A judge, whether on his or her own initiative or on motion of a party, shall disqualify himself or herself from an action or proceeding in any of the following circumstances:
(a)when the judge has bias against or is partial to any of the parties to the action or their attorneys, or has prejudged the case;
(b)when the judge has a personal or financial interest in the outcome of the case;
(c)when the judge is related by consanguinity or affinity within the fourth degree to the prosecutor, family advocate, guardian ad litem, advocate for minors’ affairs, or any of the parties or their attorneys in a civil proceeding;
(d)when the judge’s friendship with any of the parties, their attorneys, the witnesses, or any other person involved in the action is such that it may defeat the ends of justice;
(e)when the judge has served as attorney or counsel for any of the parties or their attorneys in the matter at issue, or as prosecuting attorney in an investigation or a criminal proceeding in which the events were the same as those of the case under submission;
(f)when the judge previously presided over the trial in the same case in a lower court, or was the judge who issued the warrant for arrest or the summons for the purpose of finding probable cause at the preliminary hearing in a criminal proceeding;
(g)when a natural or artificial person in the case has furnished or arranged for the judge to obtain a loan in which the usual guarantees or conditions were not met;
(h)when the judge has served in governmental employment and in such capacity participated as counsel, advisor, or material witness in the matter in controversy;
(i)when one of the parties’ attorneys is or has served during the last three years as an attorney for the judge who is to adjudicate the controversy before the court; or
(j)when there is any other reason that may reasonably cast doubt upon the judge’s ability to decide the matter impartially or which tends to undermine public confidence in the administration of justice.
Por iniciativa propia, o a recusación de parte, un juez o una jueza se deberá inhibir de actuar en un pleito o procedimiento en cualquiera de los casos siguientes:
(a)por tener prejuicio o parcialidad hacia cualquiera de las personas o los abogados o abogadas que intervengan en el pleito, o por haber prejuzgado el caso;
(b)por tener interés personal o económico en el resultado del caso;
(c)por existir un parentesco de consanguinidad o afinidad dentro del cuarto grado con el o la fiscal, procurador o procuradora de asuntos de familia, defensor o defensora judicial, procurador o procuradora de menores o cualquiera de las partes o sus representantes legales en un procedimiento civil;
(d)por existir una relación de amistad de tal naturaleza entre el juez y cualquiera de las partes, sus abogados, testigos u otra persona involucrada en el pleito que pueda frustrar los fines de la justicia;
(e)por haber sido abogado o abogada, o asesor o asesora de cualquiera de las partes o de sus abogados o abogadas en la materia en controversia, o fiscal en una investigación o procedimiento criminal en el que los hechos fueron los mismos presentes en el caso ante su consideración;
(f)por haber presidido el juicio del mismo caso en un tribunal inferior o por haber actuado como magistrado o magistrada a los fines de expedir una orden de arresto o citación para determinar causa probable en la vista preliminar de un procedimiento criminal;
(g)por intervenir en el procedimiento una persona natural o jurídica que le haya facilitado o gestionado algún préstamo en el que no se hayan dispensado las garantías o condiciones usuales;
(h)cuando en calidad de funcionario o funcionaria que desempeña un empleo público, haya participado como abogado o abogada, asesor o asesora, o testigo esencial del caso en controversia;
(i)cuando uno de los abogados o de las abogadas de las partes sea abogado o abogada de los jueces o juezas que han de resolver la controversia ante su consideración, o lo haya sido durante los últimos tres años, o
(j)por cualquier otra causa que pueda razonablemente arrojar dudas sobre su imparcialidad para adjudicar o que tienda a minar la confianza pública en el sistema de justicia.

What this rule doesQué hace esta regla

A judge shall disqualify himself or herself — on his or her own initiative or on motion of a party — in any of the following circumstances.

(a) Bias or prejudgment. Bias against or partiality toward any party or their attorneys, or having prejudged the case.

(b) Interest. A personal or financial interest in the outcome.

(c) Family. Related by consanguinity or affinity within the fourth degree to the prosecutor, family advocate, guardian ad litem, advocate for minors’ affairs, or any party or attorney.

(d) Friendship. Friendship with a party, an attorney, a witness, or anyone else involved such that it may defeat the ends of justice.

(e) Prior role as counsel. Having served as attorney or counsel for a party or their attorneys in the matter, or as prosecutor in an investigation or criminal proceeding on the same events.

(f) Prior judicial involvement. Having presided over the trial in the same case in a lower court, or having issued the arrest warrant or the summons for probable cause at a preliminary hearing.

(g) An irregular loan. Where a person in the case furnished or arranged a loan to the judge in which the usual guarantees or conditions were not met.

(h) Government service. Having participated, in governmental employment, as counsel, advisor, or material witness in the matter.

(i) A recent client relationship. Where one of the parties’ attorneys is, or has been during the last three years, an attorney for the judge.

(j) The catch-all. Any other reason that may reasonably cast doubt upon the judge’s ability to decide the matter impartially, or which tends to undermine public confidence in the administration of justice.

El juez o la jueza deberá inhibirsepor iniciativa propia o a moción de parte— en cualquiera de las siguientes circunstancias.

(a) Prejuicio o prejuzgamiento. Prejuicio o parcialidad hacia cualquiera de las partes o sus abogados, o haber prejuzgado el caso.

(b) Interés. Tener interés personal o económico en el resultado.

(c) Parentesco. Estar relacionado por consanguinidad o afinidad dentro del cuarto grado con el fiscal, el procurador de familia, el defensor judicial, el procurador de asuntos de menores, o cualquier parte o abogado.

(d) Amistad. Amistad con una parte, un abogado, los testigos o cualquier otra persona envuelta de tal naturaleza que pueda derrotar los fines de la justicia.

(e) Actuación previa como abogado. Haber sido abogado o asesor de una parte o de sus abogados en el asunto, o fiscal en una investigación o procedimiento criminal sobre los mismos hechos.

(f) Intervención judicial previa. Haber presidido el juicio del mismo caso en un tribunal inferior, o haber expedido la orden de arresto o la citación para determinar causa probable en la vista preliminar.

(g) Un préstamo irregular. Cuando una persona natural o jurídica del caso le facilitó o gestionó un préstamo en el que no se cumplieron las garantías o condiciones usuales.

(h) Servicio gubernamental. Haber participado, en empleo gubernamental, como abogado, asesor o testigo material en el asunto.

(i) Una relación reciente de cliente. Cuando uno de los abogados de las partes es o ha sido durante los últimos tres años abogado del juez que ha de adjudicar.

(j) La cláusula residual. Cualquier otra razón que pueda razonablemente arrojar duda sobre su capacidad para adjudicar imparcialmente o que tienda a minar la confianza pública en la administración de la justicia.
