestar.
