(a)Immediately upon the filing in the record of a copy of the notice of entry of an order, resolution or judgment, the clerk shall serve notice thereof on the same date upon all party who may have appeared in the action in the manner provided by Rule 67. Such mailing shall be sufficient notice for all purposes for which notice of the entry of an order, resolution or judgment is required by these rules.
(b)The clerk shall serve all orders, resolutions or judgments that, according to their terms, must be served on the parties who appeared in the action, at the last address set forth in the record by a self-represented party or at the address of the attorney as it appears in the roll of attorneys kept by the Supreme Court for purposes of receiving such notices in compliance with Rule 9.
(c)In the case of parties of record that are in default, the Clerk shall mail the notice of the entry of any order, decree, or judgment to the last known address that appears on record as provided by the party appearing pro se or to the address that arises from the register of the Supreme Court provided by the lawyer to receive summons pursuant to Rule 9. In the case of parties in default that have been served by publication but have never appeared on record or in the case of unknown defendants, the Clerk shall notify the entry of judgment through a notice to be published by the plaintiff. The notice shall state that it shall be published once in a newspaper of general circulation in Puerto Rico within ten (10) days after the notification thereof and shall inform the defendant of the judgment entered and of the time for appeal. A copy of the notice of entry of judgment so published shall be served on the defendant by certified mail return receipt requested to his [or her] last known address within ten (10) days after the notice is published. All terms shall begin to count as of the date the notice was published, which shall be confirmed through an affidavit of the administrator or authorized agent of the newspaper together with a copy of the notice.10
(d)The legal notice shall contain the following information:
(1)Title (“Notice of Service by Publication”)
(2)Part of the Court of First Instance
(3)Case number
(4)Name of the plaintiff
(5)Name of the defendant to be served
(6)Nature of the claim
(7)Date of issuance
(8)Time within which the person thus served must seek review of or take appeal from the judgment before it becomes final and unappealable.
(e)The clerk shall set forth on the copy of the proof of service that shall be attached to the original record the date and manner of service and the person or persons served.
Where the notice is served personally, there shall be attached to the record the marshal’s return or that of the employee of the court serving such notice, or the affidavit of a private person verifying the service.
(f)Any party may acknowledge service of notice of any order, resolution or judgment by signing the original document and entering the date of such acknowledgment.

(c) En el caso de partes en rebeldía que hayan comparecido en autos, el Secretario o Secretaria le notificará toda orden, resolución o sentencia a la última dirección que se haya consignado en el expediente por la parte que se autorepresenta o a la dirección del abogado o abogada que surge del registro del Tribunal Supremo para recibir notificaciones, en cumplimiento con la Regla 9. En el caso de partes en rebeldía que fueron emplazadas personalmente y nunca comparecieron, se le notificará la sentencia a la última dirección conocida. En caso de desconocer la última dirección, se procederá a notificar la sentencia por edicto, de la misma forma como si la persona hubiera sido emplazada por edicto, según se describe a continuación. En el caso de partes en rebeldía que hayan sido emplazadas por edicto y que nunca hayan comparecido en autos o de partes demandadas desconocidas, el Secretario o Secretaria expedirá un aviso de notificación de sentencia por edictos para su publicación por la parte demandante. El aviso dispondrá que éste, debe publicarse una sola vez en un periódico de circulación general en la Isla de Puerto Rico dentro de los diez (10) días siguientes a su notificación e informará a la parte demandada de la sentencia dictada y del término para apelar. Copia del aviso de notificación de sentencia publicado será notificada a la parte demandada por correo certificado con acuse de recibo dentro del término de diez (10) días luego de la publicación del edicto a la última dirección conocida del demandado. Todos los términos comenzarán a computarse a partir de la fecha de la publicación del edicto, la cual deberá acreditarse mediante una declaración jurada del (de la) administrador(a) o agente autorizado(a) del periódico, acompañada de un ejemplar del edicto publicado.
(d)El contenido del edicto deberá contar con la información siguiente:
(1)Título (“Notificación mediante Edicto”)
(2)Sala del Tribunal de Primera Instancia
(3)Número del caso
(4)Nombre de la parte demandante
(5)Nombre de la parte demandada a ser notificada
(6)Naturaleza de la reclamación
(7)Fecha de expedición
(8)Término dentro del cual la persona así notificada tiene que revisar o apelar de la sentencia antes de que ésta advenga final y firme.
(e)El Secretario o la Secretaria hará constar en la copia de la constancia de la notificación que una a los autos originales la fecha y la forma en que fue efectuada la notificación y la persona o las personas notificadas.
Si la notificación se diligencia personalmente, entonces deberá unirse a los autos la certificación del alguacil o de la alguacila, o del empleado o empleada del tribunal que hizo la notificación o la declaración jurada de la persona particular que acredite la diligencia.
(f)Cualquier parte podrá darse por notificada de cualquier orden, resolución o sentencia firmando en el original del documento y haciendo constar la fecha en que se ha dado por notificado.

