(a)Contents and filing. The master shall prepare a report upon all matters submitted to the master by the order of reference and, if required to make findings of fact and conclusions of law, the master shall set them forth in the report, which shall be filed with the clerk of the court on the date specified in the order of reference pursuant to Rule 41.3. Unless otherwise directed, the master shall file with the report a statement of the proceedings, a summary of the evidence, and the original exhibits.
(b)Draft report. Before filing the report, the master may submit a draft thereof to counsel for all parties for the purpose of receiving their suggestions. Once the report is filed, the clerk shall forthwith serve notice thereof on all the parties.
(c)Approval. In all cases, the court shall accept the master’s findings of fact unless clearly erroneous. Within twenty (20) days after being served with notice of the filing of the report or within the term fixed by the court, any party may serve written objections thereto upon the other parties. Applications to the court for action upon the report and upon the objections thereto shall be made by motion and upon notice as prescribed in Rule 67. After hearing the parties, the court may adopt, modify or reject the report, in whole or in part, or may receive further evidence or may resubmit it to the master with instructions.
(d)Stipulations as to findings. The effect of a master’s report is the same whether or not the parties have consented to the reference; but, when the parties stipulate that a master’s findings of fact shall be final, only questions of law arising upon the report shall thereafter be considered.

El comisionado o la comisionada preparará un informe sobre todos los asuntos encomendados por la orden del tribunal, y si se le exige que haga determinaciones de hechos y conclusiones de derecho, las expondrá en el informe, el cual presentará en la Secretaría del tribunal en la fecha señalada en la orden según lo dispuesto en la Regla 41.3. A menos que de otro modo se disponga, acompañará una relación de los procedimientos, un resumen de la prueba y los exhibit originales.
(b)Proyecto del informe. Antes de presentar su informe, el comisionado o la comisionada podrá someter un proyecto de éste a los abogados o las abogadas de todas las partes con el fin de recibir sus sugerencias. Al presentar el informe, el Secretario o la Secretaria lo notificará inmediatamente a todas las partes.
(c)Aprobación al informe. En todos los casos, el tribunal aceptará las determinaciones de hechos del comisionado o de la comisionada, a menos que sean claramente erróneas. Dentro de los veinte (20) días siguientes a la notificación del informe o del término que disponga el tribunal, cualquiera de las partes podrá notificar a las otras sus objeciones por escrito a dicho informe. La solicitud al tribunal para que tome la acción que proceda con respecto al informe y a las objeciones a éste se hará mediante moción y con notificación, según se dispone en la Regla 67. El tribunal, después de oír a las partes, podrá adoptar el informe, modificarlo o rechazarlo en todo o en parte, recibir evidencia adicional o devolverlo con instrucciones.
(d)Estipulación en cuanto a las determinaciones de hechos. El efecto del informe del comisionado o de la comisionada será el mismo, hayan o no consentido las partes a que el asunto sea encomendado a un comisionado o una comisionada, pero cuando las partes estipulen que las determinaciones de hechos del comisionado o la comisionada sean finales, solamente se considerarán en lo sucesivo las cuestiones de derecho que surjan del Informe.

(a) Contents and filing. The master prepares a report on all matters submitted by the order of reference and, if required to make findings of fact and conclusions of law, sets them out in it. It is filed with the clerk on the date specified in the order of reference. Unless otherwise directed, the master also files a statement of the proceedings, a summary of the evidence, and the original exhibits.

(b) Draft report. Before filing, the master may submit a draft to counsel for all parties for their suggestions. Once filed, the clerk forthwith serves notice on all parties. The draft stage is optional and can catch errors before they are on the record.

(c) Approval — and the standard of review. In all cases the court shall accept the master’s findings of fact unless clearly erroneous. That is deferential, and it applies whether or not the parties consented to the reference.

Objections are served on the other parties in writing within twenty (20) days of notice of filing, or the term the court fixes. Applications for action on the report and objections are made by motion on notice under Rule 67. After hearing the parties, the court may adopt, modify or reject the report in whole or in part, receive further evidence, or resubmit it to the master with instructions.

(d) Stipulations. The report has the same effect whether or not the parties consented to the reference — but where they stipulate that the master’s findings of fact shall be final, only questions of law arising upon the report may afterwards be considered.

El comisionado prepara un informe sobre todas las materias sometidas por la orden de referencia y, si se le exige hacer determinaciones de hecho y conclusiones de derecho, las consigna en él. Se presenta en secretaría en la fecha especificada en la orden. Salvo instrucción en contrario, presenta además una relación del procedimiento, un resumen de la prueba y los exhibits originales.

(b) Borrador. Antes de presentarlo, el comisionado puede someter un borrador a la representación legal de todas las partes para recibir sus sugerencias. Presentado, la secretaría notifica de inmediato a todas. La etapa de borrador es opcional y puede atrapar errores antes de que consten.

(c) Aprobación y criterio de revisión. En todos los casos el tribunal aceptará las determinaciones de hecho del comisionado salvo que sean claramente erróneas. Es deferente, y aplica hayan consentido o no las partes a la referencia.

Las objeciones se notifican por escrito a las demás partes dentro de veinte (20) días de la notificación de la presentación, o del término que el tribunal fije. Las solicitudes de acción sobre el informe y sobre las objeciones se hacen por moción notificada conforme a la Regla 67. Oídas las partes, el tribunal puede adoptar, modificar o rechazar el informe en todo o en parte, recibir prueba adicional, o devolverlo al comisionado con instrucciones.

(d) Estipulaciones. El informe tiene el mismo efecto hayan consentido o no las partes, pero cuando estipulan que las determinaciones de hecho serán finales, después solo podrán considerarse las cuestiones de derecho que surjan del informe.
