What this rule doesQué hace esta regla

One sentence, and it decides more than any other sentence of comparable length in these rules. Filing is the event that starts the case.

The reason to care is the limitations period. A claim is brought when the complaint reaches the clerk, so a complaint filed on the last day is timely even though the defendant learns of it weeks later. Service has its own clock — Rule 4.3(c) gives 120 days — and missing that clock costs the case in a different way, by dismissal without prejudice the first time and with prejudice the second.

Keep the two apart. Filing stops the prescriptive term. Service starts the defendant’s time to answer and is what gives the court power over that defendant. A case can be timely filed and still die for want of service.

Importa por el término prescriptivo. La reclamación se interpone cuando la demanda llega a la secretaría, de modo que una demanda presentada el último día es oportuna aunque la parte demandada se entere semanas después. El emplazamiento corre por su cuenta —la Regla 4.3(c) concede 120 días— y fallar ahí cuesta el caso de otra manera: desestimación sin perjuicio la primera vez, y con perjuicio la segunda.

Mantenga separados los dos momentos. La presentación interrumpe la prescripción. El emplazamiento echa a andar el término para contestar y es lo que le da al tribunal autoridad sobre esa parte. Un pleito puede presentarse a tiempo y morir por falta de emplazamiento.

Can parties skip pleadings entirely?¿Pueden las partes prescindir de las alegaciones?
For a genuine dispute they can use Rule 5.2 and file a stipulation of facts with an affidavit instead of pleadings.
