No error in either the admission or the exclusion of evidence, and no error or defect in any ruling or order or in anything done or omitted by the court or by any of the parties is ground for granting a new trial or for vacating, modifying or otherwise disturbing a judgment or order, unless refusal to take such action appears to the court inconsistent with substantial justice. The court at every stage of the proceeding must disregard any error or defect in the proceeding which does not affect the substantial rights of the parties.
Ningún error en la admisión o exclusión de prueba y ningún error o defecto en cualquier decisión u orden, o en cualquier acto realizado u omitido por el tribunal o por cualquiera de las partes, dará lugar a la concesión de un nuevo juicio o a que se deje sin efecto, modifique o de otro modo se altere una sentencia u orden a menos que el tribunal considere que la negativa a tomar tal acción resulta incompatible con la justicia sustancial. Durante el curso del procedimiento, el tribunal deberá hacer caso omiso de cualquier error o defecto en éste que no afecte los derechos sustanciales de las partes.

What this rule doesQué hace esta regla

This is the rule that keeps litigation from being an error hunt.

The reach is total. It covers error in the admission or the exclusion of evidence, and error or defect in any ruling or order or in anything done or omitted by the court or by any of the parties. Nothing about the conduct of a case is outside it.

The standard. None of that is ground for a new trial or for vacating, modifying or otherwise disturbing a judgment or order unless refusal to take such action appears to the court inconsistent with substantial justice. The question is not whether something went wrong. It is whether letting the result stand would be unjust.

It is a duty, not a discretion. The court at every stage of the proceeding must disregard any error or defect in the proceeding which does not affect the substantial rights of the parties. At every stage — not only on appeal.

The practical consequence is that a party challenging a judgment has to show harm, not just irregularity. Rule 52.1 makes the point again on the appellate side: interlocutory orders reviewed together with the judgment are reviewed subject to this rule.

Esta es la regla que evita que el litigio se convierta en una cacería de errores.

El alcance es total. Cubre el error en la admisión o exclusión de prueba y el error o defecto en cualquier dictamen u orden o en cualquier cosa hecha u omitida por el tribunal o por cualquiera de las partes. Nada del manejo de un caso queda fuera.

El criterio. Nada de eso es fundamento para nuevo juicio ni para dejar sin efecto, modificar o alterar una sentencia u orden a menos que negarse a hacerlo le parezca al tribunal incompatible con la justicia sustancial. La pregunta no es si algo salió mal, sino si dejar el resultado en pie sería injusto.

Es un deber, no una discreción. El tribunal en todas las etapas del procedimiento deberá hacer caso omiso de cualquier error o defecto que no afecte los derechos sustanciales de las partes. En todas las etapas, no solo en apelación.

La consecuencia práctica es que quien impugna una sentencia tiene que demostrar perjuicio, no mera irregularidad. La Regla 52.1 lo repite del lado apelativo: las órdenes interlocutorias que se revisan junto con la sentencia se revisan sujetas a esta regla.
