(a)The General Court of Justice shall have jurisdiction:
(1)over every matter, case or controversy arising within the territorial limits of the Commonwealth of Puerto Rico, and
(2)over persons domiciled in this jurisdiction and over non-domiciled persons who have any contact with the jurisdiction that is consistent with the applicable constitutional provisions.
(b)The court shall have power to entertain voluntary jurisdiction proceedings. A voluntary jurisdiction proceeding may be filed in the court for the purpose of establishing and perpetuating a fact that is not an issue in any legal action at that time and is not injurious to a certain and determinate person.
(a)El Tribunal General de Justicia tendrá jurisdicción:
(1)sobre todo asunto, todo caso o toda controversia que surja dentro de la demarcación territorial del Estado Libre Asociado de Puerto Rico, y
(2)sobre las personas domiciliadas y las no domiciliadas que tengan cualquier contacto que haga compatible la jurisdicción con las disposiciones constitucionales aplicables.
(b)El tribunal tendrá facultad para conocer de los procedimientos de jurisdicción voluntaria. Se podrá acudir al tribunal con un recurso de jurisdicción voluntaria con el fin de consignar y perpetuar un hecho que no sea objeto de una controversia judicial en ese momento y que no pueda resultar en perjuicio de una persona cierta y determinada.

What this rule doesQué hace esta regla

Subdivision (a) states the reach of the General Court of Justice in two clauses. The first is territorial: every matter, case or controversy arising within Puerto Rico. The second is personal, and it is written as a long-arm provision that goes as far as the Constitution permits — any contact consistent with the applicable constitutional provisions.

That phrasing is deliberate. Rather than list the acts that create jurisdiction, as many long-arm statutes do, Puerto Rico ties its reach directly to the constitutional limit. The practical question is therefore the familiar due-process one: did the defendant do something that makes it fair to answer here?

Subdivision (b) adds a separate power that has no federal counterpart in the civil rules — voluntary jurisdiction. A person may come to court to establish and perpetuate a fact, with no adversary and no dispute, provided the fact is not then in litigation and nobody identifiable is hurt by it. It is the vehicle for a whole class of civil-law proceedings that a common-law lawyer would not expect to find in a code of civil procedure.

El inciso (a) fija el alcance del Tribunal General de Justicia en dos cláusulas. La primera es territorial: todo asunto, caso o controversia que surja dentro de Puerto Rico. La segunda es personal, y está redactada como una disposición de largo alcance que llega hasta donde la Constitución lo permita: cualquier contacto compatible con las disposiciones constitucionales aplicables.

Esa redacción es deliberada. En lugar de enumerar los actos que crean jurisdicción, como hacen muchas leyes de largo alcance, Puerto Rico ata su alcance directamente al límite constitucional. La pregunta práctica es entonces la del debido proceso: ¿hizo la parte demandada algo que haga justo que responda aquí?

El inciso (b) añade una facultad que no tiene equivalente federal en lo civil: la jurisdicción voluntaria. Una persona puede acudir al tribunal para consignar y perpetuar un hecho, sin parte contraria y sin controversia, siempre que el hecho no esté entonces en litigio y no perjudique a persona cierta y determinada. Es el vehículo de toda una clase de procedimientos civilistas.
