A temporary restraining order may be granted without notice to the adverse party or that party’s attorney only if:
(a)it clearly appears from the facts shown by affidavit or by the verified complaint that immediate and irreparable injury, loss, or damage will result to the applicant before the adverse party or that party’s attorney can be notified and heard, and
(b)the applicant or the applicant’s attorney certifies to the court in writing the efforts, if any, that have been made to give the notice and the reasons supporting the claim that notice should not be required.
Every temporary restraining order granted without notice shall be indorsed with the date and hour of issuance; shall be filed forthwith in the clerk’s office and entered of record; shall define the injury and state why it is irreparable and why the order was granted without notice; and shall expire by its terms within such time after entry, not to exceed ten (10) days, as the court fixes, unless within the time so fixed the order, for good cause shown, is extended for a like period or unless the party against whom the order is directed consents that it may be extended for a longer period. The reasons for the extension shall be entered of record. In case a temporary restraining order is granted without notice, the motion for a preliminary injunction shall be set down for hearing at the earliest possible time and takes precedence of all matters except older matters of the same character. When the motion comes on for hearing, the party who obtained the temporary restraining order shall proceed with the application for a preliminary injunction and, if the party does not do so, the court shall dissolve the temporary restraining order. On two (2) days’ notice to the party who obtained the temporary restraining order without notice or on such shorter notice to that party as the court may prescribe, the adverse party may appear and move for its dissolution or modification and in that event the court shall proceed to hear and determine such motion as expeditiously as the ends of justice require.
Una orden de entredicho provisional podrá ser dictada sin notificación previa a la parte adversa o a su abogado o abogada únicamente si:
(a)aparece claramente de los hechos expuestos en una declaración jurada o en la demanda jurada que se causarán perjuicios, pérdidas o daños inmediatos e irreparables a la parte solicitante antes de que se pueda notificar y oír a la parte adversa o a su abogado o abogada, y
(b)si el abogado o abogada del solicitante o la misma parte solicitante certifica por escrito al tribunal las diligencias que se hayan hecho, si alguna, para la notificación y las razones en que funda su solicitud para que no se requiera dicha notificación.
Toda orden de entredicho provisional concedida sin notificación previa llevará constancia de la fecha y la hora de su expedición; será archivada inmediatamente en la Secretaría del tribunal y registrada; se definirá en ella el perjuicio y se hará constar por qué éste es irreparable y la razón por la cual se expidió la orden sin notificación previa, y de acuerdo con sus términos, expirará dentro de un período de tiempo después de ser registrada, que será fijado por el tribunal y no excederá de diez (10) días, a menos que sea prorrogada dentro del término así fijado por causa justa probada y por un período de tiempo igual, o a menos que la parte contra la cual se haya dictado la orden dé su consentimiento para que sea prorrogada por un período mayor. Las razones que haya para tal prórroga se harán constar en el expediente. En caso de que se dicte una orden de entredicho provisional sin notificación previa, la moción para un auto de injunction preliminar será señalada para ser vista en la fecha más próxima que sea posible y tendrá preferencia sobre todos los demás asuntos, excepto aquellos que sean más antiguos y de la misma naturaleza. Cuando la moción sea llamada para vista, la parte que obtuvo la orden de entredicho provisional procederá con su solicitud de injunction preliminar y, si así no lo hace, el tribunal la dejará sin efecto. Con dos (2) días de aviso a la parte que obtuvo la orden de entredicho provisional, sin aviso o previo aviso por un término más corto a dicha parte según lo disponga el tribunal, la parte adversa podrá comparecer y solicitar la disolución o modificación de la orden, y en ese caso se procederá a oír y resolver la moción con toda la prontitud que requieran los fines de la justicia.

The two conditions, both required. A temporary restraining order may issue without notice only if: (a) it clearly appears from the facts shown by affidavit or by the verified complaint that immediate and irreparable injury, loss, or damage will result to the applicant before the adverse party or that party’s attorney can be notified and heard; and (b) the applicant or applicant’s attorney certifies to the court in writing the efforts, if any, that have been made to give the notice and the reasons supporting the claim that notice should not be required.
The timing in (a) is precise. The question is not whether harm will occur, but whether it will occur before the other side can be notified and heard. If a hearing can be held in time, notice is required.
What the order must show. Every TRO granted without notice is indorsed with the date and hour of issuance, filed forthwith in the clerk’s office and entered of record, and must define the injury, state why it is irreparable, and state why the order was granted without notice.
Ten days, then it expires. The order expires by its terms within such time after entry, not to exceed ten days, as the court fixes — unless within that time it is extended for a like period for good cause shown, or unless the party against whom it is directed consents to a longer period. The reasons for any extension are entered of record.
The hearing comes fast, and the applicant must show up. Where a TRO issues without notice, the motion for a preliminary injunction is set down at the earliest possible time and takes precedence of all matters except older matters of the same character. When it is called, the party who obtained the TRO shall proceed with the application — and if it does not, the court shall dissolve the temporary restraining order.
The other side can move first. On two days’ notice to the party who obtained the order without notice, or such shorter notice as the court prescribes, the adverse party may appear and move to dissolve or modify it, and the court shall hear and determine the motion as expeditiously as the ends of justice require.
Las dos condiciones, ambas exigidas. El entredicho provisional puede dictarse sin notificación solo si: (a)surge claramente de los hechos expuestos en declaración jurada o en la demanda jurada que se causará a quien solicita un daño, pérdida o perjuicio inmediato e irreparable antes de que pueda notificarse y oírse a la parte adversa o a su abogado o abogada; y (b) quien solicita, o su representación legal, certifica al tribunal por escrito las gestiones, si alguna, realizadas para notificar y las razones que sostienen que no debe exigirse la notificación.
El momento que fija el inciso (a) es preciso. La pregunta no es si habrá daño, sino si lo habrá antes de que pueda notificarse y oírse a la otra parte. Si da tiempo de celebrar una vista, hay que notificar.
Qué debe hacer constar la orden. Todo entredicho concedido sin notificación se anota con la fecha y la hora de expedición, se presenta inmediatamente en la secretaría y se registra, y debe definir el daño, exponer por qué es irreparable y por qué se concedió sin notificación.
Diez días, y expira. La orden expira por sus propios términos en el plazo que el tribunal fije tras el registro, que no excederá de diez días, salvo que dentro de ese plazo se prorrogue por un período igual con justa causa o que la parte contra quien va dirigida consienta a un período mayor. Las razones de la prórroga se harán constar en el récord.
La vista llega rápido, y quien solicitó debe comparecer. Cuando el entredicho se expide sin notificación, la moción de injunction preliminar se señala a la brevedad posible y tiene precedencia sobre todos los asuntos, salvo los de igual naturaleza que sean más antiguos. Llegada la vista, quien obtuvo el entredicho proseguirá con la solicitud, y si no lo hace, el tribunal disolverá el entredicho provisional.
La otra parte puede adelantarse. Con dos días de notificación a quien obtuvo la orden sin notificación, o el término más corto que el tribunal fije, la parte adversa puede comparecer y pedir que se disuelva o modifique, y el tribunal atenderá y resolverá la moción con la prontitud que los fines de la justicia requieran.
