Every action shall be filed in the corresponding division or part of the court, as provided by law and by these rules, but no case will be dismissed for having been wrongly laid in a court without proper venue.
Every case shall be heard in the division or part of the court in which it was filed by agreement of the parties and with the grounded consent of the judge presiding over that division or part. Otherwise, it shall be transferred to the proper part of the court by order of the judge.
Todo pleito se presentará en la sala que corresponda según lo dispuesto por ley y por estas reglas, pero no se desestimará ningún caso por haberse sometido a una sala sin competencia.
Todo pleito se tramitará en la sala en que se presente por convenio de las partes y la anuencia fundamentada del juez que presida dicha sala en ese momento. De lo contrario, se transferirá por orden del juez o la jueza a la sala correspondiente.

What this rule doesQué hace esta regla

The first sentence carries the whole point. Every action goes in the corresponding division or part of the court, but no case will be dismissed for having been wrongly laid. Venue in Puerto Rico is a question of housekeeping, not of survival.

The second paragraph explains how a case stays where it was filed even when that part is not the proper one: the parties agree, and the judge presiding over that part consents on stated grounds. Absent both, the judge orders it transferred.

For a litigant the practical reading is simple. Choosing the wrong part costs time and possibly a motion, never the claim. And because a defendant who wants the case moved must act within the thirty days Rule 3.6(a) allows, the party more likely to be hurt by inattention here is the defendant, not the plaintiff.

La primera oración contiene todo el asunto. Todo pleito se presenta en la sala correspondiente, pero ningún caso se desestimará por haberse presentado sin competencia. La competencia en Puerto Rico es cuestión de orden, no de supervivencia.

El segundo párrafo explica cómo un caso permanece donde se presentó aunque esa no sea la sala correcta: las partes lo acuerdan y el juez que preside consiente con fundamento. Si falta cualquiera de las dos cosas, el juez ordena el traslado.

Para el litigante la lectura práctica es sencilla. Equivocarse de sala cuesta tiempo y quizá una moción, nunca la reclamación. Y como la parte demandada que quiere mover el caso debe actuar dentro de los treinta días de la Regla 3.6(a), quien más arriesga con el descuido aquí es ella, no la demandante.
