When a party to a complaint is represented by an attorney, every pleading shall be signed by at least one attorney of record, who shall state his/her name, license number issued by the Supreme Court of Puerto Rico, telephone and fax numbers, mailing address, and email address as these appear in the [Roll of Attorneys] of the Supreme Court of Puerto Rico. Moreover, the first pleading submitted by the attorney shall include the street and mailing addresses and telephone number of the party he/she is representing. When a natural person is a party to the complaint and is not represented by an attorney, he/she shall sign his/her pleading and state his/her telephone number and fax numbers, mailing address, and email address, if any.
The attorney or the party shall forthwith notify the court by motion, under the caption of the case, regarding any change in telephone number, fax number, mailing address or email address.
Except when otherwise specifically provided by rule or statute, papers need not be verified or accompanied by affidavit. The signature of the attorney or the party is tantamount to certifying that the signer is willing and able to comply with the settings and orders of the court, that the signer has read the paper and that to the best of his or her knowledge, information, and belief, formed after a reasonable inquiry, the paper is duly supported by factual contentions and warranted by existing law, and that it is not being presented to cause an injustice or delay, or to harass or to increase the cost of litigation.
If a paper is signed in violation of this rule, the court, upon motion or on its own initiative, shall impose upon the signer, the represented party, or both, any sanction provided in Rule 9.3, or may enter an order to pay to the other party or parties reasonable expenses incurred as a result of the filing of the paper, including a reasonable amount in attorney’s fees.
If it is shown that a paper was filed containing false, misrepresented, defamatory or indecent information, or if offensive or vile language is used, the court shall impose any sanction provided in Rule 9.3.
Cuando la parte en el pleito tenga representación legal, todo escrito será firmado al menos por un abogado o abogada de autos, quien incluirá en el escrito su nombre, su número de abogado(a) ante el Tribunal Supremo de Puerto Rico, número de teléfono y número de fax, y su dirección postal y dirección electrónica, según consten en el registro del Tribunal Supremo de Puerto Rico. Además, en el primer escrito que presente el abogado o abogada, deberá notificar la dirección física y postal y el número de teléfono de la parte que representa. Cuando una persona natural sea parte en el pleito y no esté representada por abogado o abogada, firmará su escrito y expresará su número de teléfono, número de fax, y su dirección postal y dirección electrónica, si los tiene.
El abogado o la abogada o la parte deberá notificar inmediatamente al tribunal, mediante una moción bajo el epígrafe del caso, cualquier cambio en su número de teléfono, número de fax, y en su dirección postal o dirección electrónica.
Excepto cuando se requiera específicamente por alguna disposición legal, no será necesario jurar escrito alguno o acompañarlo de una declaración jurada. La firma del abogado o abogada, o de la parte equivale a certificar que está hábil y disponible para cumplir con los señalamientos y las órdenes del tribunal, que ha leído el escrito y que, de acuerdo con su mejor conocimiento, información y creencia, formada luego de una investigación razonable, dicho escrito está bien fundado en los hechos y respaldado por el derecho vigente, y que no se ha presentado con el propósito de causar una injusticia, dilación u opresión o de aumentar el costo del litigio.
Si un escrito se firma en violación de esta regla el tribunal, a moción de parte o a iniciativa propia, impondrá a la persona quien lo firmó, a la parte representada o a ambas, cualquier sanción conforme lo dispuesto en la Regla 9.3, o podrá incluir una orden para pagar a la otra parte o partes una suma razonable en concepto de gastos con motivo de la presentación del escrito, incluso una cantidad razonable para honorarios de abogado o abogada.
Si se determina que un escrito se ha presentado con información falsa, simulada, difamatoria o indecorosa, o se utiliza lenguaje ofensivo o soez, el tribunal impondrá cualquier sanción conforme lo dispuesto en la Regla 9.3.
What this rule doesQué hace esta regla
The first two paragraphs are administrative and worth doing right. A represented party’s pleadings are signed by at least one attorney of record, who states name, Supreme Court licence number, telephone and fax, mailing address and email as they appear in the Roll of Attorneys. The first pleading also gives the client’s street and mailing addresses and telephone. An unrepresented natural person signs and gives the same contact details. Any change must be reported to the court promptly by motion under the case caption.
The third paragraph is the heart. Papers need not be verified. Instead, the signature itself certifies four things: that the signer is willing and able to comply with the settings and orders of the court; that the signer read the paper; that after reasonable inquiry it is supported by factual contentions and warranted by existing law; and that it is not presented to cause injustice or delay, to harass, or to increase the cost of litigation.
The first of those four is unusual. Most jurisdictions certify only the paper’s content; Puerto Rico also makes the signer vouch that they can actually keep the schedule.
The sanctions come in two tiers. For a paper signed in violation of the rule, the court may impose any sanction in Rule 9.3 on the signer, the represented party or both, or order payment of the other side’s reasonable expenses including attorney’s fees. For a paper containing false, misrepresented, defamatory or indecent information, or offensive or vile language, the rule says the court shall impose a Rule 9.3 sanction.
Los dos primeros párrafos son administrativos y conviene hacerlos bien. Las alegaciones de una parte representada las firma al menos un abogado de récord, que consigna nombre, número de licencia del Tribunal Supremo, teléfono y fax, dirección postal y correo electrónico según aparecen en el Registro de Abogados. La primera alegación incluye además la dirección física y postal y el teléfono del cliente. Quien no tiene representación firma y da los mismos datos. Todo cambio se notifica al tribunal sin demora, por moción bajo el epígrafe del caso.
El tercer párrafo es el corazón. Los escritos no necesitan jurarse. En su lugar, la firma certifica cuatro cosas: que quien firma está dispuesta y en condiciones de cumplir con los señalamientos y órdenes del tribunal; que leyó el escrito; que tras una investigación razonable se sostiene en contenciones de hecho y en el derecho vigente; y que no se presenta para causar injusticia o dilación, hostigar ni encarecer el litigio.
La primera de las cuatro es inusual. La mayoría de las jurisdicciones certifica solo el contenido; Puerto Rico exige además responder por poder cumplir el calendario.
Las sanciones vienen en dos niveles. Por un escrito firmado en violación de la regla, el tribunal puede imponer cualquier sanción de la Regla 9.3 a quien firma, a la parte representada o a ambas, u ordenar el pago de los gastos razonables de la otra parte, incluidos honorarios. Por un escrito con información falsa, tergiversada, difamatoria o indecente, o lenguaje ofensivo o vil, la regla dispone que el tribunal impondrá una sanción de la Regla 9.3.
