(a)Where an initial scheduling conference was held, the court shall enter a scheduling order detailing the terms and agreements.
(b)Where an initial scheduling conference was not ordered, the court shall issue a scheduling order adopting the terms and agreements set forth in the Case Management Report.
(c)The time limits and dates fixed in the scheduling order are of strict compliance, subject to the sanction set forth in Rule 37.7.
(a)En los casos señalados para la conferencia inicial, el tribunal emitirá una orden para la calendarización del proceso que recogerá las disposiciones y los acuerdos.
(b)En aquellos casos en que no se señale la celebración de la conferencia inicial, el tribunal emitirá una orden de calendarización en la cual adoptará las disposiciones y acuerdos incluidos en el Informe para el manejo del caso.
(c)Los términos y los señalamientos fijados en la orden de calendarización serán de estricto cumplimiento, sujeto a la sanción establecida en la Regla 37.7.
What this rule doesQué hace esta regla
Three short subdivisions, and the third is the one that governs the rest of the case.
(a) Where an initial scheduling conference was held, the court enters a scheduling order detailing the terms and agreements.
(b) Where no conference was ordered, the court still issues an order, adopting the terms and agreements set forth in the Case Management Report. So a case always gets a scheduling order, and the parties’ own report becomes binding when it does.
(c) The time limits and dates fixed in the scheduling order are of strict compliance, subject to the sanction in Rule 37.7.
"Strict compliance" is not a figure of speech in these rules. Rule 26 makes it the outer limit on what the parties may stipulate — deposition arrangements may be varied freely except where they conflict with this order. And Rule 37.7 supplies the consequence for disobeying it.
Tres incisos breves, y el tercero gobierna el resto del caso.
(a) Celebrada una conferencia inicial sobre el calendario, el tribunal dicta una orden que detalla los términos y acuerdos.
(b) Si no se ordenó conferencia, el tribunal igual emite una orden, adoptando los términos y acuerdos del Informe de Manejo del Caso. Así, todo caso recibe una orden de calendario, y el informe de las propias partes se vuelve obligatorio cuando ello ocurre.
(c) Los términos y las fechas fijadas en la orden son de estricto cumplimiento, sujetos a la sanción de la Regla 37.7.
“Estricto cumplimiento” no es una figura retórica en estas reglas. La Regla 26 lo convierte en el límite exterior de lo que las partes pueden estipular: los arreglos de deposiciones pueden variarse libremente salvo que choquen con esta orden. Y la Regla 37.7 aporta la consecuencia de desobedecerla.
