The remedy heretofore available by a writ of mandamus, whether peremptory or alternative, may be obtained by filing a verified petition therefor. Whenever such remedy is sought and the right to demand immediate performance of an act is evident and it appears that there is no excuse for not performing it, the court may peremptorily order that such remedy be granted; otherwise, it shall order that an answer be filed, and as soon as is practicable, shall hold a hearing and receive evidence, if necessary, and shall promptly make a decision. Compliance with the orders entered by the court shall be in the same manner as is required with respect to any other order.
El auto de mandamus, tanto perentorio como alternativo, podrá obtenerse presentando una solicitud jurada al efecto. Cuando se solicite dicho remedio y el derecho a exigir la inmediata ejecución de un acto sea evidente y aparezca que no se podrá dar ninguna excusa para no ejecutarlo, el tribunal podrá ordenar perentoriamente la concesión del remedio; de otro modo, ordenará que se presente una contestación. Tan pronto sea conveniente, el tribunal celebrará una vista, recibiendo prueba, si es necesario, y dictará su decisión prontamente. Se obtendrá el cumplimiento de las órdenes dictadas por el tribunal del mismo modo en que se exige el cumplimiento de cualquier otra orden.

How it is started. The remedy formerly available by writ of mandamus, whether peremptory or alternative, is obtained by filing a verified petition. There is no separate writ practice to learn — the petition is the vehicle.
The fast track. Where the right to demand immediate performance of an act is evident and it appears there is no excuse for not performing it, the court may peremptorily order that the remedy be granted. Both conditions have to be obvious on their face; mandamus is not a way to litigate a contested duty quickly.
Otherwise, the ordinary path. The court orders an answer filed and, as soon as is practicable, holds a hearing, receives evidence if necessary, and promptly makes a decision. Speed is built into every step, but so is the chance to be heard.
Enforcement is nothing special. Compliance with the court’s orders is required in the same manner as with any other order — the contempt and execution machinery of the rest of the rules applies.
Cómo se inicia. El remedio que antes se obtenía mediante auto de mandamus, perentorio o alternativo, se obtiene presentando una solicitud jurada. No hay una práctica de autos aparte que aprender: la solicitud es el vehículo.
La vía rápida. Cuando el derecho a exigir el cumplimiento inmediato de un acto es evidente y surge que no hay excusa para no cumplirlo, el tribunal puede ordenar perentoriamente que se conceda el remedio. Ambas condiciones tienen que ser obvias; el mandamus no es una manera de litigar rápido un deber discutido.
De lo contrario, la vía ordinaria. El tribunal ordena que se conteste y, tan pronto sea practicable, celebra vista, recibe prueba si es necesario y resuelve con prontitud. La rapidez está en cada paso, y también la oportunidad de ser oído.
La ejecución no tiene nada de especial. El cumplimiento de las órdenes se exige en la misma forma que con cualquier otra orden: aplica la maquinaria de desacato y ejecución del resto de las reglas.
