(a)Once a petition for appeal is filed, all further proceedings in lower courts regarding the judgment appealed from or any part thereof, or the issues contained therein, shall be stayed unless otherwise ordered by the appellate court on its own initiative or on motion of a party. The proceedings in the Court of First Instance may continue with regard to any matter involved therein but not included in the appeal. The proceedings in the Court of First Instance shall not be stayed when the judgment orders the sale of goods susceptible to loss or damage, in which case the Court of First Instance may order such goods to be sold and the proceeds therefrom deposited until the appellate court renders judgment.
(b)The filing of a petition for writ of certiorari shall not stay the proceedings in the respondent court unless otherwise ordered by the appellate court on its own initiative or on motion of a party. The issuance of a writ of certiorari shall stay the proceedings in the respondent court unless the Court of Appeals provides otherwise.
(c)The filing of a petition for certification shall not stay the proceedings in the Court of Appeals or in the Court of First Instance unless otherwise provided by the Supreme Court on its own initiative or on motion of a party. Temporary restraining orders and injunctions shall be governed by the provisions of Rule 57.7.
(d)The effects of a decision from which appeal is taken or review sought shall not be stayed unless otherwise ordered by the appellate court, on its own initiative or on motion of a party, and which includes any of the following remedies:
(1)An injunction, mandamus, or cease and desist order;
(2)A support payment order;
(3)An order on custody or visitation.
(a)Una vez presentado el escrito de apelación, se suspenderán todos los procedimientos en los tribunales inferiores respecto a la sentencia o parte de ésta de la cual se apela, o las cuestiones comprendidas en ella, salvo orden en contrario expedida por iniciativa propia o a solicitud de parte por el tribunal de apelación. El Tribunal de Primera Instancia podrá proseguir el pleito en cuanto a cualquier cuestión involucrada en él no comprendida en la apelación. No se suspenderán los procedimientos en el Tribunal de Primera Instancia cuando la sentencia disponga la venta de bienes susceptibles de pérdida o deterioro, en cuyo caso el Tribunal de Primera Instancia podrá ordenar que dichos bienes se vendan y su importe se deposite hasta tanto el tribunal de apelación dicte sentencia.
(b)La presentación de una solicitud de certiorari no suspenderá los procedimientos ante el tribunal recurrido, salvo orden en contrario expedida por el tribunal de apelación por iniciativa propia o a solicitud de parte. La expedición del auto de certiorari suspenderá los procedimientos en el tribunal recurrido, salvo que el Tribunal de Apelaciones disponga lo contrario.
(c)La presentación de una solicitud de certificación no interrumpirá los procedimientos ante el Tribunal de Apelaciones o el Tribunal de Primera Instancia, salvo que el Tribunal Supremo disponga lo contrario, por iniciativa propia o a petición de parte. En cuanto a las órdenes de entredicho provisional e injunction, se estará a lo dispuesto en la Regla 57.7.
(d)No se suspenderán los efectos de una decisión apelada o recurrida, salvo una orden en contrario expedida por el tribunal de apelación por iniciativa propia o a solicitud de parte, y que incluya cualquiera de los remedios siguientes:
(1)Una orden de injunction, de mandamus o de hacer o desistir.
(2)Una orden de pago de alimentos.
(3)Una orden sobre custodia o relaciones filiales.

What this rule doesQué hace esta regla

(a) An appeal stays the proceedings below on the judgment appealed from, any part of it, or the issues it contains — unless the appellate court orders otherwise, on its own initiative or on motion. Matters involved in the case but not included in the appeal may continue.

One exception written into (a). Proceedings are not stayed where the judgment orders the sale of goods susceptible to loss or damage. The Court of First Instance may order the sale and have the proceeds deposited until the appellate court rules — value is preserved rather than allowed to rot through the appeal.

(b) Certiorari works the other way around. Filing a petition for certiorari does not stay the proceedings below unless the appellate court orders it. Issuance of the writ does stay them, unless the Court of Appeals provides otherwise. The stay follows the court’s decision to take the case, not the litigant’s decision to ask.

(c) Certification does not stay anything in the Court of Appeals or the Court of First Instance unless the Supreme Court provides otherwise. Temporary restraining orders and injunctions are governed by Rule 57.7.

(d) Four things that keep operating. The effects of a decision under review are not stayed unless the appellate court orders it, where the decision includes an injunction, mandamus, or cease and desist order; a support payment order; or an order on custody or visitation. These are the remedies whose whole value is that they work now.

(a) La apelación suspende los procedimientos abajo sobre la sentencia apelada, cualquier parte de ella o las cuestiones que contiene, salvo que el tribunal apelativo disponga otra cosa, por iniciativa propia o a moción de parte. Los asuntos envueltos en el caso pero no incluidos en la apelación pueden continuar.

Una excepción escrita en el propio (a). No se suspenden los procedimientos cuando la sentencia ordena la venta de bienes susceptibles de pérdida o deterioro. El Tribunal de Primera Instancia puede ordenar la venta y que el producto se deposite hasta que el apelativo resuelva: se conserva el valor en vez de dejarlo perderse durante el recurso.

(b) El certiorari funciona al revés. Presentar la petición no suspende los procedimientos abajo salvo que el tribunal apelativo lo ordene. Expedir el auto sí los suspende, salvo que el Tribunal de Apelaciones disponga otra cosa. La suspensión sigue a la decisión del tribunal de tomar el caso, no a la decisión del litigante de pedirlo.

(c) La certificación no suspende nada en el Tribunal de Apelaciones ni en el de Primera Instancia salvo que el Supremo disponga otra cosa. Los entredichos provisionales y los injunctions se rigen por la Regla 57.7.

(d) Cuatro cosas que siguen operando. Los efectos de la decisión recurrida no se suspenden salvo que lo ordene el tribunal apelativo cuando la decisión incluye un injunction, mandamus u orden de cesar y desistir, una orden de pago de alimentos o una orden sobre custodia o relaciones filiales. Son los remedios cuyo valor entero está en que funcionen ahora.
