If the requirements of Rule 56.3 have been met, the court shall issue, on motion of a claimant, an order of attachment or of prohibition to alienate.
No order of attachment or of prohibition to alienate may issue without prior notice and a hearing, except on a showing by the claimant of a previous proprietary interest in the attached goods, extraordinary circumstances, or likelihood of success through clear and convincing documentary evidence that the debt is liquid, due and demandable.
Any party affected by any order issued without prior notice and hearing may at any time file a motion to modify or set aside the order, and a hearing on said motion shall be held at the earliest possible date and shall take precedence over all other matters. A two (2)-day notice upon the party obtaining the order, or the shortest notice the court may prescribe, shall be sufficient for purposes of the hearing.
In the case of real property, the attachment and the prohibition to alienate shall be effected by entry in the Registry of Property and notice served on the defendant. In case of personal property, the order shall be carried out by depositing such personal property with the court or with the person designated by it under the claimant’s responsibility. On motion of any of the parties, the court may order the public sale of fungible goods whose attachment or prohibition to alienate had been issued, and the proceeds from the sale shall be deposited in the manner prescribed by the court.
The party requesting the appointment of a depositary of the property to be attached shall furnish the address and telephone number, if any, of his or her home and place of employment or business. The appointed depositary shall immediately notify the court, under the caption of the case, any change of address or telephone number, and of the place or conditions of the property attached.
Si se cumple con los requisitos de la Regla 56.3, el tribunal deberá expedir, a moción de la parte reclamante, una orden de embargo o de prohibición de enajenar.
No se podrá expedir una orden de embargo o prohibición de enajenar sin previa notificación y vista, excepto que la parte reclamante demuestre tener un previo interés propietario sobre la cosa embargada, la existencia de circunstancias extraordinarias o la probabilidad de prevalecer mediante prueba documental fehaciente que demuestre que la deuda es líquida, vencida y exigible.
Cualquier parte afectada por cualquier orden dictada sin notificación y vista podrá presentar en cualquier tiempo una moción para que modifique o se anule la orden, y dicha moción se señalará para vista en la fecha más próxima posible y tendrá precedencia sobre todos los demás asuntos. A los propósitos de dicha vista, una notificación de dos días a la parte que obtuvo la orden, o la notificación más corta que el tribunal prescriba, será suficiente.
En el caso de bienes inmuebles, tanto el embargo como la prohibición de enajenar se efectuarán anotándolos en el registro de la propiedad y notificándolos a la parte demandada. En el caso de bienes muebles, la orden se efectuará depositando los bienes de que se trate con el tribunal o con la persona designada por el tribunal bajo la responsabilidad de la parte reclamante. El tribunal podrá ordenar, a petición de cualquiera de las partes, la venta en pública subasta de los bienes fungibles cuyo embargo o prohibición de enajenar se haya decretado, consignándose el producto de su venta en la forma dispuesta por el tribunal.
La parte que solicite la designación de una persona como depositario de los bienes a embargarse deberá acreditar su dirección y teléfono, si lo tiene, tanto residencial como de empleo o negocio. El depositario designado o la depositaria designada deberá notificar inmediatamente al tribunal, bajo el epígrafe del caso, cualquier cambio de dirección o teléfono, de sitio o condición de los bienes.

The grant. If Rule 56.3’s requirements are met, the court shall issue, on the claimant’s motion, an order of attachment or of prohibition to alienate.
Notice is the default. No such order issues without prior notice and a hearing except on a showing of one of three things: a previous proprietary interest in the attached goods, extraordinary circumstances, or likelihood of success through clear and convincing documentary evidence that the debt is liquid, due and demandable.
The immediate answer. Any party affected by an order issued without prior notice may at any time move to modify or set it aside. The hearing is held at the earliest possible date and takes precedence over all other matters; two days’ notice to the party who obtained the order — or the shortest notice the court prescribes — is enough.
How the orders bite. On real property, attachment and prohibition to alienate are effected by entry in the Registry of Property and notice served on the defendant. On personal property, by depositing the property with the court or with the person the court designates, under the claimant’s responsibility.
Perishables can be turned into money. On motion of any party, the court may order the public sale of fungible goods under attachment or prohibition to alienate, with the proceeds deposited as the court prescribes.
The depositary is accountable. A party requesting the appointment of a depositary must furnish the address and telephone number of home and place of employment or business. The depositary must immediately notify the court, under the caption of the case, of any change of address or telephone number and of the place or conditions of the property attached.
La concesión. Cumplidos los requisitos de la Regla 56.3, el tribunal expedirá, a moción de la parte reclamante, una orden de embargo o de prohibición de enajenar.
La notificación es la norma. No se expide tal orden sin notificación previa y vista salvo que se demuestre una de tres cosas: un interés propietario previo sobre los bienes a embargarse, circunstancias extraordinarias, o probabilidad de prevalecer mediante prueba documental clara y convincente de que la deuda es líquida, vencida y exigible.
La respuesta inmediata. Cualquier parte afectada por una orden dictada sin notificación previa puede en cualquier momento pedir que se modifique o se deje sin efecto. La vista se celebra a la brevedad posible y tiene precedencia sobre todos los demás asuntos; bastan dos días de notificación a quien obtuvo la orden, o el término más corto que el tribunal fije.
Cómo operan las órdenes. Sobre bienes inmuebles, el embargo y la prohibición de enajenar se efectúan mediante anotación en el Registro de la Propiedad y notificación a la parte demandada. Sobre bienes muebles, mediante depósito en el tribunal o en la persona que este designe, bajo la responsabilidad de la parte reclamante.
Lo perecedero puede convertirse en dinero. A moción de cualquier parte, el tribunal puede ordenar la venta pública de bienes fungibles sobre los que recae el embargo o la prohibición, y el producto se deposita según él disponga.
El depositario responde. Quien solicite el nombramiento de un depositario debe proveer la dirección y el teléfono de su hogar y de su empleo o negocio. El depositario debe notificar de inmediato al tribunal, bajo el epígrafe del caso, todo cambio de dirección o teléfono y del lugar o las condiciones de los bienes embargados.
