Rule 35.1 is the offer of judgment — the one with teeth, because refusing an offer and then doing no better costs you the other side’s post-offer costs, expenses and attorney’s fees. Rule 35.2 covers the defendant who tendered the full amount before suit and deposits it. Rule 35.3 allows a deposit in court by leave. Rule 35.4 lets a judgment be entered on consent, even before an action is filed.
Rule 35.1 rewards realism. An offer made more than twenty days before trial forces the other side to price its own case honestly.

La Regla 35.1 es la oferta de sentencia, la que tiene filo, porque rechazarla y no lograr nada mejor cuesta las costas, gastos y honorarios de abogado posteriores a la oferta. La 35.2 cubre a la parte demandada que ofreció el total antes del pleito y lo consigna. La 35.3 permite la consignación con permiso. La 35.4 permite dictar sentencia por consentimiento, incluso antes de presentar el pleito.
La Regla 35.1 premia el realismo. Una oferta hecha más de veinte días antes del juicio obliga a la otra parte a tasar su propio caso con honestidad.
