Three rules that decide how a case leaves the Court of First Instance.
Rule 52.1 says which rulings can be reviewed and when an interlocutory order can be taken up on its own. Rule 52.2 sets every deadline and every way to interrupt one. Rule 52.3 says what stops while review is pending.
The vocabulary matters. Appeal is review of a judgment as of right. Certiorari is discretionary review, mostly of resolutions and orders. Certification is the Supreme Court reaching down to take a case, or answering a question sent by a court outside Puerto Rico.
Tres reglas que deciden cómo sale un caso del Tribunal de Primera Instancia.
La Regla 52.1 dice qué dictámenes son revisables y cuándo una orden interlocutoria puede subir sola. La 52.2 fija todos los términos y todas las formas de interrumpirlos. La 52.3 dice qué se detiene mientras la revisión está pendiente.
El vocabulario importa. La apelación es la revisión de una sentencia como cuestión de derecho. El certiorari es revisión discrecional, sobre todo de resoluciones y órdenes. La certificación es el Tribunal Supremo trayendo hacia sí un caso, o contestando una pregunta que le envía un tribunal de fuera de Puerto Rico.
