All motions for extension of time shall make a showing of good cause based on concrete and well-grounded explanations. Any motion for extension of time shall be filed before the expiration of the term sought to be extended and as prescribed by Rule 68.2. The extended term shall start to run on the day after the expiration of the term sought to be extended.
Toda solicitud de prórroga deberá acreditar la existencia de justa causa con explicaciones concretas debidamente fundamentadas. Cualquier solicitud de prórroga deberá presentarse antes de expirar el plazo cuya prórroga se solicita y hacerse conforme lo establece la Regla 68.2. El término de la prórroga comenzará a transcurrir al día siguiente del vencimiento del plazo cuya prórroga se solicita.
What this rule doesQué hace esta regla
Three requirements, and the first is the one people miss. The motion must be filed before the term expires. A request made after the deadline is not an extension request; it is an attempt to revive something already gone, which Rule 68.2 governs on much harder terms.
Second, the showing. Good cause based on concrete and well-grounded explanations — the rule says so in as many words. "Counsel requires additional time" is not an explanation.
Third, the arithmetic. The extended term starts the day after the original term would have expired, not the day the court grants the motion. So a motion granted late does not cost the movant days, and a motion granted early does not gain any.
Tres requisitos, y el primero es el que se olvida. La moción debe presentarse antes de que venza el término. Una solicitud posterior no es una prórroga; es un intento de revivir lo ya vencido, que la Regla 68.2 rige con condiciones mucho más duras.
Segundo, la demostración. Justa causa basada en explicaciones concretas y bien fundamentadas, dice la regla con esas palabras. “La representación legal necesita más tiempo” no es una explicación.
Tercero, la aritmética. El término prorrogado comienza el día siguiente al vencimiento del término original, no el día en que el tribunal resuelve. Así, una resolución tardía no cuesta días a quien pidió, y una temprana no le regala ninguno.
