The most intrusive discovery method, and the only one requiring a court order in every case.
Rule 32.1 sets the condition — the mental or physical condition of a party, or of someone in a party’s custody or legal control, must be in controversy — and adds a provision with real bite: a party who puts its own condition in issue waives privacy over the related medical or psychological records.
Rule 32.2 handles the exchange of reports, on a forty-five day clock, and sets out the privilege waiver that follows from asking for the report or deposing the examiner.

La Regla 32.1 fija la condición —la condición mental o física de una parte, o de quien esté bajo su custodia o control legal, debe estar en controversia— y añade una disposición con filo real: quien pone en cuestión su propia condición renuncia a la intimidad sobre los expedientes médicos o psicológicos relacionados.
La Regla 32.2 atiende el intercambio de informes, con un reloj de cuarenta y cinco días, y expone la renuncia al privilegio que sigue a pedir el informe o deponer a quien examinó.
