These rules shall govern the procedure in all suits of a civil nature in the General Court of Justice. They shall be construed so as to facilitate access and case management and to secure the just, speedy, and inexpensive determination of every action.
Estas reglas regirán todos los procedimientos de naturaleza civil ante el Tribunal General de Justicia. Se interpretarán de modo que faciliten el acceso a los tribunales y el manejo del proceso, de forma que garanticen una solución justa, rápida y económica de todo procedimiento.

What this rule doesQué hace esta regla

Rule 1 does two jobs in two sentences. First it sets the reach of the rules: every suit of a civil nature in the General Court of Justice. Second it tells judges how to read the rest of them.

That second sentence matters more than it looks. When a rule is ambiguous, or when following its letter would keep a case from being heard, Rule 1 is the argument for the reading that gets to the merits. Puerto Rico names four goals: access to the courts, case management, and a determination that is just, speedy and inexpensive. Access and management are not in the federal analogue, and they give the rule a practical edge — a judge managing a crowded docket is doing what Rule 1 asks.

It is a rule of construction, not a source of power. It will not excuse a missed deadline the rules make non-extendable, and it does not let a court invent procedure the rules withhold. What it does is settle close questions in favour of deciding the case.

La Regla 1 hace dos cosas en dos oraciones. Primero fija el alcance: todo procedimiento de naturaleza civil ante el Tribunal General de Justicia. Después le dice al tribunal cómo leer las demás reglas.

Esa segunda oración pesa más de lo que aparenta. Cuando una regla es ambigua, o cuando seguir su letra impediría que el caso se atienda, la Regla 1 es el argumento a favor de la lectura que llega al fondo. Puerto Rico nombra cuatro objetivos: el acceso a los tribunales, el manejo del proceso, y una solución justa, rápida y económica. El acceso y el manejo no aparecen en la regla federal equivalente, y le dan filo práctico: un juez que administra un calendario cargado hace lo que la Regla 1 le pide.

Es una regla de interpretación, no una fuente de poder. No excusa un término que las reglas declaran improrrogable, ni permite inventar un procedimiento que las reglas no conceden. Lo que hace es resolver las dudas a favor de decidir el caso.

The Supreme Court adopted them by resolution in 2009 under the Constitution, and the Legislative Assembly enacted them with amendments by Law No. 220-2009.
