At the trial or upon the hearing of a motion or an interlocutory proceeding, any part or all of a deposition, so far as admissible under the Rules of Evidence applied as though the witness were then present and testifying, may be used against any party who was present or represented at the taking of the deposition or who had reasonable notice thereof, in accordance with any of the following provisions:
(a)Any deposition may be used by any party for the purpose of contradicting or impeaching the testimony given by the deponent as a witness.
(b)The deposition of a party or of anyone who at the time of taking the deposition was an officer, director or managing agent, or a person designated under Rule 27.6 to testify on behalf of a public or private corporation, partnership, association, or governmental agency that is a party to the action may be used by an adverse party for any purpose.
(c)The deposition of a witness, whether a party or not, may be used by any party for any purpose if the court finds:
(1)that the witness is dead;
(2)that it has been shown that it would be burdensome to require appearance at trial of a witness who is not in Puerto Rico, unless it is shown that the absence of the witness was procured by the party offering the deposition;
(3)that the witness is unable to attend or testify because of age, illness, or physical disability;
(4)that the party offering the deposition has been unable to produce the attendance of the witness by subpoena; or
(5)upon application and notice, that such exceptional circumstances exist as to make it desirable, in the interest of justice and with due regard to the importance of presenting the testimony of witnesses orally in open court, to allow the deposition to be used.
(d)If only part of a deposition is offered in evidence by a party, an adverse party may require the offeror to introduce any other relevant and admissible part that ought in fairness to be considered with the part introduced, and any party may introduce any other parts of the deposition.
Substitution of parties does not affect the right to use depositions previously taken; and when an action in the General Court of Justice or in any court of the United States or of any of its states, territories or possessions has been dismissed, and another action involving the same subject matter is afterwards brought between the same parties or their representatives or successors in interest, all depositions lawfully taken and duly filed in the former action may be used in the latter as if originally taken therefor.
En el juicio, o al celebrarse la vista de una moción o de un procedimiento interlocutorio, la totalidad o cualquier parte de una deposición, en cuanto sea admisible de acuerdo con las Reglas de Evidencia, aplicadas como si el o la deponente estuviese testificando en corte, podrá utilizarse contra cualquier parte que haya estado presente o representada en la toma de la deposición o que haya sido debidamente notificada de dicho acto, de acuerdo con cualquiera de las disposiciones siguientes:
(a)Cualquier parte podrá utilizar cualquier deposición con el propósito de contradecir o impugnar el testimonio del o de la deponente como testigo.
(b)La deposición de una parte o la de cualquier persona que en la fecha en que se tomó la deposición era un o una oficial, funcionario o funcionaria, director o directora, o agente administrador o agente administradora, o persona designada bajo la Regla 27.6 para testificar a nombre de una corporación pública o privada, sociedad, asociación o agencia gubernamental que sea parte en el pleito, podrá utilizarse por la parte adversa para cualquier propósito.
(c)La deposición de una persona testigo, ya sea parte o no, podrá utilizarse por cualquiera de las partes para cualquier propósito si el tribunal determina:
(1)que la persona testigo ha fallecido;
(2)que se ha demostrado que sería oneroso requerir la presencia en el juicio de una persona testigo que se encuentra fuera de Puerto Rico, a menos que se pruebe que la ausencia de la persona testigo fue motivada por la parte que ofrece la deposición;
(3)que la persona testigo no puede comparecer a declarar por su avanzada edad, enfermedad o incapacidad física;
(4)que la parte que ofrece la deposición no ha podido conseguir la comparecencia de la persona testigo mediante una citación, o
(5)mediante solicitud y notificación demostrativas de que existen circunstancias de tal forma excepcionales que hacen deseable, en interés de la justicia y dando la debida consideración a la importancia de presentar oralmente el testimonio de los o las deponentes en corte abierta, que se permita el uso de la deposición.
(d)Si una parte ofrece en evidencia solamente un fragmento de una deposición, la parte adversa podrá exigirle que presente cualquier otro fragmento de la deposición que sea relevante y admisible, y que en justicia deba ser considerado con el fragmento ya ofrecido. De igual forma, cualquier parte podrá ofrecer cualesquiera otros fragmentos de dicha deposición.
La sustitución de parte no afectará el derecho a usar deposiciones previamente tomadas, y cuando un pleito incoado ante el Tribunal General de Justicia o ante una corte de Estados Unidos o de cualquiera de sus estados, territorios o posesiones ha sido sobreseído, y luego se presente un nuevo pleito que involucre la misma cuestión litigiosa entre las mismas partes o sus representantes o causahabientes, todas las deposiciones legalmente tomadas y debidamente archivadas en el pleito anterior se podrán usar en el nuevo pleito como si hubiesen sido originalmente tomadas para éste.

