The pleadings, motions, and other documents contemplated in these Rules shall be filed with the courts through electronic means, upon the implementation of the necessary administrative measures and technology. Likewise, the service of any orders, resolutions, interlocutory remedies, and judgments issued by the court shall be made by electronic means as well as any other document that the Court Clerk shall serve in a civil proceeding.
The electronic delivery to the address or website established by the Chief Justice of the Supreme Court of Puerto Rico for each Office of the Clerk of the General Court of Justice shall constitute the filing of said documents with the court and the Office of the Clerk referred to in these Rules. The electronic filing of a document shall constitute, in turn, the service of notice that should be made between attorneys, and unrepresented parties, as required by these Rules. In these cases, an electronic signature shall constitute the signature required under these Rules, and shall have the same legal validity as a handwritten one.
Service of summons and subpoenas, however, shall not be made by electronic means, but rather shall be carried out in accordance with Rules 4 and 40. Likewise, the terms shall be calculated pursuant to Rule 68.
The Chief Justice of the Supreme Court of Puerto Rico shall take administrative measures as necessary to comply with the provisions herein, including, but not limited to establishing the security parameters necessary to manage confidential or sensitive information, guarantee information integrity, as well as those measures geared to guaranteeing access thereto to low-income persons.
Las alegaciones, mociones y demás escritos que se contemplan en estas Reglas se presentarán al tribunal por medios electrónicos, una vez se implanten las medidas administrativas y la tecnología necesaria para ello. Asimismo, se notificarán por medios electrónicos las órdenes, resoluciones, providencias interlocutorias y sentencias que emita el tribunal, al igual que cualquier otro documento que el Secretario o la Secretaria deba notificar durante un procedimiento civil.
El envío electrónico a la dirección o portal establecido por el Juez Presidente del Tribunal Supremo de Puerto Rico para cada Secretaría del Tribunal General de Justicia constituirá la presentación de escritos en el tribunal y en la Secretaría a la que se refiere estas Reglas. La presentación electrónica del escrito constituirá, a su vez, la notificación que debe efectuarse entre abogados, abogadas y partes que se autorrepresentan, según exigen estas Reglas. En estos casos, se entenderá que una firma electrónica constituirá el requisito de firma que exigen estas Reglas y tendrá la misma validez legal que la manuscrita o de puño y letra.
No obstante, el diligenciamiento de citaciones o emplazamientos no podrá realizarse por medios electrónicos, y deberá efectuarse de conformidad con las Reglas 4 y 40. Asimismo, los términos se computarán de conformidad con la Regla 68.
El Juez Presidente del Tribunal Supremo de Puerto Rico tomará aquellas medidas administrativas necesarias para dar cumplimiento a lo aquí dispuesto, incluyendo pero sin limitarse a, establecer los parámetros de seguridad necesarios para el manejo de información confidencial o sensitiva, para garantizar la integridad de la información y aquellas medidas dirigidas a garantizar el acceso a las personas de escasos recursos económicos.

What this rule doesQué hace esta regla

The mandate. Pleadings, motions and other documents shall be filed through electronic means, upon the implementation of the necessary administrative measures and technology. Likewise, service of orders, resolutions, interlocutory remedies and judgments issued by the court is made electronically, along with any other document the clerk serves in a civil proceeding.

What the electronic delivery accomplishes. Delivery to the address or website the Chief Justice establishes for each clerk’s office constitutes the filing of those documents with the court and the clerk. And the electronic filing constitutes, in turn, the service of notice between attorneys and unrepresented parties that these rules require. One act does both jobs.

Electronic signatures. An electronic signature constitutes the signature required under these rules and has the same legal validity as a handwritten one.

The exclusion. Service of summons and subpoenas shall not be made by electronic means, but under Rules 4 and 40. The documents that bring a person into a case, or compel their appearance, keep their older formality. Terms continue to be computed under Rule 68.

Implementation, with a named concern. The Chief Justice takes the necessary administrative measures, including establishing the security parameters needed to manage confidential or sensitive information and guarantee information integrity, and measures geared to guaranteeing access to low-income persons. The rule anticipates that moving a court online can shut people out, and says so.

El mandato. Las alegaciones, mociones y demás documentos se presentarán por medios electrónicos, una vez implantadas las medidas administrativas y la tecnología necesarias. Igualmente se notificarán electrónicamente las órdenes, resoluciones, remedios interlocutorios y sentencias del tribunal, y cualquier otro documento que la secretaría notifique en un procedimiento civil.

Qué logra la entrega electrónica. La entrega a la dirección o el portal que el Juez Presidente establezca para cada secretaría constituye la presentación de esos documentos ante el tribunal y la secretaría. Y la presentación electrónica constituye, a su vez, la notificación entre abogados y partes sin representación que estas reglas exigen. Un solo acto hace las dos cosas.

Firmas electrónicas. La firma electrónica constituye la firma requerida por estas reglas y tiene la misma validez legal que la manuscrita.

La exclusión. Los emplazamientos y las citaciones no se diligenciarán por medios electrónicos, sino conforme a las Reglas 4 y 40. Los documentos que traen a una persona al caso, o que la obligan a comparecer, conservan su formalidad antigua. Los términos se siguen computando conforme a la Regla 68.

Implantación, con una preocupación nombrada. El Juez Presidente toma las medidas administrativas necesarias, incluidos los parámetros de seguridad para manejar información confidencial o sensitiva y garantizar su integridad, y las medidas dirigidas a garantizar el acceso a las personas de escasos recursos.
