Every procedure for appeal, certiorari, certification, and any other procedure to review judgments and resolutions shall be handled in accordance with the applicable laws, these rules, and the rules adopted by the Supreme Court of Puerto Rico.
Writs of certiorari to review judgments or interlocutory orders pronounced by the Court of First Instance shall only be issued by the Court of Appeals when resorted to by reason of a resolution or order under Rules 56 and 57 or the denial of a motion of a provisory nature. However, and as an exception to the above provision, the Court of Appeals may review interlocutory judgments or orders issued by the Court of First Instance when resorted to for decisions regarding the admissibility of factual witnesses or essential experts, issues regarding evidentiary privileges, entries of [default], in cases involving family relations, in cases vested with public interest, or in any other situation in which waiting for a judgment of the Court of Appeals constitutes a gross miscarriage of justice. When denying the issue of a writ of certiorari in such cases, the Court of Appeals does not have to state the grounds for its decision.
Any other judgment or interlocutory order issued by the Court of First Instance may be reviewed in the petition for review instituted against the judgment in question, subject to the provisions of Rule 50 on harmless errors.
Todo procedimiento de apelación, certiorari, certificación, y cualquier otro procedimiento para revisar sentencias y resoluciones se tramitará de acuerdo con la Ley aplicable, estas reglas y las reglas que adopte el Tribunal Supremo de Puerto Rico.
El recurso de certiorari para revisar resoluciones u órdenes interlocutorias dictadas por el Tribunal de Primera Instancia, solamente será expedido por el Tribunal de Apelaciones cuando se recurra de una resolución u orden bajo las Reglas 56 y 57 o de la denegatoria de una moción de carácter dispositivo. No obstante, y por excepción a lo dispuesto anteriormente, el Tribunal de Apelaciones podrá revisar órdenes o resoluciones interlocutorias dictadas por el Tribunal de Primera Instancia cuando se recurra de decisiones sobre la admisibilidad de testigos de hechos o peritos esenciales, asuntos relativos a privilegios evidenciarios, anotaciones de rebeldía, en casos de relaciones de familia, en casos que revistan interés público o en cualquier otra situación en la cual esperar a la apelación constituiría un fracaso irremediable de la justicia. Al denegar la expedición de un recurso de certiorari en estos casos, el Tribunal de Apelaciones no tiene que fundamentar su decisión.
Cualquier otra resolución u orden interlocutoria expedida por el Tribunal de Primera Instancia podrá ser revisada en el recurso de apelación que se interponga contra la sentencia sujeto a lo dispuesto en la Regla 50 sobre los errores no perjudiciales.
What this rule doesQué hace esta regla
The general referral. Every procedure for appeal, certiorari, certification and any other review of judgments and resolutions is handled in accordance with the applicable laws, these rules, and the rules adopted by the Supreme Court of Puerto Rico.
The default rule for certiorari. The Court of Appeals issues writs of certiorari to review judgments or interlocutory orders of the Court of First Instance only when the petition comes from a resolution or order under Rules 56 and 57 — attachment and injunction — or from the denial of a motion of a provisory nature.
The exceptions. As an exception, the Court of Appeals may review interlocutory judgments or orders on decisions about the admissibility of factual witnesses or essential experts, on evidentiary privileges, on entries of default, in cases involving family relations, in cases vested with public interest, or in any other situation where waiting would constitute a gross miscarriage of justice.
Silence on denial. When the Court of Appeals declines to issue the writ in these cases, it does not have to state the grounds.
Everything else waits. Any other judgment or interlocutory order of the Court of First Instance may be reviewed in the petition for review instituted against the judgment, subject to Rule 50 on harmless errors. Nothing is lost by waiting — but nothing is won either unless the error affected substantial rights.
La remisión general. Todo procedimiento de apelación, certiorari, certificación y cualquier otro para revisar sentencias y resoluciones se tramita conforme a las leyes aplicables, a estas reglas y a las que adopte el Tribunal Supremo de Puerto Rico.
La regla general del certiorari. El Tribunal de Apelaciones expide autos de certiorari para revisar sentencias u órdenes interlocutorias del Tribunal de Primera Instancia solamente cuando se recurre de una resolución u orden bajo las Reglas 56 y 57 —aseguramiento de sentencia e injunction— o de la denegatoria de una moción de carácter dispositivo.
Las excepciones. Por excepción, el Tribunal de Apelaciones podrá revisar sentencias u órdenes interlocutorias cuando se recurra de decisiones sobre la admisibilidad de testigos de hechos o peritos esenciales, sobre privilegios evidenciarios, sobre anotaciones de rebeldía, en casos de relaciones de familia, en casos revestidos de interés público, o en cualquier otra situación en que esperar constituiría un fracaso irremediable de la justicia.
Silencio al denegar. Cuando deniega la expedición del auto en esos casos, el Tribunal de Apelaciones no tiene que fundamentar su decisión.
Todo lo demás espera. Cualquier otra sentencia u orden interlocutoria del Tribunal de Primera Instancia podrá revisarse en el recurso instado contra la sentencia, sujeto a la Regla 50 sobre errores no perjudiciales. Nada se pierde por esperar, pero tampoco se gana nada si el error no afectó derechos sustanciales.
