(a)A defense of lack of jurisdiction over the person, insufficiency of process, or insufficiency of service of process is waived:
(1)if omitted from a motion for consolidation of defenses under Rule 10.7, or
(2)if it is neither made by motion under Rule 10 nor included in a responsive pleading or in an amendment thereof not requiring permission of the court, as provided by Rule 13.1.
(b)A defense of failure to state a claim upon which relief can be granted, a defense of failure to join an party indispensable under Rule 16, and an objection of failure to state a legal defense to a claim may be made in any pleading permitted or ordered under Rule 5.1, or by motion for judgment on the pleadings, or at the trial on the merits.
(c)Whenever it appears by suggestion of the parties or otherwise that the court lacks jurisdiction of the subject matter, the court shall dismiss the action.
(a)La defensa de falta de jurisdicción sobre la persona, insuficiencia del emplazamiento o insuficiencia del diligenciamiento del emplazamiento se entenderá renunciada:
(1)si no se incluye en una moción de acumulación de defensas bajo la Regla 10.7, o
(2)si no es formulada mediante una moción como se dispone en esta Regla 10 ni se incluye en una alegación responsiva o mediante una enmienda que no requiera permiso del tribunal, conforme lo dispuesto por la Regla 13.1.
(b)La defensa de haber dejado de exponer una reclamación que justifique la concesión de un remedio, la defensa de haber omitido acumular una parte indispensable como se dispone en la Regla 16 y la objeción de haber omitido exponer una defensa legal a una reclamación, pueden hacerse mediante cualquier alegación permitida u ordenada según lo dispuesto en la Regla 5.1, mediante una moción para que se dicte sentencia por las alegaciones o en el juicio.
(c)Siempre que surja, por indicación de las partes o de algún otro modo, que el tribunal carece de jurisdicción sobre la materia, éste desestimará el pleito.

What this rule doesQué hace esta regla

This rule sorts the Rule 10.2 defences into three groups, and knowing which is which is most of what a defendant needs from Chapter III.

Lost by silence (a). Lack of jurisdiction over the person, insufficiency of process, and insufficiency of service of process are waived if omitted from a Rule 10.7 consolidated motion, or if neither made by a Rule 10 motion nor included in the responsive pleading or an amendment to it that does not require the court’s permission under Rule 13.1. Note the second route: you can still add these by amending as of right.

Preserved (b). Failure to state a claim upon which relief can be granted, failure to join an indispensable party under Rule 16, and an objection that a claim states no legal defence may be made in any pleading permitted or ordered under Rule 5.1, by motion for judgment on the pleadings, or at the trial on the merits.

Never lost (c). Whenever it appears — by suggestion of the parties or otherwise — that the court lacks jurisdiction over the subject matter, the court shall dismiss the action. Not may; shall. No motion is needed and no stage of the case is too late.

Esta regla clasifica las defensas de la Regla 10.2 en tres grupos, y saber cuál es cuál es casi todo lo que una parte demandada necesita del Capítulo III.

Se pierden por silencio (a). La falta de jurisdicción sobre la persona, la insuficiencia del emplazamiento y la del diligenciamiento se renuncian si se omiten de una moción consolidada bajo la Regla 10.7, o si no se hacen por moción bajo la Regla 10 ni se incluyen en la alegación responsiva o en una enmienda que no requiera permiso del tribunal bajo la Regla 13.1. Fíjese en la segunda vía: todavía puede añadirlas enmendando de derecho.

Se preservan (b). Dejar de exponer una reclamación que justifique la concesión de un remedio, dejar de acumular una parte indispensable bajo la Regla 16, y la objeción de que una reclamación no expone una defensa legal pueden hacerse en cualquier alegación permitida u ordenada bajo la Regla 5.1, por moción de sentencia por las alegaciones, o en el juicio en su fondo.

Nunca se pierde (c). Siempre que aparezca —por señalamiento de las partes o de otro modo— que el tribunal carece de jurisdicción sobre la materia, desestimará el pleito. No “podrá”: desestimará. No hace falta moción y ninguna etapa es demasiado tarde.
