In all actions the court shall find the facts specially and state separately its conclusions of law thereon and direct the entry of the appropriate judgment. In granting or refusing interlocutory injunctions, the court shall similarly set forth the findings of fact and conclusions of law which constitute the grounds for its action. Findings of fact based on oral evidence shall not be set aside unless clearly erroneous, and due regard shall be given to the opportunity of the trial court to pass upon the credibility of the witnesses. The findings of a master, to the extent that the court adopts them, shall be considered as the findings of the court.
Findings of fact and conclusions of law need not be specified:
(a)on decisions on motions under Rule 10 or 36.1 and 36.2, or any other motion except as provided in Rule 39.2;
(b)in default cases;
(c)by stipulation of the parties; or
(d)when the court so decides in view of the nature or the cause of action or of the relief granted by the judgment.
Where a motion for summary judgment is denied in whole or in part, the court’s findings shall be as prescribed in Rule 36.4.
En todos los pleitos, el tribunal especificará los hechos probados, consignará separadamente sus conclusiones de derecho y ordenará que se registre la sentencia que corresponda. Al conceder o denegar injunction interlocutorios, el tribunal, de igual modo, consignará las determinaciones de hechos y conclusiones de derecho que constituyan los fundamentos de su resolución. Las determinaciones de hechos basadas en testimonio oral no se dejarán sin efecto a menos que sean claramente erróneas, y se dará la debida consideración a la oportunidad que tuvo el tribunal sentenciador para juzgar la credibilidad de los testigos. What this rule doesQué hace esta regla

The requirement. In all actions the court shall find the facts specially, state separately its conclusions of law, and direct entry of the appropriate judgment. The same applies in granting or refusing interlocutory injunctions — the grounds must be set out.

The standard of review. Findings of fact based on oral evidence shall not be set aside unless clearly erroneous, and due regard shall be given to the opportunity of the trial court to pass upon the credibility of the witnesses. This is the sentence that decides most factual appeals.

Masters. A master’s findings, to the extent the court adopts them, are considered the findings of the court — and so carry the same protection.

Four exceptions. Findings need not be specified (a) on decisions on Rule 10 motions or Rules 36.1 and 36.2 or any other motion, except as provided in Rule 39.2; (b) in default cases; (c) by stipulation of the parties; or (d) when the court so decides given the nature of the cause of action or of the relief granted.

The Rule 39.2 carve-out matters: a dismissal at the close of the plaintiff’s evidence does require findings, because the court is deciding facts.

And where summary judgment is denied in whole or in part, the findings are those Rule 36.4 prescribes — which facts are without substantial controversy and which are genuinely disputed.

El requisito. En todos los pleitos el tribunal determinará los hechos especialmente, consignará por separado sus conclusiones de derecho, y ordenará que se dicte la sentencia correspondiente. Lo mismo aplica al conceder o denegar injunctions interlocutorios: hay que exponer los fundamentos.

El criterio de revisión. Las determinaciones de hecho basadas en prueba oral no se dejarán sin efecto salvo que sean claramente erróneas, y se dará la debida consideración a la oportunidad que tuvo el tribunal de instancia de juzgar la credibilidad de los testigos. Esta oración decide casi todas las apelaciones sobre hechos.

Comisionados. Las determinaciones de un comisionado, en la medida en que el tribunal las adopte, se consideran del tribunal, y llevan por tanto la misma protección.

Cuatro excepciones. No hay que consignarlas (a) al resolver mociones bajo la Regla 10 o las Reglas 36.1 y 36.2 o cualquier otra moción, salvo lo dispuesto en la Regla 39.2; (b) en casos en rebeldía; (c) por estipulación de las partes; o (d) cuando el tribunal así lo decida por la naturaleza de la causa de acción o del remedio concedido.

La salvedad de la Regla 39.2 importa: la desestimación al cerrar la prueba de la parte demandante sí exige determinaciones, porque el tribunal está decidiendo hechos.

Y cuando se deniega la sentencia sumaria en todo o en parte, las determinaciones son las que prescribe la Regla 36.4: qué hechos carecen de controversia sustancial y cuáles están realmente en disputa.
