(a)When an appeal is taken from or review sought of an order or judgment granting, dissolving or denying an injunction, the trial court, in its discretion, may suspend, modify, restore, or grant an injunction during the pendency of the appeal upon such terms as to bond or other matters as may be proper for the security of the rights of the adverse party.
(b)The provisions of this rule do not limit the power of the appellate court of or of a judge or justice thereof to stay proceedings during the pendency of an appeal or to suspend, modify, restore, or grant an injunction during the pendency of an appeal or certiorari, or to make any order appropriate to preserve the status quo or the effectiveness of the judgment subsequently to be entered. However, when an appeal is taken from an order dissolving or denying a temporary restraining order, the appellate court may only issue, while the appeal is pending, an ex parte provisional order that shall not exceed the ten (10) days fixed for such extraordinary remedy, unless the court expressly extends such term under Rule 57.1.
(a)Cuando una parte apele o recurra de una orden o sentencia que conceda, deje sin efecto o deniegue un injunction, el tribunal de instancia, en el ejercicio de su discreción, podrá suspender, modificar, restituir o conceder un injunction mientras se dilucida el recurso interpuesto bajo aquellos términos relativos a fianza y demás que estime adecuados para proteger los derechos de la parte contraria.
(b)Lo dispuesto en esta regla no restringe la facultad del tribunal de apelación o de uno de sus jueces o una de sus juezas para paralizar los procedimientos mientras se dilucida el recurso interpuesto o para suspender, modificar, restituir o conceder un injunction mientras esté pendiente la apelación o certiorari, o para dictar cualquier orden adecuada para preservar el status quo o la efectividad de la sentencia que habrá de emitirse en su día. No obstante, cuando una parte recurra de una orden que deje sin efecto o deniegue un entredicho provisional, el tribunal de apelación sólo podrá emitir, mientras dilucida el recurso interpuesto, una orden provisional “ex parte” que no debe excederse del término de diez (10) días que caracteriza a dicho recurso extraordinario, salvo que el tribunal expresamente prorrogue dicho término en conformidad con la Regla 57.1.

(a) The trial court keeps power. When an appeal is taken from, or review sought of, an order or judgment granting, dissolving or denying an injunction, the trial court in its discretion may suspend, modify, restore, or grant an injunction during the pendency of the appeal, on such terms as to bond or other matters as may be proper for the security of the rights of the adverse party.
(b) So does the appellate court. Nothing in the rule limits the power of the appellate court, or a judge or justice of it, to stay proceedings during an appeal, to suspend, modify, restore, or grant an injunction during an appeal or certiorari, or to make any order appropriate to preserve the status quo or the effectiveness of the judgment subsequently to be entered.
One cap. When an appeal is taken from an order dissolving or denying a temporary restraining order, the appellate court may issue, while the appeal is pending, only an ex parte provisional order, and it shall not exceed the ten days fixed for such extraordinary remedy — unless the court expressly extends that term under Rule 57.1.
The logic is that appellate review cannot give a TRO a longer life than the trial court could have given it. Ten days is ten days, wherever the order comes from.
Rule 52.3(c) points here: on a petition for certification, temporary restraining orders and injunctions are governed by this rule.
(a) El tribunal de instancia conserva facultad. Cuando se apela, o se pide revisión, de una orden o sentencia que conceda, disuelva o deniegue un injunction, el tribunal de instancia en su discreción puede suspender, modificar, restablecer o conceder un injunction durante la pendencia del recurso, en los términos de fianza u otros que sean propios para garantizar los derechos de la parte adversa.
(b) También el tribunal apelativo. Nada en la regla limita la facultad del tribunal apelativo, o de un juez o jueza de él, para paralizar los procedimientos durante el recurso, para suspender, modificar, restablecer o conceder un injunction durante una apelación o certiorari, o para dictar cualquier orden apropiada que preserve el estado de cosas o la eficacia de la sentencia que luego se dicte.
Un tope. Cuando se apela de una orden que disuelve o deniega un entredicho provisional, el tribunal apelativo solo puede expedir, pendiente el recurso, una orden provisional ex parte, y esta no excederá los diez días fijados para tal remedio extraordinario, salvo que el tribunal prorrogue expresamente ese término conforme a la Regla 57.1.
La lógica es que la revisión apelativa no puede darle al entredicho una vida más larga que la que el tribunal de instancia podía darle. Diez días son diez días, venga de donde venga la orden.
La Regla 52.3(c) remite aquí: en un recurso de certificación, los entredichos provisionales y los injunctions se rigen por esta regla.
