Outside the jurisdiction of the Commonwealth of Puerto Rico, depositions will be taken on notice:
(1)before a person authorized to administer oaths in Puerto Rico or in the place where the examination is held;
(2)before a person or officer commissioned by the court for this purpose; or
(3)pursuant to a letter rogatory.
A commission or letter rogatory shall be issued only when necessary or convenient on application and on terms and directions that are just and appropriate. Officers may be designated in notices or commissions either by name or by descriptive title, and letters rogatory may be addressed “To the Appropriate Authority in (here the name of the place).” Evidence obtained in response to a letter rogatory need not be excluded merely because it is not a verbatim transcript, because the testimony was not taken under oath, or because of any similar departure from the requirements for depositions taken within Puerto Rico.
Fuera de la jurisdicción del Estado Libre Asociado de Puerto Rico se tomarán las deposiciones previa notificación:
(1)ante una persona autorizada a tomar juramentos en Puerto Rico o en el lugar donde se vaya a tomar la deposición;
(2)ante la persona o el funcionario o la funcionaria que pueda ser designado o designada por un tribunal mediante comisión para esos fines, o
(3)por medio de una suplicatoria.
Una comisión o suplicatoria será expedida solamente cuando sea necesario o conveniente, mediante petición, bajo los términos y de acuerdo con las instrucciones que sean justas y apropiadas. Los funcionarios o las funcionarias podrán designarse en las notificaciones o comisiones por su nombre o por su título descriptivo, y las suplicatorias podrán ser dirigidas “A la Autoridad Judicial Competente en (aquí el nombre del lugar)”. La prueba obtenida como resultado de una suplicatoria no debe ser excluida meramente por el fundamento de que no constituye una transcripción verbatim, porque el testimonio no se tomó bajo juramento o por no cumplir con algún requisito similar a los exigidos para las deposiciones tomadas dentro de Puerto Rico.

What this rule doesQué hace esta regla

Three routes. (1) Before a person authorised to administer oaths in Puerto Rico or in the place where the examination is held. (2) Before a person or officer commissioned by the court. (3) Pursuant to a letter rogatory — the formal request from one jurisdiction’s courts to another’s.

A commission or letter rogatory issues only when necessary or convenient, on application and on just and appropriate terms. Officers may be designated by name or by descriptive title, and a letter rogatory may simply be addressed "To the Appropriate Authority in [place]" — which is what makes it workable when you do not know who will handle it.

The final sentence is the one that saves foreign evidence. Testimony obtained on a letter rogatory need not be excluded merely because it is not a verbatim transcript, or was not taken under oath, or departs in some similar way from what Puerto Rico requires at home. Other legal systems take evidence differently, and the rule declines to punish a party for that.

Tres vías. (1) Ante quien esté autorizado a tomar juramentos en Puerto Rico o en el lugar donde se celebre el examen. (2) Ante una persona o funcionario comisionado por el tribunal. (3) Mediante exhorto, la petición formal de los tribunales de una jurisdicción a los de otra.

La comisión o el exhorto se expiden solo cuando sea necesario o conveniente, a solicitud y bajo términos justos y apropiados. Los funcionarios pueden designarse por nombre o por título descriptivo, y el exhorto puede dirigirse simplemente “A la autoridad correspondiente en [lugar]”, que es lo que lo hace viable cuando no se sabe quién lo atenderá.

La oración final es la que salva la prueba extranjera. El testimonio obtenido por exhorto no se excluirá meramente porque no sea una transcripción literal, o no se haya tomado bajo juramento, o se aparte de algún modo similar de lo que Puerto Rico exige en casa. Otros sistemas toman la prueba de otra manera, y la regla se niega a castigar a una parte por ello.
