(a)Petition. A person who desires to perpetuate his or her own testimony or that of another person regarding any matter that may be cognizable in a court may file in the court a verified petition to such ends. The petition shall be entitled in the name of the petitioner and shall show:
(1)that the petitioner expects to be a party to an action cognizable in a court but is presently unable to bring it or cause it to be brought;
(2)the subject matter of the expected action and the petitioner’s interest therein;
(3)the facts that the petitioner desires to establish by the proposed testimony and the reasons for desiring to perpetuate it;
(4)the names or a description of the persons the petitioner expects will be adverse parties and their addresses so far as known; and
(5)the names and addresses of the persons to be examined and the substance of the testimony that the petitioner expects to elicit from each.
(6)his/her interest that the deposition be taken via oral examination or written questions.
(b)Notice. After the petition is filed, the petitioner shall serve written notice upon each person named in the petition as an expected adverse party. The notice shall be served in the manner provided by Rule 4.4 for service of summons, and a period of at least fifteen (15) days shall be allowed for the parties so served to raise any objection to the petition. If such service cannot with due diligence be made upon any of the persons named in the petition, the court may make such order as is just for service by publication or otherwise, and shall take such measures as are appropriate to safeguard the interests of persons not served. If any of those persons is a child or is incompetent, the provisions of Rule 15.2 shall apply.
(c)Order and examination. If the court is satisfied that the perpetuation of the testimony may prevent a failure or delay of justice, it shall issue an order designating or describing the persons whose depositions may be taken and specifying the subject matter of the examination and whether the depositions shall be taken upon oral examination or written interrogatories. The depositions may then be taken in accordance with these rules, and the court may issue orders of the character provided for by Rules 31 and 32. For the purpose of applying these rules to depositions for perpetuating testimony, each reference therein to the court in which the action is pending shall be deemed to refer to the court in which the petition for such deposition was filed.
(d)Use of deposition. If a deposition to perpetuate a testimony is taken under these rules or if, although not so taken, it would be admissible in evidence in the courts of the jurisdiction in which it is taken, it may be used in any action involving the same subject matter subsequently brought in accordance with the provisions of Rule 29.1.
(a)Petición. Quien desee perpetuar su propio testimonio o el de otra persona con relación a un asunto en el cual pueda entender el tribunal, podrá presentar ante éste una petición jurada al efecto. Se intitulará la petición con el nombre de la persona peticionaria y en ella se hará constar:
(1)que la persona peticionaria espera ser parte en un pleito en el cual puede entender el tribunal, pero que por el presente le es imposible iniciarlo o lograr que lo inicie otra persona;
(2)la cuestión implicada en el pleito en expectativa y su interés en éste;
(3)los hechos que desea establecer mediante el testimonio propuesto y las razones que tenga para interesar su perpetuación;
(4)los nombres o una descripción de las personas que la persona peticionaria espera que habrán de ser partes adversas y sus direcciones, si son conocidas, y
(5)los nombres y las direcciones de las personas que han de ser interrogadas y la sustancia del testimonio que espera obtener de cada una.
(6)su interés en que la deposición sea tomada mediante examen oral o preguntas escritas.
(b)Notificación. Presentada la solicitud, la persona peticionaria la notificará por escrito a cada una de las personas mencionadas en ella como probables partes adversas. La notificación será diligenciada en la forma prescrita por la Regla 4.4 para diligenciar un emplazamiento y fijará un término no menor de quince (15) días en que las partes notificadas podrán comparecer a oponerse a la solicitud. Si a pesar de la debida diligencia no puede notificar a alguna de las personas mencionadas en la petición, el tribunal podrá dictar la orden que considere justa para que la notificación se haga mediante publicación o en cualquier otra forma, y tomará las medidas que estime razonables para proteger los intereses de las personas que no hayan sido notificadas. Si alguna de las personas es un o una menor o incapacitado o incapacitada, se aplicarán las disposiciones de la Regla 15.2.
(c)Orden e interrogatorio. Si el tribunal queda satisfecho de que la perpetuación del testimonio puede impedir un fracaso o una dilación de la justicia, dictará una orden en la que designe o describa las personas cuyas deposiciones podrán ser tomadas, y especifique los asuntos sobre los cuales versará el interrogatorio, así como si las deposiciones deberán ser tomadas mediante interrogatorio oral o escrito. Se podrán entonces tomar las deposiciones de acuerdo con estas reglas y el tribunal podrá dictar órdenes similares a las dispuestas en las Reglas 31 y 32. A los efectos de la aplicación de estas reglas a las deposiciones para perpetuar testimonio, toda referencia en éstas al tribunal ante el cual el pleito esté pendiente se entenderá que significa el tribunal ante el cual se presentó la petición para la toma de tales deposiciones.
(d)Uso de la deposición. Si una deposición para perpetuar un testimonio es tomada de acuerdo con estas reglas o, aunque no haya sido así tomada, es admisible en evidencia en los tribunales de la jurisdicción en que fue tomada, podrá ser usada en cualquier pleito incoado posteriormente que involucre el mismo asunto, con arreglo a las disposiciones de la Regla 29.1.

