If a party or party’s attorney fails to comply with in this rule or fails to obey any case management order without good cause shown, the court shall impose on the party or on the party’s attorney such monetary sanctions or penalties as are just.
Si una parte o su abogado o abogada incumple con los términos y señalamientos de esta Regla, o incumple cualquier orden del tribunal para el manejo del caso sin que medie justa causa, el tribunal impondrá a la parte o su abogado o abogada la sanción económica que corresponda. El dinero recaudado por estas sanciones ingresará al Fondo de Acceso a la Justicia para su disposición al amparo de la Ley 165-2013, según enmendada.
What this rule doesQué hace esta regla
The enforcement provision behind the whole of Rule 37, and it is short because it does not need to be long.
The trigger has two forms: a party or a party’s attorney fails to comply with this rule, or fails to obey any case management order — in either case without good cause shown.
The response is mandatory in form: the court shall impose on the party or on the party’s attorney such monetary sanctions or penalties as are just. What is just is left to the court; whether to respond at all is not.
This is the rule the rest of the chapter points at. Rule 37.1 says its terms are of strict compliance subject to the provisions of Rule 37.7. Rule 37.3(c) says the same of the scheduling order’s dates. So "strict compliance" throughout Rule 37 means exactly this: miss it without good cause and a sanction follows.
Note that the exposure runs to the attorney as readily as to the party. Case management failures are usually the lawyer’s, and the rule says so.
La disposición de cumplimiento detrás de toda la Regla 37, y es breve porque no necesita ser larga.
El detonante tiene dos formas: que una parte o su abogado incumpla esta regla, o desobedezca cualquier orden de manejo del caso, en ambos casos sin que se demuestre justa causa.
La respuesta es obligatoria en su forma: el tribunal impondrá a la parte o a su abogado las sanciones económicas o multas que sean justas. Qué es justo queda al tribunal; si responder o no, no.
Es la regla a la que apunta el resto del capítulo. La Regla 37.1 dice que sus términos son de estricto cumplimiento sujetos a lo dispuesto en la Regla 37.7. La 37.3(c) dice lo mismo de las fechas de la orden de calendario. Así que “estricto cumplimiento” a lo largo de la Regla 37 significa exactamente esto: incumplir sin justa causa acarrea sanción.
Note que la exposición alcanza al abogado con la misma facilidad que a la parte. Los fallos de manejo del caso suelen ser de la representación legal, y la regla lo dice.
