If a party, or an officer, director or managing agent of a party, or a person designated under Rule 27.6 or 28 to testify on behalf of a party fails:
(1)to appear before the officer who is to take the deposition, after being served with a proper notice,
(2)to serve answers or objections to interrogatories submitted under Rule 30, after proper service of the interrogatories, or
(3)to serve a written response to a request for inspection, after proper service of the request, the court, on motion of a party, may make such orders in regard to the failure as are just, and among others it may take any action authorized under paragraphs (1), (2), and (3) of subdivision (b) of Rule 34.3. In lieu of any of the foregoing orders or in addition thereto, the court shall require the party failing to act or the attorney advising that party, or both, to pay the reasonable expenses, including attorney’s fees, caused by the failure, unless the court finds that the failure was substantially justified or that other circumstances make an award of expenses unjust.
The failure to act described in this rule may not be excused on the ground that the discovery sought is objectionable, unless the party failing to act has obtained a protective order as provided by Rule 23.2.
If the party giving the notice of the taking of a deposition fails to attend and another party attends in person or by attorney pursuant to the notice, the court may order the party giving the notice to pay to the other party the reasonable expenses incurred in so attending, including reasonable attorney’s fees.
If the party giving the notice of the taking of a deposition fails to serve the witness with a subpoena and the witness because of such failure does not attend, and if another party attends in person or by attorney expecting the deposition of that witness to be taken, the court may order the party giving the notice to pay such other party the reasonable expenses incurred in so attending, including reasonable attorney’s fees.
Si una parte, un funcionario o una funcionaria, un agente administrador o una agente administradora de una parte o una persona designada para testificar a su nombre, según disponen las Reglas 27.6 ó 28, deja de:
(1)comparecer ante la persona ante quien se ha de tomar su deposición después de haber sido debidamente notificada,
(2)presentar contestaciones u objeciones a los interrogatorios sometidos de acuerdo con la Regla 30 después de habérseles notificado debidamente, o
(3)presentar una contestación por escrito a una solicitud para efectuar una inspección después de habérsele notificado debidamente, el tribunal, a solicitud de parte, podrá dictar, con relación al incumplimiento, aquellas órdenes que sean justas, entre ellas, tomar cualquier acción de las autorizadas en las cláusulas (1), (2) y (3) del inciso (b) de la Regla 34.3. En lugar de cualquiera de las órdenes anteriores o adicional a ellas, el tribunal impondrá a la parte que incumpla o al abogado o abogada que la aconsejó, o a ambos, el pago del importe de los gastos razonables ocasionados por la negativa, incluso los honorarios de abogado o abogada, a menos que el tribunal determine que existía una justificación válida para el incumplimiento o que, dentro de las circunstancias, el pago de los gastos resultaría injusto.
No será excusable el incumplimiento a que se refiere esta regla, por el fundamento de que lo solicitado es objetable, a menos que la parte que incumpla haya obtenido una orden protectora de acuerdo con la Regla 23.2.
Si una parte que notificó la toma de la deposición deja de comparecer y otra parte comparece en persona o por medio de abogado o abogada conforme a dicha notificación, el tribunal podrá ordenar a la parte que hizo la notificación que pague a la otra el importe de los gastos razonables en que hayan incurrido para comparecer, incluso una suma razonable para honorarios de abogado.
Si la parte que notificó la toma de la deposición a una persona testigo deja de entregarle una citación y ésta, por razón de tal omisión, no comparece, y si otra parte asiste en persona o por medio de abogado o abogada porque espera que la deposición de dicha persona testigo ha de ser tomada, el tribunal podrá ordenar a la parte que hizo la notificación que pague a la otra el importe de los gastos razonables en que hayan incurrido para comparecer, incluso una suma razonable para honorarios de abogado o abogada.

What this rule doesQué hace esta regla

The distinction from Rule 34.3 is that no court order is needed first. Three failures suffice: (1) not appearing before the officer after proper notice; (2) not serving answers or objections to Rule 30 interrogatories after proper service; (3) not serving a written response to an inspection request after proper service.

On motion, the court may make such orders as are just, including any action authorised by Rule 34.3(b)(1), (2) and (3) — facts taken as established, claims or defences barred, pleadings struck, the case stayed, dismissed, or default judgment entered. And in addition or instead, the court shall require the party or its advising attorney, or both, to pay the reasonable expenses including fees, unless substantially justified or unjust.

The sentence that catches people: the failure may not be excused on the ground that the discovery sought is objectionable, unless the party has obtained a protective order under Rule 23.2. Believing a request is improper is not a reason to ignore it. Object, or move — do not go silent.

The last two paragraphs run the other way, against the party who noticed the deposition. If it fails to attend and another party attends, the court may order it to pay that party’s reasonable expenses including fees. Same if it fails to serve the witness with a subpoena and the witness therefore does not come, while another party attends expecting the deposition.

La diferencia con la Regla 34.3 es que no hace falta una orden previa. Bastan tres omisiones: (1) no comparecer ante el funcionario tras notificación adecuada; (2) no notificar contestaciones u objeciones a los interrogatorios de la Regla 30 tras su notificación adecuada; (3) no notificar respuesta escrita a una solicitud de inspección tras su notificación adecuada.

A solicitud, el tribunal puede dictar las órdenes que sean justas, incluida cualquier acción autorizada por la Regla 34.3(b)(1), (2) y (3): tener hechos por establecidos, impedir reclamaciones o defensas, eliminar alegaciones, paralizar el caso, desestimarlo o dictar rebeldía. Y además o en su lugar, el tribunal exigirá a la parte o a su abogado, o a ambos, pagar los gastos razonables incluidos honorarios, salvo justificación sustancial o injusticia.

La oración que sorprende: la omisión no puede excusarse alegando que el descubrimiento es objetable, salvo que la parte haya obtenido una orden protectora bajo la Regla 23.2. Creer que una solicitud es impropia no es razón para ignorarla. Objete, o solicite; no guarde silencio.

Los dos últimos párrafos corren al revés, contra quien notificó la deposición. Si no comparece y otra parte sí, el tribunal puede ordenarle pagar los gastos razonables de esa parte, incluidos honorarios. Igual si no le entrega citación al testigo y por eso este no comparece, mientras otra parte acude esperando la deposición.
