At any time more than twenty (20) days before the trial begins, a party defending against a claim may serve upon the adverse party an offer to allow judgment to be taken against the defending party for the money or property or to the effect specified in the offer, with costs then accrued. The offer must meet the following requirements:
(1)Be made in writing and served by certified mail upon the party to whom it is made.
(2)Name the party making the offer and the party to whom the offer is being made.
If within ten (10) days after the service of the offer the adverse party serves written notice that the offer is accepted, either party may then file the offer and notice of acceptance together with proof of service thereof, and thereupon the clerk of the court shall enter judgment. An offer not accepted shall be deemed withdrawn and evidence thereof is not admissible except in a proceeding to determine costs, expenses, and attorney’s fees, or in a proceeding to compel compliance with the judgment entered as a result of an offer of judgment.
If the judgment finally obtained by the offeree is similar to or less favorable than the offer, the offeree must pay the costs, expenses, and attorney’s fees incurred after the making of the offer.
The fact that an offer is made but not accepted does not preclude a subsequent offer. When the liability of one party to another has been determined by judgment, but the amount of damages or the extent of the liability remains to be determined by further proceedings, the party adjudged liable may make an offer of judgment, which shall have the same effect as an offer made before trial if it is served within a reasonable time not less than twenty (20) days prior to the commencement of the hearing.
En cualquier momento antes de los veinte (20) días precedentes al comienzo del juicio, la parte que se defiende de una reclamación podrá notificar a la parte adversa una oferta para consentir a que se dicte sentencia en su contra por la cantidad, por la propiedad o en el sentido especificado en su oferta, con las costas devengadas hasta ese momento. La oferta deberá cumplir con los requisitos siguientes:
(1)Hacerse por escrito, notificando a la parte a quien se le hace mediante correo certificado.
(2)Especificar quién hace la oferta y la parte a la que va dirigida.
(3)Establecer la cantidad, si alguna, que se ofrece en concepto de daños.
(4)Especificar la cantidad total o propiedad y condiciones ofrecidas.
(5)Establecer la cantidad en concepto de costas devengadas hasta el momento.
Si dentro de los diez (10) días siguientes a la notificación la parte adversa notifica por escrito que acepta la oferta, cualquiera de las partes podrá presentarla junto con la notificación de su aceptación y la prueba de su notificación, y entonces el Secretario o Secretaria del tribunal dictará sentencia. Si no es aceptada así, se considerará retirada y no se admitirá en evidencia, excepto en un procedimiento para determinar costas, gastos y honorarios de abogado o abogada, o en un procedimiento para obligar al cumplimiento de una sentencia dictada, producto de una oferta de sentencia.
En todo caso en que la sentencia que obtenga finalmente la parte a quien se le hizo la oferta sea igual o menos favorable, ésta tendrá que pagar las costas, los gastos y los honorarios de abogado o abogada en que se incurrió con posterioridad a la oferta.
El hecho de que se haga una oferta y ésta no se acepte no impide que se haga otra subsiguiente. Cuando la responsabilidad de una parte haya sido adjudicada mediante sentencia pero queda aún por resolverse en procedimientos ulteriores la cuantía de los daños o la extensión de dicha responsabilidad, la parte cuya responsabilidad se haya adjudicado podrá notificar una oferta de sentencia y ésta tendrá el mismo efecto que una oferta hecha antes del juicio si se notifica dentro de un término razonable no menor de veinte (20) días antes del comienzo de la vista.
What this rule doesQué hace esta regla
Who and when. A party defending against a claim, at any time more than twenty (20) days before trial begins, may serve an offer to allow judgment to be taken against it for money, property, or the effect specified, with costs then accrued.
The five requirements. The offer must be in writing and served by certified mail; name the offeror and the offeree; state the amount offered for damages, if any; specify the total amount or property and conditions offered; and state the amount for costs then accrued. Each is worth checking — an offer that does not comply cannot do the work the rule gives it.
Acceptance. Within ten (10) days of service the offeree may serve written notice of acceptance; either party may then file the offer, the notice and proof of service, and the clerk enters judgment. No judicial approval step is described.
Rejection. An offer not accepted is deemed withdrawn and evidence of it is not admissible — except in a proceeding to determine costs, expenses and attorney’s fees, or one to compel compliance with a judgment entered on an offer.
The consequence. If the judgment finally obtained by the offeree is similar to or less favourable than the offer, the offeree must pay the costs, expenses and attorney’s fees incurred after the offer was made. Note "similar to": matching the offer is not enough to escape.
Later offers, and offers after liability. A rejected offer does not preclude another. And where liability has been determined but damages or extent remain, the party adjudged liable may make an offer with the same effect, if served at least twenty days before the hearing begins.
Quién y cuándo. La parte que se defiende de una reclamación, en cualquier momento más de veinte (20) días antes de comenzar el juicio, puede notificar una oferta para que se dicte sentencia en su contra por dinero, bienes, o el efecto que especifique, con las costas acumuladas.
Los cinco requisitos. La oferta debe ser escrita y notificada por correo certificado; nombrar a quien ofrece y a quien se ofrece; expresar la suma ofrecida por daños, si alguna; especificar la suma total o los bienes y las condiciones ofrecidas; y expresar la suma por las costas acumuladas. Conviene cotejar cada uno: una oferta que no cumple no puede hacer el trabajo que la regla le da.
Aceptación. Dentro de diez (10) días de la notificación, quien recibe puede notificar por escrito su aceptación; cualquiera de las partes puede entonces presentar la oferta, la notificación y la prueba de su notificación, y la secretaría dicta sentencia. No se describe un paso de aprobación judicial.
Rechazo. La oferta no aceptada se tiene por retirada y su evidencia no es admisible, salvo en un procedimiento para determinar costas, gastos y honorarios, o para exigir el cumplimiento de una sentencia dictada por una oferta.
La consecuencia. Si la sentencia finalmente obtenida por quien rechazó es similar o menos favorable que la oferta, esa parte debe pagar las costas, gastos y honorarios de abogado incurridos después de la oferta. Note lo de “similar”: igualar la oferta no basta para escapar.
Ofertas posteriores y tras la responsabilidad. Una oferta rechazada no impide otra. Y cuando ya se determinó la responsabilidad pero faltan los daños o su extensión, la parte hallada responsable puede ofrecer con el mismo efecto, si lo notifica al menos veinte días antes de comenzar la vista.
