(a)The party causing the physical and mental examination to be made shall deliver to the person examined, within forty-five (45) days from the date of examination, a copy of the detailed written report of the examiner setting out the examiner’s findings. After delivery, the party causing the examination to be made shall be entitled to receive from the party who was examined a like report of any examination, previously or thereafter made, of the same physical or mental condition. If the party examined refuses to deliver said report, the court, on motion duly served, may make an order requiring delivery of the report on such terms as are just. If the professional authorized by law to perform the examination fails or refuses to make a report, the court may exclude the examiner’s testimony if offered at trial.
(b)By obtaining a report of the examination so ordered or by taking the deposition of the examiner, the party examined waives any privilege the party may have in that action or any other involving the same controversy, regarding the testimony of every other person who has examined or may thereafter examine the party in respect of the same mental or physical condition.
(a)La parte a cuya instancia se hizo el examen físico y mental le entregará a la parte examinada una copia de un informe del examinador o de la examinadora, por escrito y detallado, haciendo constar sus determinaciones en un plazo no mayor de cuarenta y cinco (45) días de la fecha del examen o prueba. Después de tal entrega, la parte a cuya instancia se hizo el examen tendrá derecho a recibir de la parte examinada un informe similar de cualquier examen del mismo estado mental o físico, efectuado anterior o posteriormente que existiese. Si la parte examinada rehúsa entregar dicho informe, el tribunal, mediante moción debidamente notificada, podrá dictar una orden exigiendo que se haga dicha entrega bajo aquellas condiciones que sean justas. Si el profesional autorizado o la profesional autorizada por ley que efectuó el examen deja de o se niega a rendir tal informe, el tribunal podrá excluir su testimonio si éste es ofrecido en el juicio.
(b)Al obtener un informe del examen así ordenado o al tomar una deposición del examinador o de la examinadora, la parte examinada renuncia a cualquier privilegio que pueda tener en ese pleito o en cualquiera otro que involucre la misma controversia, con relación al testimonio de toda otra persona que le haya examinado o pueda examinarle en el futuro sobre el mismo estado mental o físico.

(a) The exchange. The party who caused the examination delivers to the person examined, within forty-five (45) days of the examination, a copy of the examiner’s detailed written report of findings. After delivering, that party becomes entitled to a like report of any examination of the same condition, previously or thereafter made, from the party who was examined.
Note the sequence: delivery first, entitlement second. The examining party cannot demand the other side’s reports before handing over its own.
Two enforcement provisions follow. If the examined party refuses to deliver, the court on a duly served motion may order delivery on just terms. If the professional fails or refuses to make a report, the court may exclude that examiner’s testimony if offered at trial — a sanction aimed at the expert rather than the party.
(b) The waiver. By obtaining a report of the ordered examination or by deposing the examiner, the party examined waives any privilege it may have — in that action or any other involving the same controversy — regarding the testimony of every other person who has examined or may later examine that party about the same condition. That is a wide waiver, and it is triggered by an act the examined party chooses to take.
(a) El intercambio. La parte que causó el examen entrega a la persona examinada, dentro de cuarenta y cinco (45) días del examen, copia del informe escrito detallado con los hallazgos. Tras entregarlo, esa parte queda facultada a recibir un informe igual de cualquier examen de la misma condición, anterior o posterior, de la parte examinada.
Note la secuencia: primero la entrega, después el derecho. Quien examina no puede exigir los informes ajenos antes de entregar el suyo.
Siguen dos disposiciones de cumplimiento. Si la parte examinada se niega a entregar, el tribunal, mediante moción debidamente notificada, puede ordenarlo en términos justos. Si el profesional no hace o rehúsa hacer el informe, el tribunal puede excluir su testimonio si se ofrece en el juicio: una sanción dirigida al perito y no a la parte.
(b) La renuncia. Al obtener el informe del examen ordenado o al deponer a quien examinó, la parte examinada renuncia a todo privilegio que pudiera tener —en ese pleito o en cualquier otro sobre la misma controversia— respecto del testimonio de toda otra persona que le haya examinado o le examine después sobre la misma condición. Es una renuncia amplia, y la activa un acto que la parte examinada escoge realizar.