(a) The petition. Verified, entitled in the petitioner’s name, and it must show six things: that the petitioner expects to be a party to a cognizable action but is presently unable to bring it; the subject matter and the petitioner’s interest; the facts to be established and why perpetuating them matters; the names or description of expected adverse parties with addresses so far as known; the names and addresses of the persons to be examined and the substance of the expected testimony; and whether the deposition should be by oral examination or written questions.

(b) Notice. Written notice on each expected adverse party, served in the manner Rule 4.4 prescribes for a summons — real service, not Rule 67 mailing — with at least fifteen (15) days to raise objections. If due diligence cannot achieve service, the court may order service by publication or otherwise and must take appropriate measures to safeguard the interests of those not served. Rule 15.2 applies if any of them is a child or incompetent.

(c) Order and examination. The court issues the order only if satisfied that perpetuation may prevent a failure or delay of justice. The order designates whose depositions may be taken, the subject matter, and whether oral or written. The court may issue Rule 31 and Rule 32 orders, and for these purposes every reference to "the court in which the action is pending" means the court where the petition was filed.

(d) Use. The deposition may be used in a later action on the same subject matter under Rule 29.1 — and, notably, so may a deposition not taken under these rules if it would be admissible in the courts of the jurisdiction where it was taken.

Jurada, a nombre de quien peticiona, y debe demostrar seis cosas: que espera ser parte de un pleito conocible pero no puede presentarlo ahora; la materia y su interés; los hechos a establecer y por qué importa perpetuarlos; los nombres o la descripción de las esperadas partes adversas con sus direcciones conocidas; los nombres y direcciones de quienes serán examinados y la sustancia del testimonio esperado; y si la deposición será oral o por preguntas escritas.

(b) Notificación. Aviso escrito a cada esperada parte adversa, notificado en la forma que la Regla 4.4 prescribe para el emplazamiento —diligenciamiento real, no el correo de la Regla 67— con al menos quince (15) días para objetar. Si la debida diligencia no logra el diligenciamiento, el tribunal puede ordenar la publicación u otra vía y debe tomar medidas para salvaguardar a quienes no fueron notificados. La Regla 15.2 aplica si alguna es persona menor o incapaz.

(c) Orden y examen. El tribunal emite la orden solo si se convence de que la perpetuación puede evitar un fracaso o una dilación de la justicia. La orden designa a quiénes se depondrá, la materia, y si será oral o escrita. Puede emitir órdenes de las Reglas 31 y 32, y para estos fines toda referencia al “tribunal donde está pendiente el pleito” significa aquel donde se presentó la petición.

(d) Uso. La deposición puede usarse en un pleito posterior sobre la misma materia conforme a la Regla 29.1 y, notablemente, también una no tomada bajo estas reglas si fuera admisible en los tribunales de la jurisdicción donde se tomó.
