Witnesses outside of the jurisdiction shall be compelled to appear for the taking of a deposition by way of a commission or letters rogatory directed to the competent judicial authority of the place where the witness is located. The testimony of such witnesses shall be taken by deposition under Rule 25.2, and the transcript of said testimony may be used in lieu of the testimony.
Las personas testigos que se encuentren fuera de la jurisdicción se citarán para la toma de una deposición mediante una comisión o suplicatoria dirigida a la autoridad judicial competente del lugar donde se encuentra el testigo. Su testimonio será tomado mediante una deposición según lo establecido en la Regla 25.2 y la transcripción de dicho testimonio podrá ser utilizada en sustitución del testimonio.

A Puerto Rico subpoena does not run beyond the jurisdiction, so this rule supplies the route that does.
Witnesses outside the jurisdiction are compelled to appear for a deposition by way of a commission or letters rogatory directed to the competent judicial authority of the place where the witness is located. The compulsion comes from that authority, not from this court.
The testimony is then taken by deposition under Rule 25.2 — which is where the three routes for depositions abroad live, and which contains the important sentence forgiving foreign departures from Puerto Rico formalities.
And the payoff: the transcript of that testimony may be used in lieu of the testimony. That is a direct authorisation, and it sits alongside Rule 29.1(c)(2), which independently allows a deposition to be used where requiring the attendance of a witness not in Puerto Rico would be burdensome.
Practically, remote depositions under Rule 27.4 have made this route less necessary for cooperative witnesses. It remains the only method for one who will not appear voluntarily.

A los testigos fuera de la jurisdicción se les compele a comparecer a deposición mediante comisión o exhorto dirigido a la autoridad judicial competente del lugar donde se encuentre el testigo. La coerción viene de esa autoridad, no de este tribunal.
El testimonio se toma entonces por deposición bajo la Regla 25.2, donde viven las tres vías para deposiciones en el exterior y donde está la oración importante que perdona las diferencias de formalidad extranjeras.
Y el rendimiento: la transcripción de ese testimonio puede usarse en lugar del testimonio. Es una autorización directa, y convive con la Regla 29.1(c)(2), que de forma independiente permite usar una deposición cuando exigir la comparecencia de quien no está en Puerto Rico resultaría oneroso.
En la práctica, las deposiciones remotas de la Regla 27.4 han hecho menos necesaria esta vía para testigos cooperadores. Sigue siendo el único método para quien no comparece voluntariamente.
