No order shall issue under this Rule 56.5 to do or to desist from doing any specific act without serving notice upon the adverse party, unless it clearly appears from specific facts supported by affidavit that the party requesting such order will sustain irreparable injury, damage or loss, or upon a showing of extraordinary circumstances or likelihood of success through clear and convincing documentary evidence. Such ex parte order shall take effect upon service of notice thereof. Any party affected thereby may at any time file a motion to modify or set aside the order, and a hearing on said motion shall be held at the earliest possible date, but not later than five (5) days after the motion was filed, and shall take precedence over all other matters. A two-day notice upon the party obtaining the order, or the shortest notice the court may prescribe, shall be sufficient for the purposes of the hearing.
No se concederá ninguna orden bajo esta Regla 56.5 para hacer o desistir de hacer cualquier acto específico sin una notificación a la parte adversa, a menos que aparezca claramente de los hechos específicos acreditados por declaración jurada que el solicitante sufrirá perjuicios, daños o pérdidas irreparables, o que se demuestre la existencia de circunstancias extraordinarias o que tenga la probabilidad de prevalecer mediante prueba documental fehaciente, antes de notificarse y de celebrarse una vista sobre la solicitud. What this rule doesQué hace esta regla

Notice first, unless. No order to do or desist from doing a specific act issues under this rule without notice to the adverse party — unless it clearly appears from specific facts supported by affidavit that the requesting party will sustain irreparable injury, damage or loss, or on a showing of extraordinary circumstances or likelihood of success through clear and convincing documentary evidence.

Notice the standard: not general allegations but specific facts, and not argument but affidavit.

When it starts working. The ex parte order takes effect upon service of notice thereof. It binds when the affected party learns of it, not when it is signed.

The answer. Any affected party may at any time move to modify or set it aside. The hearing is held at the earliest possible date, but not later than five days after the motion was filed, and takes precedence over all other matters. Two days’ notice to the party who obtained the order — or the shortest the court prescribes — is enough.

That five-day outer limit is the sharpest difference from Rule 56.4, which sets no maximum for its hearing. An order commanding conduct gets an even faster review than an order freezing property.

Repárese en el estándar: no alegaciones generales sino hechos específicos, y no argumento sino declaración jurada.

Cuándo empieza a regir. La orden ex parte surte efecto al notificarse. Obliga cuando la parte afectada se entera, no cuando se firma.

La respuesta. Cualquier parte afectada puede en cualquier momento pedir que se modifique o se deje sin efecto. La vista se celebra a la brevedad posible, pero no más tarde de cinco días de presentada la moción, y tiene precedencia sobre todos los demás asuntos. Bastan dos días de notificación a quien obtuvo la orden, o el término más corto que el tribunal fije.

Ese límite exterior de cinco días es la diferencia más marcada con la Regla 56.4, que no fija máximo para su vista. La orden que manda una conducta recibe una revisión aún más rápida que la que congela bienes.
