If an appeal has been taken from a judgment of a court, or before the taking of an appeal if the time therefor has not expired, the court that rendered the judgment may allow the taking of the depositions of witnesses to perpetuate their testimony for use in the event of further proceedings in that court. In such case, the party who desires to perpetuate the testimony may file a motion in the court for leave to take the depositions, upon the same notice and service thereof on the adverse party as if the action were pending in that court. The motion shall show: (1) the names and addresses of the persons to be examined and the substance of the testimony which the party expects to elicit from each; and (2) the reasons for perpetuating their testimony. If the court finds that the perpetuation of the testimony is necessary to avoid a failure or delay of justice, it may issue an order allowing the depositions to be taken and may issue orders of the character provided for by Rules 31 and 32, and thereupon these depositions may be taken and used in the same manner and under the same conditions as are prescribed in these rules for depositions taken in pending actions.
Si se ha interpuesto una apelación contra una sentencia del tribunal, o si el plazo para tal acción no ha expirado antes de interponerse una apelación, el tribunal que haya dictado la sentencia podrá permitir que se tomen las deposiciones de testigos para perpetuar sus testimonios y usarlos en casos de ulteriores procedimientos ante la misma. En tal caso, la parte que desee perpetuar el testimonio podrá presentar ante el tribunal una moción de permiso para tomar las deposiciones, con igual aviso y notificación a la parte contraria como si el pleito estuviera pendiente ante dicho tribunal. En la moción se hará constar: (1) los nombres y las direcciones de las personas que han de ser interrogadas y la sustancia del testimonio que se espera obtener de cada una, y (2) las razones para la perpetuación de sus testimonios. Si el tribunal estima que la perpetuación del testimonio es necesaria para evitar un fracaso o dilación de la justicia, podrá dictar una orden para autorizar la toma de las deposiciones y podrá dictar órdenes similares a las que disponen las Reglas 31 y 32, y desde entonces, estas deposiciones podrán ser tomadas y usadas del mismo modo y bajo las mismas condiciones dispuestas en estas reglas para deposiciones en pleitos pendientes.

What this rule doesQué hace esta regla

The gap this fills is real. Once judgment is entered the case is over in the trial court, but if the appeal succeeds there may be a new trial — and by then a witness may be gone.

So the court that rendered the judgment may allow depositions to perpetuate testimony for use in the event of further proceedings in that court. The window opens after an appeal is taken and also before, while the time to appeal has not expired.

The motion is filed in that court, on the same notice and service as if the action were still pending there, and must show two things: the names and addresses of the persons to be examined with the substance of the expected testimony, and the reasons for perpetuating it.

The finding required is that perpetuation is necessary to avoid a failure or delay of justice. On that finding the court may issue Rule 31 and Rule 32 orders, and the depositions are taken and used under the same conditions as depositions in a pending action.

La brecha que llena es real. Dictada la sentencia el caso terminó en el tribunal de instancia, pero si la apelación prospera puede haber un juicio nuevo, y para entonces un testigo puede no estar.

Por eso el tribunal que dictó la sentencia puede permitir deposiciones para perpetuar testimonio para usarlo si hay procedimientos ulteriores ante él. La ventana se abre tras presentarse la apelación y también antes, mientras el término no haya vencido.

La moción se presenta ante ese tribunal, con la misma notificación y diligenciamiento que si el pleito siguiera pendiente, y debe demostrar dos cosas: los nombres y direcciones de quienes serán examinados con la sustancia del testimonio esperado, y las razones para perpetuarlo.

La determinación exigida es que la perpetuación sea necesaria para evitar un fracaso o una dilación de la justicia. Sobre esa base el tribunal puede emitir órdenes de las Reglas 31 y 32, y las deposiciones se toman y usan en las mismas condiciones que las de un pleito pendiente.