What this rule doesQué hace esta regla

The threshold has three elements. The deposition must be admissible under the Rules of Evidence applied as though the witness were then present and testifying; it may be used against a party who was present or represented at the taking, or who had reasonable notice; and it must fit one of the following provisions.

(a) Impeachment. Any deposition, by any party, to contradict or impeach the deponent’s testimony as a witness.

(b) The other side’s own words. The deposition of a party, or of anyone who was then an officer, director or managing agent, or a Rule 27.6 designee for a corporation, partnership, association or governmental agency that is a party, may be used by an adverse party for any purpose. This is the provision that makes Rule 27.6 depositions so valuable.

(c) Unavailable witnesses. Any party may use any witness’s deposition for any purpose if the court finds: the witness is dead; that requiring attendance would be burdensome for a witness not in Puerto Rico (unless the offering party procured the absence); inability to attend or testify through age, illness or physical disability; failure to produce attendance by subpoena; or, on application and notice, exceptional circumstances making use desirable in the interest of justice and with due regard to live testimony.

(d) Completeness. If part is offered, an adverse party may require the offeror to introduce any other relevant and admissible part that ought in fairness to be considered with it, and any party may introduce further parts.

The closing paragraph carries two portable rules. Substitution of parties does not affect the right to use depositions already taken. And where an action in the General Court of Justice or any United States court has been dismissed and another on the same subject matter is brought between the same parties or their representatives or successors, all depositions lawfully taken and duly filed in the former may be used in the latter as if originally taken for it.

El umbral tiene tres elementos. La deposición debe ser admisible bajo las Reglas de Evidencia aplicadas como si el testigo estuviera presente declarando; puede usarse contra la parte que estuvo presente o representada en la toma, o que tuvo notificación razonable; y debe encajar en una de las disposiciones siguientes.

(a) Impugnación. Cualquier deposición, por cualquier parte, para contradecir o impugnar el testimonio de la persona deponente como testigo.

(b) Las propias palabras de la otra parte. La deposición de una parte, o de quien entonces fuera oficial, director o agente administrador, o de una persona designada bajo la Regla 27.6 por una corporación, sociedad, asociación o agencia gubernamental que sea parte, puede usarla la parte adversa para cualquier fin. Es lo que hace tan valiosas las deposiciones de la Regla 27.6.

(c) Testigos no disponibles. Cualquier parte puede usar la deposición de cualquier testigo para cualquier fin si el tribunal determina: que el testigo murió; que sería oneroso exigir la comparecencia de quien no está en Puerto Rico (salvo que quien la ofrece procurara la ausencia); la imposibilidad de comparecer o declarar por edad, enfermedad o impedimento físico; el fracaso en lograr la comparecencia mediante citación; o, previa solicitud y notificación, circunstancias excepcionales que hagan deseable su uso en interés de la justicia y con la debida consideración al testimonio oral.

(d) Integridad. Ofrecida una parte, la adversa puede exigir que se introduzca cualquier otra pertinente y admisible que en justicia deba considerarse con ella, y cualquier parte puede introducir otras porciones.

El párrafo final trae dos reglas portátiles. La sustitución de partes no afecta el derecho a usar deposiciones ya tomadas. Y cuando un pleito ante el Tribunal General de Justicia o cualquier tribunal de los Estados Unidos se desestimó y se trae otro sobre la misma materia entre las mismas partes o sus representantes o sucesores, todas las deposiciones legalmente tomadas y presentadas en el primero pueden usarse en el segundo como si se hubieran tomado para él.