What this rule doesQué hace esta regla

This is the rule appeal deadlines depend on. Rule 52.2 counts terms from the entry in the record of a copy of the notice of judgment; Rule 65.3 is what produces that notice.

(a) Same-day service. Immediately upon the filing in the record of a copy of the notice of entry of an order, resolution or judgment, the clerk serves notice on the same date upon all parties who appeared, in the manner provided by Rule 67. That mailing is sufficient notice for all purposes for which these rules require notice of the entry.

(b) Where it goes. To the last address in the record given by a self-represented party, or to the attorney’s address in the roll of attorneys kept by the Supreme Court for receiving notices under Rule 9. Keeping that roll current is not a formality — it is the address the court will use.

(c) Parties in default. A defaulting party who is on the record is served the same way, at the address of record or the roll. Where a defaulting party was served by publication and never appeared, or the defendant is unknown, the clerk issues a notice of the judgment for publication by the plaintiff: published once in a newspaper of general circulation in Puerto Rico within ten days, informing the defendant of the judgment and the time to appeal. A copy of the published notice is then sent by certified mail, return receipt requested, to the last known address within ten days after publication. All terms begin to run from the date of publication, proven by an affidavit from the newspaper’s manager or authorized agent with a copy of the notice.

What the current Spanish adds to (c). Law No. 44 of 2023 amended this subdivision after the English compilation was prepared. The Spanish text in force covers a case the English does not: a defaulting party who was personally served but never appeared is notified of the judgment at the last known address — and if that address is unknown, the judgment is served by publication, exactly as though the person had been served by publication.

(d) What the published notice must say. Eight items: the title "Notice of Service by Publication", the part of the Court of First Instance, the case number, the plaintiff’s name, the name of the defendant being served, the nature of the claim, the date of issuance, and the time within which the person must seek review or appeal before the judgment becomes final and unappealable.

(e)–(f) Proof, and acknowledgment. The clerk records the date and manner of service and who was served on the copy attached to the original record. Personal service is proven by the marshal’s or court employee’s return, or a private person’s affidavit. And any party may acknowledge service by signing the original document and entering the date.

Esta es la regla de la que dependen los términos de apelación. La Regla 52.2 cuenta desde el archivo en autos de copia de la notificación de la sentencia; la Regla 65.3 es lo que produce esa notificación.

(a) Notificación el mismo día. Inmediatamente después de archivarse en autos copia de la notificación del registro de una orden, resolución o sentencia, la secretaría notifica en la misma fecha a todas las partes que hayan comparecido, en la forma preceptuada en la Regla 67. El depósito en el correo es aviso suficiente a todos los fines para los que estas reglas requieran esa notificación.

(b) A dónde va. A la última dirección consignada en el expediente por la parte que se autorrepresenta, o a la dirección del abogado o abogada que surge del registro del Tribunal Supremo para recibir notificaciones, en cumplimiento con la Regla 9. Mantener ese registro al día no es formalidad: es la dirección que el tribunal usará.

(c) Partes en rebeldía. A la parte en rebeldía que haya comparecido en autos se le notifica igual, a la dirección del expediente o del registro. Cuando la parte en rebeldía fue emplazada por edicto y nunca compareció, o se trata de partes demandadas desconocidas, la secretaría expide un aviso de notificación de sentencia para su publicación por la parte demandante: se publica una sola vez en un periódico de circulación general dentro de los diez días siguientes, informando de la sentencia y del término para apelar. Copia del aviso publicado se envía por correo certificado con acuse de recibo a la última dirección conocida dentro de diez días de la publicación. Todos los términos se computan desde la fecha de publicación, acreditada con declaración jurada del administrador o agente autorizado del periódico y un ejemplar del edicto.

Lo que el texto vigente añade al inciso (c). La Ley Núm. 44 de 2023 lo enmendó después de prepararse la compilación en inglés. El español vigente cubre un caso que el inglés no: a la parte en rebeldía que fue emplazada personalmente y nunca compareció se le notifica la sentencia a la última dirección conocida, y si esa dirección se desconoce, se notifica por edicto, igual que si hubiera sido emplazada por edicto.

(d) Qué debe decir el edicto. Ocho datos: el título "Notificación mediante Edicto", la sala del Tribunal de Primera Instancia, el número del caso, el nombre de la parte demandante, el de la parte demandada a notificar, la naturaleza de la reclamación, la fecha de expedición y el término dentro del cual esa persona tiene que revisar o apelar antes de que la sentencia advenga final y firme.

(e)–(f) Constancia y darse por notificado. La secretaría hace constar la fecha y la forma de la notificación y a quiénes se notificó en la copia que une a los autos originales. La notificación personal se acredita con la certificación del alguacil o del empleado del tribunal, o la declaración jurada de la persona particular. Y cualquier parte puede darse por notificada firmando en el original y consignando la fecha.
