(a)A judgment may be entered without a trial or before the commencement of action, based upon the consent of a person with the legal capacity to obligate him/herself, either for money due or to become due, or to secure any person against contingent liabilities in favor of the defendant, or both, in the manner prescribed by this rule. Once the Court issues such judgment, it shall be entered and notified by the Court’s clerk and will become final and binding at the date of entry.
(b)Such consent shall appear from a verified statement, signed by the defendant, to the following effect:
(1)It must authorize the entry of judgment for a specified sum.
(2)If it be for money due or to become due, it must concisely state the facts out of which it arose and show that the sum confessed therefor is justly due, or to become due.
(3)If it be for the purpose of securing the plaintiff against a contingent liability, it must concisely state the facts constituting the liability and show that the sum confessed therefor does not exceed the amount of liability.
(a)Podrá dictarse sentencia sin la celebración de un juicio o sin haberse iniciado un pleito, fundada en el consentimiento de una persona con capacidad legal para obligarse, ya sea por dinero debido o que haya de deber o para asegurar a otra contra responsabilidades eventuales contraídas a favor de la parte demandada, o por ambas cosas, en la forma prescrita en esta regla. Una vez el tribunal pase juicio, la misma será registrada y notificada por el Secretario o Secretaria del tribunal y advendrá final y firme desde la fecha de su registro.
(b)Dicho consentimiento deberá aparecer de un escrito firmado bajo juramento por la parte demandada, haciendo constar lo siguiente:
(1)Su autorización para que se dicte sentencia en su contra por una suma determinada.
(2)Si es por dinero debido o que haya de deberse, expondrá concisamente los hechos y el origen de la deuda, y demostrará que la suma consentida se debe o se deberá en justicia.
(3)Si es con el fin de garantizar a la parte demandante contra una responsabilidad eventual, expondrá concisamente los hechos constitutivos de la responsabilidad y demostrará que la suma consentida no excede el importe de la responsabilidad.
What this rule doesQué hace esta regla
(a) The device. A judgment may be entered without a trial or before the commencement of an action, based on the consent of a person with legal capacity to obligate themselves — either for money due or to become due, or to secure a person against contingent liabilities in the defendant’s favour, or both. Once issued, the clerk enters and notifies it, and it becomes final and binding at the date of entry.
That is an unusual amount of power in a single instrument: a binding judgment with no complaint, no answer and no hearing.
(b) The safeguards. The consent must appear from a verified statement signed by the defendant, and it must do three things. (1)Authorise the entry of judgment for a specified sum — no open-ended consent. (2) If for money due or to become due, concisely state the facts out of which it arose and show that the sum is justly due. (3) If to secure against a contingent liability, concisely state the facts constituting the liability and show the sum does not exceed the amount of that liability.
Each requirement guards against the same risk — a confessed judgment for more than is genuinely owed. The statement has to show its own work, under oath, and a court reading it can see whether the number is justified.
(a) El mecanismo. Puede dictarse sentencia sin juicio o antes de comenzar un pleito, sobre el consentimiento de una persona con capacidad legal para obligarse, ya sea por dinero vencido o por vencer, o para garantizar a una persona contra responsabilidades contingentes a favor de la parte demandada, o ambas. Dictada, la secretaría la registra y notifica, y queda final y firme a la fecha del registro.
Es una cantidad inusual de poder en un solo instrumento: una sentencia obligatoria sin demanda, sin contestación y sin vista.
(b) Las salvaguardas. El consentimiento debe surgir de una declaración jurada firmada por la parte demandada, y debe hacer tres cosas. (1)Autorizar el registro de sentencia por una suma específica: nada de consentimientos abiertos. (2) Si es por dinero vencido o por vencer, exponer concisamente los hechos de que surgió y demostrar que la suma se debe justamente. (3) Si es para garantizar contra una responsabilidad contingente, exponer concisamente los hechos que la constituyen y demostrar que la suma no excede el monto de esa responsabilidad.
Cada requisito protege contra el mismo riesgo: una sentencia confesada por más de lo que realmente se debe. La declaración tiene que mostrar su trabajo, bajo juramento, y un tribunal que la lea puede ver si la cifra está justificada.
