(a)In responding to a pleading, a party shall admit or deny the averments upon which the adverse party relies and shall state the party’s defenses to each claim asserted and the facts that show that the party is entitled to raise such defenses.
(b)If the party filing a responsive pleading fails to comply, in whole or in part, with the requirements provided in subdivision (a) of this rule, the court, on its own initiative or upon motion of a party, may issue an order to compel compliance with the requirements of that subdivision.
(c)If the party is without knowledge or information sufficient to form a belief as to the truth of an averment because it involves facts that could not be ascertained within the time provided for filing the responsive pleading, the party shall so state. The party thus acting must investigate the truth or falsehood of the averment denied for lack of information and knowledge and must amend the pleading within the time set by the court at the initial conference or on or before the date set for the pretrial conference. If the responsive pleader is unable to verify the averments so denied after employing available discovery methods and other reasonable diligence, the pleader must amend the pleading in order to deny the averments. If the pleading is not amended to admit or deny the averments denied for lack of knowledge or information, the averments shall be taken as admitted.
(d)Denials shall fairly meet the substance of the averments denied and shall affirmatively state the version of the facts denied by the responsive pleader. When the responsive pleader intends to deny only a part or a qualification of an averment, the pleader shall specify so much of it as is true and material and shall deny only the remainder. The responsive pleader may specifically deny each of the averments or paragraphs of the pleading or may generally deny all the averments or paragraphs of the pleading except such averments or paragraphs as the pleader expressly admits. However, when a pleader intends to deny all the averments of a pleading, the pleader may do so by general denial subject to the provisions of Rule 9.
(a)La parte a quien corresponda presentar una alegación responsiva admitirá o negará las aseveraciones en que descanse la parte contraria y expondrá sus defensas contra cada reclamación interpuesta, junto con una relación de los hechos demostrativos de que tales defensas le asisten.
(b)En caso de que la parte que presente una alegación responsiva incumpla total o parcialmente con los requisitos impuestos en el inciso (a) de esta regla, el tribunal, a iniciativa propia o a solicitud de parte, podrá dictar una orden para requerirle que satisfaga las exigencias de dicho inciso.
(c)Si la parte no tiene el conocimiento o la información suficiente para formar una opinión en cuanto a la veracidad de alguna de las aseveraciones expuestas, por tratarse de hechos que no pueden constatarse dentro del término concedido para contestar, así lo hará constar. La parte que proceda de este modo estará obligada a investigar la veracidad o falsedad de la aseveración negada por falta de información y conocimiento, y a enmendar su alegación dentro del término que fije el tribunal en la conferencia inicial o antes o en la fecha señalada para la conferencia con antelación al juicio. Si a la parte respondiente no le es posible constatar las aseveraciones así negadas, luego del uso de los métodos de descubrimiento disponibles y de otras diligencias razonables, deberá enmendar su alegación para negarla. Si la alegación no se enmienda para admitir o negar las aseveraciones negadas por falta de información y conocimiento, éstas se considerarán admitidas.
(d)Las negaciones impugnarán en lo sustancial las aseveraciones correspondientes y expresarán afirmativamente la versión de los hechos negados por la parte que presenta la alegación responsiva. Cuando la parte que presenta una alegación responsiva intente negar solamente una parte de una aseveración o una condición a una aseveración, especificará aquella parte de ella que sea cierta y material, y negará el resto. La parte respondiente podrá negar específicamente cada una de las aseveraciones o párrafos de la alegación, o podrá negar, en forma general, todas las aseveraciones o párrafos de dicha alegación, excepto aquellas aseveraciones o párrafos que ella admita expresamente. Sin embargo, si la parte se propone negar todas las aseveraciones expuestas en dicha alegación, podrá hacerlo mediante una negación general, sujeto a lo establecido en la Regla 9.

Subdivision (a) sets a standard higher than a bare denial. A responding party admits or denies the averments and states the defences to each claim together with the facts showing entitlement to raise them. An answer that lists defences without facts has not complied.
Subdivision (b) gives the court teeth: on its own initiative or on motion, it may order compliance with (a).
Subdivision (c) is the provision to watch. A party genuinely without knowledge may say so — but only where the facts could not be ascertained in the time available, and the denial carries a duty to investigate. The pleading must then be amended by the date the court sets at the initial conference or by the pretrial conference. If discovery and reasonable diligence still leave the party unable to verify, it must amend to deny. If it never amends at all, the averments are taken as admitted.
Subdivision (d) requires denials to meet the substance of what is denied and to state the responder’s own version of the facts. A partial denial must specify what is true and deny only the rest. A general denial of everything is possible but sits under Rule 9, which means the signature carries a certification the pleader may have to defend.
El inciso (a) impone un estándar más alto que la negación escueta. Quien contesta admite o niega las aseveraciones y expone sus defensas a cada reclamación junto a los hechos que la facultan a levantarlas. Una contestación que enumera defensas sin hechos no cumple.
El inciso (b) le da filo al tribunal: por iniciativa propia o a solicitud de parte, puede ordenar el cumplimiento del inciso (a).
El inciso (c) es el que hay que vigilar. Quien de veras carece de información puede decirlo, pero solo cuando los hechos no pudieran conocerse en el tiempo disponible, y la negación conlleva un deber de investigar. Hay que enmendar la alegación en la fecha que fije el tribunal en la conferencia inicial o antes de la conferencia con antelación al juicio. Si el descubrimiento y la diligencia razonable no bastan, hay que enmendar para negar. Si nunca se enmienda, las aseveraciones se tienen por admitidas.
El inciso (d) exige que las negaciones respondan a la sustancia de lo negado y expongan la versión propia de los hechos. La negación parcial debe especificar qué es cierto y negar solo el resto. La negación general de todo es posible pero queda sujeta a la Regla 9, cuya firma implica una certificación que habrá que sostener.
