When there is a controversy that may give rise to a suit, the parties, without having to file pleadings, may file with the court a stipulation of facts together with an affidavit stating that there exists a real and effective controversy between the parties and that the stipulation is filed in good faith so that the court may determine the rights of the parties. If the court determines that such a controversy exists, the proceedings shall be governed by these rules.
Cuando exista una controversia que pueda dar lugar a un pleito, las partes, sin necesidad de presentar sus alegaciones, podrán presentar al tribunal una estipulación de hechos acompañada de una declaración jurada, acreditativa de que existe una controversia real y efectiva entre ellas y de que dicha estipulación se presenta de buena fe para que el tribunal determine los derechos de las partes. Si el tribunal determina que existe dicha controversia, los procedimientos se regirán por estas reglas.
What this rule doesQué hace esta regla
This is the shortest route to a decision the rules offer, and it is easy to forget it exists. Where a controversy could give rise to a suit, the parties file a stipulation of facts together with an affidavit stating two things: that the controversy is real and effective, and that the filing is in good faith so the court may determine their rights.
The affidavit does the guarding. Courts will not answer hypothetical questions, and the sworn statement is what separates a genuine dispute from a request for an advisory opinion. If the court finds the controversy exists, the case proceeds under these rules from there.
It suits a dispute that turns entirely on law — the meaning of a contract clause, the effect of a statute on undisputed facts — where discovery would prove nothing and the parties can agree on what happened.
Es la vía más corta a una decisión que ofrecen las reglas, y es fácil olvidar que existe. Cuando hay una controversia que pueda dar lugar a un pleito, las partes presentan una estipulación de hechos junto a una declaración jurada que afirme dos cosas: que la controversia es real y efectiva, y que se presenta de buena fe para que el tribunal determine sus derechos.
La declaración jurada es la salvaguarda. Los tribunales no contestan preguntas hipotéticas, y el juramento separa la disputa genuina de una opinión consultiva. Si el tribunal concluye que la controversia existe, el procedimiento sigue bajo estas reglas.
Conviene a la disputa que descansa por entero en el derecho —el sentido de una cláusula, el efecto de una ley sobre hechos incontrovertidos— donde el descubrimiento no probaría nada y las partes pueden acordar lo ocurrido.
