Rule 41.1 covers appointment and compensation. Rule 41.2 is the gate, and it is narrow: a reference in the Court of First Instance is the exception and not the rule, available only for accountings, difficult damages computations, or highly technical matters. Rule 41.3 sets the master’s powers, which must be stated with particularity in the order. Rule 41.4 governs meetings, witnesses and accounts. Rule 41.5 covers the report and its review.
The standard of review is the one to remember: the court shall accept the master’s findings of fact unless clearly erroneous.

La Regla 41.1 cubre el nombramiento y la compensación. La 41.2 es la puerta, y es estrecha: la referencia en el Tribunal de Primera Instancia es la excepción y no la regla, disponible solo para contabilidades, cómputos difíciles de daños, o materias altamente técnicas. La 41.3 fija las facultades, que deben expresarse con particularidad en la orden. La 41.4 rige las reuniones, los testigos y las cuentas. La 41.5 cubre el informe y su revisión.
El criterio de revisión es el que hay que recordar: el tribunal aceptará las determinaciones de hecho del comisionado salvo que sean claramente erróneas.
