An application to the court for an order shall be by motion, which, unless made during a hearing or trial, shall be made in writing, setting forth with particularity the grounds and arguments therefor and the relief or order sought. It shall also be accompanied by any document or affidavit that may be necessary to decide the motion.
A party opposing a motion shall file a duly grounded opposition within twenty (20) days after service of the motion. The opposition shall be accompanied by any document or affidavit necessary to decide the same. If no opposition is filed within said period of twenty (20) days, the motion shall be taken under advisement.
Motions shall be taken under advisement without a hearing unless the court, on its own initiative or upon motion of a party, decides to set a hearing therefor at its discretion. This rule shall not apply to motions for which the law or these rules require that a hearing be held.
La petición para que se expida una orden se hará mediante una moción, la cual, a menos que se haga durante una vista o un juicio, se hará por escrito, haciendo constar con particularidad los fundamentos legales y argumentos en que se basa y exponiendo el remedio o la orden que se interesa. Deberá, además, estar acompañada de cualquier documento o affidávit que sea necesario para su resolución.
Cualquier parte que se oponga a una moción deberá presentar su oposición fundamentada dentro de los veinte (20) días siguientes a ser notificada de la moción. La oposición deberá acompañarse de cualquier documento o affidávit necesario para su resolución. Si no se presenta una oposición dentro de dicho término de veinte (20) días, se entenderá que la moción queda sometida.
Toda moción se considerará sometida para resolución sin la celebración de vista a menos que el tribunal, a iniciativa propia o a solicitud de una parte, resuelva a su discreción señalarla para vista. Esta regla no aplicará a aquellas mociones que por disposición de ley y estas reglas requieran la celebración de una vista.

What this rule doesQué hace esta regla

The first paragraph sets the form. Any application for an order is by motion; unless made during a hearing or trial it must be in writing, set out the grounds and arguments with particularity and the relief sought, and be accompanied by any document or affidavit needed to decide it. That last requirement is easy to skip and costly: a motion the court cannot decide on its own papers will wait.

The second paragraph is the deadline that governs opposition practice in Puerto Rico. A party opposing files a duly grounded opposition within twenty days of service, with its own supporting documents. If no opposition is filed in twenty days, the motion is taken under advisement. Silence does not automatically grant the motion — but it does hand the court the decision on one side’s papers alone.

The third paragraph sets the default that motions are decided without a hearing. The court may set one on its own initiative or on request, at its discretion, and the rule does not apply where a statute or these rules require a hearing.

El primer párrafo fija la forma. Toda solicitud de una orden se hace por moción; salvo que se presente durante una vista o el juicio, debe ser escrita, exponer con particularidad los fundamentos y argumentos y el remedio pedido, y acompañarse de todo documento o declaración jurada necesaria para resolverla. Ese último requisito se salta con facilidad y sale caro: la moción que el tribunal no puede resolver con sus propios papeles espera.

El segundo párrafo fija el término que gobierna la práctica de oposiciones en Puerto Rico. Quien se oponga presenta una oposición debidamente fundamentada dentro de veinte días de la notificación, con sus documentos. Si no se presenta oposición en veinte días, la moción se somete. El silencio no concede la moción automáticamente, pero entrega la decisión al tribunal con los papeles de un solo lado.

El tercer párrafo establece que las mociones se resuelven sin vista. El tribunal puede señalarla por iniciativa propia o a solicitud, a su discreción, y la regla no aplica cuando la ley o estas reglas exigen vista.
