Two rules: when a judge must step aside, and how to make it happen.

Rule 63.1 sets out ten circumstances — bias, personal or financial interest, close family relationship, a compromising friendship, prior service as counsel or prosecutor, prior judicial involvement below, an irregular loan, prior government service on the matter, a recent attorney-client relationship with one of the lawyers, and a catch-all for anything else that casts reasonable doubt on impartiality.

Rule 63.2 requires a verified motion within twenty days of learning the ground, filed with the recused judge, and sets out what happens whether the judge agrees or not.

The tenth ground names two harms, not one: doubt about the judge’s ability to decide impartially, and anything that tends to undermine public confidence in the administration of justice. Appearance matters on its own.

La Regla 63.1 expone diez circunstancias: prejuicio, interés personal o económico, parentesco cercano, una amistad comprometedora, haber sido abogado o fiscal en el asunto, haber intervenido antes judicialmente, un préstamo irregular, servicio gubernamental previo en la materia, una relación reciente de abogado-cliente con uno de los letrados y una cláusula residual para cualquier otra cosa que arroje duda razonable sobre la imparcialidad.

La Regla 63.2 exige una moción jurada dentro de veinte días de conocerse el motivo, presentada ante el juez recusado, y expone qué ocurre esté o no de acuerdo.

El décimo motivo nombra dos daños, no uno: la duda sobre la capacidad del juez para decidir imparcialmente y todo lo que tienda a socavar la confianza pública en la administración de la justicia. La apariencia cuenta por sí sola.
